Tuesday, March 19, 2002 6:16 PM Government's 9/11 Fund Exclusions To the Bush Administration and 9/11 Fund Administrator Feinberg: I am disgusted, angered, and disappointed by the recently announced decision to exclude surviving partners of lesbian and gay victims of the 9/11 attacks. That this exclusion is cloaked in an ostensible reliance on state laws is a transparent attempt to deflect responsibiltity by harking to a kind of "state's rights" interpretation - "if they don't recognize 'em, we won't." Mr. Feinberg in a television appearance stressed that with a short life to the fund - 1 1/2 to 2 years - he is not able to follow any path BUT these particular state laws (though the same is not true of other laws and regulations, for example those dealing with immigrants). I would suggest that it is _exactly_ the limited nature of this fund's life and of his mandate that creates a perfect case for NOT discriminating among victims - to determine whose life is, in the case of this fund, literally worth more to the survivors. There can be little rational complaint about "social engineering" or charges of an effort to change state laws when the focus of this fund and its time frame are so limited. In addition, treating the survivors of _all_ victims the same would allow the Bush administration to act upon its rhetoric of U.S. unity and to model equality in the wake of these attacks. Because, make no mistake, I am not suggesting that anyone Mr. Feinberg has already "defined in" be excluded; rather, I want you to treat all survivors the same and bring in those he chose to leave out. I am a visiting professor at NYU and Connell Professor at UCLA Law School; I have taught torts for 32 years. 1. I believe the term "physically injured" should include the emotional distress of those evacuated from the damaged buildings, whether or not they suffered direct physical impact. As you know, the latter requirement has been eliminated by virtually every American jurisdiction. Nor do I think there should be a requirement of physical consequences (sleep loss, changes in diet); we know that emotional distress has physical components. 2. I believe that collateral sources should be disregarded. I gather the DOJ is already inclined to disregard charitable donations. The only other significant collateral sources are those for which the victim already has given value--premiums for insurance, labor for employment benefits (including insurance). 3. I do NOT believe survivors should be compensated for the pain and suffering of decedents. The only justification for such payments after death is deterrence, which has no relevance to the federal compensation fund. 4. Obviously statistical methods will be necessary to extrapolate forward the income streams of those killed or injured and the portions that would be devoted to the benefit of dependents. 5. State law varies greatly about whether family members can recover for damage to the relationship with a victim who is killed (wrongful death) or injured (loss of consortium). No state offers a principled basis for drawing the lines it does. I believe the DOJ is free to draw its own lines; I would urge it to do so broadly to include spouses, parents, and children (including step-relationships). At the same time, I do not believe there should be individualized valuations of these relationships; the purpose is to acknowledge the loss, not to compensate it, since there can be no meaningful compensation. I would be glad to expand on or explain any of these ideas. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you have probably already heard through media reports many Gay and Lesbian citizens gave and lost their lives in the September 11th attack. Some worked in the World Trade Center, others were heroes in giving their lives in public service and as passengers on hijacked planes. While our lifestyles may be different from the majority, we really are no different except in whom we choose to love. We attend church, pay taxes, raise children, volunteer, take care of parents, etc., as most normal, healthy Americans do. Please don't forget the loved ones left behind in these "alternative families". I am requesting the following consideration. Thank you for your time. Thursday, March 14, 2002 9:15 PM Please include same-sex partners in the victim compensation I am writing to voice my concern over the exclusion of same-sex partners from the 9/11 Victims' Compensation Fund. This horrible tragedy was unprecedented and affected people from all walks of American society. All the affected deserve our help. Your administration has recognized that a compassionate and effective response will entail making certain exceptions to general U.S. policy on eligibility for public benefits, such as making compensation available to undocumented aliens (and protecting their employers from prosecution should such individuals come forward). Please make sure that ALL affected families and households receive the assistance they need to cope with this terrorist attack, whether the household was counting on the income of a brother or sister, an opposite-sex but unmarried partner, a same-sex partner, or a friend. Fair rules can be devised for assisting all families and households who were directly affected by this terrorist attack. Please don't use this as! an opportunity to cut out or furth er marginalize people whose loss and grief is no less real because they are not heterosexual.
