Justice help all terrorist victims
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.
This importantly should include the partners and children of same
sex unions. They suffer just as grievously for their deceased loved
ones as do other survivors, and their need for assistance is just as
great.
Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions. They are
interested in a political victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Equal rights for survivors

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

911 Fund Gay DISCRIMINATION
America is once again retreating back into its pre-911 disunity and bigotry
again i see. If homosexuals can save lives, if homosexuals can be heroes,
and if homosexuals can donate millions to the fund, why can't they get
relief? Especially if illegal aliens can??? This is the chance for the
federal government to finally stand up and make a difference and change the
way this nation treats its gays once and for all. If the government says:
"yes, we WILL recognize homosexuals as citizens, patriots and heros for this
country, yes we will not DENY them the aide that all heterosexuals are being
openly encouraged to partake in, yes, we will do it with full confidence
that THIS IS THE AMERICAN WAY," then maybe this country can step into the
21st century, and start living up to the ideals that it was founded on, and
that brought billions upon billions to these shores over the last 250 years
in search for life, liberty and the pursuit of happiness. It is time we
stop DISCRIMINATING against ANY of our legal citizens for any reason
whatsoever--whether it be for race, religion, political perscription, or
sexual orientation. This is not TWO SOCIETIES. This is not TWO countries.
This is the UNITED STATES OF AMERICA, one nation, indivisible, with LIBERTY
AND JUSTICE FOR ALL!!! Lets start acting like it!

Mr. Feinberg,
While I by no means consider myself to be an "activist," I feel I must take
issue with comments made by you on "Meet the Press" on Sunday, March 10,
2002. The comments I make reference to are those directed at Gay and Lesbian
AMERICANS whose partners perished in that terrible, unforgivable act of
terrorism on September 11, 2001.
During that interview, you indicated that surviving partners will not
necessarily be eligible for the same compensation as heterosexual family
members who lost their loved ones. Your rational behind this position seemed
to be that you were simply following guidelines on how individual states
addressed "domestic partnerships."
As I understand it (and please, by all means, correct me if I am wrong),
surviving family members of ILLEGAL IMMIGRANTS will be fully compensated,
but because you are following "State Laws," surviving gay partners are not
afforded the same consideration.
So let me get this STRAIGHT (every pun intended). This country, this land
that I love, the home of the free and the brave, gives more consideration to
an illegal immigrants surviving family members that it does to the surviving
partners and children and gay and lesbian men and women who perished?
Pray tell, how is it that a gay man or woman's life is less valuable than
someone who has entered this country ILLEGALLY??? If you want to follow laws
when deciding who deserves what compensation, why not take into consideration
FEDERAL LAW??
You sir, with all due respect, are an idiot.
Let me assure you of this. The gay men and women (with the exception of the
illegal immigrants) who went down with the towers that paid their taxes, bled
red the same as all the other victims. And their survivors hurt just as badly
as all the other survivors.
Actually, thanks to you and your draconian way of thinking, they now hurt
much worse.
I suppose this is just another example of "dubyas" philosophy of
"compassionate conservatism."

FW: [GayCityDiscussion] 911 Fund to Discriminate against gays
Frankly, I'm kinda disgusted with The Fund. The whole point of including
illegal aliens and possibly (heterosexual) domestic partners, is to NOT make
judgments about who people were and the lives they led because this tragedy
touched EVERY American, and we all want to support the victims/loved ones
left behind. NO ONE should be left out if they can clearly establish a

THE LIST: 9/11 Fund Screws Gays
Read the following article (below my comments) -- Kenneth Feinberg and
Attorney General John Ashcroft are not acting as responsible human beings,
how dare they. They are both puppets of the Religious Right. Unthinking,
uncaring, irresponsible idiots. All people involved as victims, or relatives
and friends of all those victims in these acts of violence on 9/11, are

I would have never guessed that we would need to make policy for the victims' families for the September 11 bombings.
I guess it never dawned on me that these victims would try to milk the system and get rich.
The New York Times Article said that you invited public comment on whether you were permitted by law to make rewards without regard to what the victims had already received by charitable donation. I would have said no before reading the Times article, and even though the Times article leans in the direction of not capping the donations, I now have to say yes. Yes we will have to take into consideration all donations, because sadly but true, there will be some scam perpetrated by one of the victims. It may only be one person who will try and get rich quick off of this, but it will still be one to many, because it is wrong for anyone to profit from the loss of human life.

Don't Discriminate!
Dear Attorney General Ashcroft,
The deaths on September 11th were the result of an attack not only on
America itself, but on our way of life -- a way of life that is founded on
and guarantees the right of individuals to live their life in whatever way
they choose as long as it does not impinge on the rights of others to do
the same. Please do not discriminate against the unmarried partners of
September 11th victims. All unmarried partners, gay or straight, young and
old and their dependents should be eligible for compensation.

To Whom It May Concern,
Since September 11th my family and I are faced with dealing with grief we
have never known before. My sister's husband worked for  ,
  and  . He loved his job and looked forward to going to work
daily. Sadly he lost his life in World Trade Tower One. My sister, her
children and our extended family are all trying to accept and cope with the
reality of this situation.
Last Wednesday evening, January 18th, I attended one of  
meetings, in order to help my sister better understand the guidelines of the
September 11th Victim's Compensation Fund of 2001. Ken Feinberg, Special
Master of the bureau, was there to speak. Together with my sister we learned
the following:
· The formula that will be used to determine awards does not allow an
"across the board" evaluation of each claim.
· Workmen's Compensation, Social Security, and life insurance awards will
offset the amount given to each family by the fund.
· There is no minimum guaranteed amount yet a cap has been set regarding
maximum amount.
· If families who lost loved ones were not feeling their award was fair
then they have the option to put together a brief as to why they feel their
award should be changed. The burden of proof becomes the responsibility of
each individual family, requiring documentation and legal assistance, in
order to prove their case.
Clearly the plan presents inconsistencies and flaws. Why should these
families, who are going through so much pain and suffering, be expected to
prove the worth of their lost loved one? It is my feeling that this is an
inappropriate challenge. How dare the government increase the pain and
suffering of these families. Families should not be penalized because of
careful future planning which may have included the purchase of life
insurance. When members of the audience raised concerns and questions, the "special
master" did not always have answers. At times Mr. Feinberg seemed vague.
Some questions he could not answer. He expected grieving families to
entertain his responses by "reading between the lines" and simply trusting
him. How are they to trust a man who exhibited little compassion to their
circumstances?
My greatest concern after hearing the "special master" speak, is that the
federal government is forcing him to keep within the established rules that
have been in place for more "common" disasters. I do not think that you will
find anyone who would disagree that this unique tragedy calls for unique
guidelines. Another presumptive award, that is more typical of the
circumstances, needs to be established. How do you expect families directly
affected by this tragedy, to participate in this program the way it is
presently set up?
I support Cantor's recommendation that has been presented regarding this
situation. I encourage you to find a fair method of compensation for these
families. Due to the actions of these terrorists, we are all suffering.
Please do not make us feel further terrorized by our own government.
On behalf of my sister and all the families who are without loved ones
forever because of this attack, I implore you to look into and take action on
this matter. BR> I thank you in advance and look forward to a speedy response
and sensible remedy.

Justice help all terrorist victims
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September
11 terrorist attacks must include all relatives of all the
victims.
This importantly should include the partners and children of
same sex unions. They suffer just as grievously for their
deceased loved ones as do other survivors, and their need for
assistance is just as great.
Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions. They
are interested in a political victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

We're americans too!
It's almost unbelievable all of the injustices that are being done to gays in America. I'm only 19 and my life is just beginning and I'm already told that I can't be legally married, that i'm a defect, and so many other awful things. I meet people and they think that i'm GREAT, then they find out I'm gay and I become "indecent". That seems to be what's happening in the fund discrimination. These are PEOPLE, they're americans, they're gay. They gave their lives, lives they lived being gay, with people who loved them..people who were family to them..lovers friends....family. Don't deprive these people of what they rightfully deserve just because they're different than what's considered "normal".

I am writing in response to the DOJ's request for public comments regarding the forthcoming regulations for implementing and administering the "9/11 Victim
Compensation Fund."
I strongly urge the DOJ to draft regulations that will compensate all the victims of the attack, including the committed partners and all non-biological children of gay
and lesbian victims.
It's not hard to realize that the grief and suffering felt is no less to those families than to the others.
Many Americans lost their lives on September 11, each of whom left loved ones behind. I strongly urge the Department to honor these bonds by treating the
families of gay and lesbian victims as you would any other.

catastrophe deserve the same treatment as other
parents do.They do not feel any less pain, nor do they
bring their children up to be judged by others..Most
of them are very good parents and upstanding citizens
just as you or I..and i think it is a total outrage
that they are being treated differently just because
of their sexual preference, and because society looks
down on them ...you know what??? you have taken
matters into your own hands and i feel that you are
trying to do gods work...their lifestyle being as it
may be to you seems wrong and inappropriate ...well to
them your lives and and lifestyle is wrong...but do
you see them pushing you aside of what is rightfully
yours?? no you dont...
But you are not judge and jury nor do you pretent to
be god and that is whom they have to answer to..not
you or anyone else and i think it is pretty low to
deny the families and their children the benefits that
they so much deserve...
its just too bad that you cant see how much love and
support they have for everything and everyone...they
dont stand on street corners with a sign saying i am
gay and proud of it...no...all they really want is to

Dear Mr. Kenneth Zwick,
We write as members of the community of University Park, Maryland. Our
little town lost five members of our community on September 11th, including
one family of four and one woman who lived in a committed domestic partner
relationship. As our community plans a memorial to our neighbors, we ask
for your help in ensuring all victims' families, including domestic
partners, are included in the relief effort.
We also write as members of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, we ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
My husband      and I thank you for considering our concerns. We look
forward to hearing from you about your efforts to ensure that all surviving
victims of the September 11 attacks have equal access to the relief fund.

and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."
