As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. He was &nbsp&nbsp&nbsp&nbsp and worked in the North Tower at the World Trade Center. I am writing to you today to express my great dissatisfaction regarding the Interim Final Rules of the proposed September 11th Victim Compensation Fund of 2001. Generally speaking, I believe that these rules are a betrayal to the victims' families and that they must be rewritten to agree with the statute passed by Congress to create this fund. Following are my comments regarding specific elements of these rules: * Nothing in the statute suggests that the determination of economic loss be limited to a pre-determined amount or cap. Each case must be considered on an individual basis based on the individual circumstances of each claimant and the award be independent of any decision made for any other victim's family. I feel that these regulations must be rewritten to permit economic losses be calculated in each individual case based upon the facts and circumstances of each claim. * The regulations for economic loss also must be rewritten to ensure that calculation of economic loss takes into account ALL elements of employee compensation paid by the employer including, but not limited to, pension benefits, stock option grants, retirement programs, etc. * As far as non-economic loss is concerned, nothing in the statute allows for a pre-determined amount or cap to be placed on any non-economic loss such as losses for physical and emotional pain, suffering, inconvenience, loss of companionship, loss of enjoyment of life, etc. It must be ensured that the proposed cap of $250,000 for pre-death pain and suffering by the victim along with $50,000 each for the spouse and dependents is eliminated and that any monetary determination for non-economic loss be solely based on the individual facts and circumstances of each claim. * Placing the burden of proof on the claimant in order to be successful in obtaining an award in excess of the pre-determined presumptive guidelines is an abuse of the power of discretion given to the Special Master of this Fund. Also, the Special Master's reliance on a claimant's ability to show extraordinary circumstances is, in fact, contrary to the direct mandate of this legislation. I think it is important to note that nowhere in the statute passed by Congress does it state that awards should be based on any limiting factor. It does require, however, that the award reflect the economic and non-economic harm suffered by the claimant. In closing, I want to thank you for giving me the opportunity to express my opinion regarding this Fund and trust that all appropriate action will be taken by your office to ensure that every victim's family affected by the horrible events of September 11, 2001 that file a claim for an award receive the individual consideration it deserves. Sunday, November 25, 2001 10:37 PM September 11th Victim Compensation Fund of 2001 I write to advocate that the definition of ?victim? be expanded. It is my understanding that the Victim Compensation Fund defines ?victim? as family members of those who died, and those who suffered physical injury as a result of the September 11th attacks on the World Trade Center (?WTC?) towers and the Pentagon. There is a group of people that does not qualify under this statutory definition of ?victim,? but these people were and are victims of the WTC attacks nonetheless. These were people who were present during the attacks, but suffered no obvious physical injuries, and those whose homes or businesses were damaged, or otherwise adversely affected because of their proximity to the WTC. My apartment complex is located across the street from where the WTC towers stood. I was home at the time of the attacks; outside in the courtyard at the time the first tower collapsed, and was engulfed by the wave of ash and debris. I was fortunate enough to have survived and was among the lucky ones who were evacuated across the Hudson River to New Jersey. In the days and weeks following the attacks, my building complex, because of its proximity to ?Ground Zero,? was designated part of the ?crime scene? in the aftermath of the terrorist attacks, and was among the last of the Battery Park City residential buildings to be able to be prepared for re-occupation. My apartment, like those of many other tenants in Battery Park City, was contaminated with dust, ash and debris. (I was fortunate here, too, as many of my neighbors? apartments were damaged by falling rubble or caught on fire when flaming debris flew across the street.) I have not been able to return to my apartment or retrieve any of my personal possessions (including clothing), however, since September 11th, because of the contamination. It is costing thousands of dollars to clean all of my clothing, linens, blankets, etc.; thousands more for the certified hazardous material abatement company to decontaminate my apartment and its contents, or safely dispose of those items that cannot be salvaged. (I don?t know yet which of my personal possessions are salvageable or which will have to be replaced.) I must also purchase air purifiers with HEPA filters in order to keep the air inside my apartment "safe." Like many of my neighbors in Battery Park City, I did not have renter?s insurance, and neither FEMA nor the Red Cross will cover these costs. There are thousands of people in similar circumstances: some, like me, are still displaced, some have returned to their apartments (and are enduring respiratory problems, nosebleeds, headaches, rashes), others will not be able to return to their homes for several more months. All have been traumatized by their experiences. Fires at Ground Zero still burn and, while the EPA has stated that the particulate matter and other substances in the air pose no long-term health risks, the air quality has certainly been compromised (for example, we have been advised that children should not exert themselves when playing outdoors). I urge that the definition of ?victim? who qualifies for compensation from the Fund be expanded to include residents who were displaced and whose homes were contaminated by the attacks, businesses that were adversely affected, and those people who were at the site during the attacks but who did not suffer apparent physical injury. The family members of the victims of the Cole did not receive this. I sympathize with the families, but they are already receiving benefits that they are entitled to along with help from all the charities started for the victims of September 11. They will also be receiving tax benefits. If this country goes ahead with this plan, the victims of another incident, here or abroad, will expect the same. Is there a surplus of funds available for this? Or, will our taxes go up to cover this expense? There are other families in this country who have been victims of terrible crimes, have lost family members and they are coping. I say, it is time for these families to pull themselves together, get on with life and stop depending on government to help them through the rest of their lives. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Department of Justice Toronto, Ontario Dear Mr. Zwick: We are acting for the surviving spouses of two victims of the terrorist attacks which took place on September 11, 2001. Both men were residents of Toronto, Ontario, Canada and were in the World Trade Center on business when the attacks took place. Death certificates have already been issued by the City of New York to each of our clients in respect of their husband's deaths. We became aware late today that the opportunity was being given to the public to submit comments regarding the substantive and procedural rules relating to the program being established by Congress to compensate the September 11th victims (the "Program"). On behalf of our clients, we wish to make two brief submissions regarding the Program: 1. Our clients' husbands were not American citizens or American residents but their deaths at the World Trade Center in New York were no less tragic than those of the many Americans who died on September 11th. Their surviving families suffer the same losses as their American counterparts. We hope that the compensation which will be offered under the Program will be extended to the families of all victims, regardless of citizenship or residency. 2. The Press Release indicates that compensation under the Program will be payable to the personal representatives of deceased victims. In the case of our clients, both of their respective husbands died "intestate" or without a will. In both cases, it has not been necessary for our clients to apply to the Court to be appointed personal representative of the estate as most of the deceased victim's assets were held jointly with the spouse with right of survivorship or the surviving spouse was designated as beneficiary of assets such as life insurance and retirement savings plans. The surviving spouse was automatically entitled to the joint assets and insurance proceeds were payable to the spouse directly rather than to the deceased's estate. There are little or no assets in either of the deceased victims' estates. If the compensation under the Program is only payable to the personal representative of the deceased victim's estate, it will be necessary for our clients to apply to the Court to be appointed personal representative. This will potentially delay the payment of compensation and will result in the compensation payable to our clients being subject to Ontario Estate Administration Tax. We hope that consideration will be given to the payment of compensation directly to surviving spouses who are the sole beneficiaries of the deceased victim's estate under the applicable laws of intestate succession rather than just to the personal representative of the estate. Under Ontario law, the surviving spouse would be the sole beneficiary of the estate if the deceased was survivived by a legally married spouse but no children. Under Ontario law, if the deceased was survived by a child as well as a spouse, the child would only be entitled to share in the portion of the net estate which exceeded $200,000.00 (Cdn). Depending upon the value of the deceased victim's net estate, the surviving spouse might still be entitled to receive all of the compensation payable under the Program. In the event that a portion was payable to a minor child, however, the child's entitlement could be paid to the spouse to administer for the child if the spouse had been appointed as guardian of the child's property. Washington, DC 20530-0001 Dear Attorney General Ashcroft: We are writing to draw your attention to unmet crime victim service needs of family members, friends, and colleagues of Massachusetts victims of the terrorist attacks at the World Trade Center (WTC) and the Pentagon on September 11, 2001. Over 70 residents of Massachusetts were aboard the two flights that crashed into the WTC. Massachusetts, through its proximity to New York City, is home to many family members of victims who worked in the WTC. In addition, several of the companies that had office space in the WTC were Boston-based companies. As a result, Massachusetts organizations and agencies that provide service to victims of crime are providing needed assistance to hundreds of family members, friends, and colleagues of victims of the September 11 attacks. As you know, the Office for Victims of Crime (OVC) was established by the 1984 Victims of Crime Act and provides substantial funding to state victim assistance and compensation programs. We urge you to consider allocating some funds from the $40 billion emergency supplemental bill that Congress passed to respond to the terrorist attacks to OVC to support critical victim services. OVC funds two major formula grant programs -- Victim Compensation and Victim Assistance. Through these initiatives, it directs funding to victim services programs on the front lines that provide specialized homicide bereavement, crisis response, and hate crime victim services to the many families across the country who need and will be needing services as a result of the attacks on September 11. In Massachusetts, victim services programs were already stretched beyond their capacity with the general crime victim population before September 11, but the demands being made on these organizations since then are enormous. Without the assurance of additional federal or state funding, Massachusetts crime victim service agencies have stepped up to meet the needs of the families of the over 70 victims from our state on the two doomed flights that originated from Boston's Logan Airport and the Massachusetts residents and companies in the WTC. Counselors have logged tremendous hours of overtime working directly with families of victims; one agency has established a Terrorist Attack Support Group; another has dispatched bilingual counselors to schools to calm the special fears of immigrant children. To meet the overwhelming and continuing demand for victim services in the wake of the terrorist acts, agencies in Massachusetts and nationwide are in need of emergency funding.
