Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, March 16, 2002 2:57 PM (no subject) In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. EVEN FETUSES AND ILLEGAL ALIENS ARE COVERED!!! Even fetuses and illegal aliens will be receiving benefits under this problem - heck, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the Pentagon (there are many more) - we are told the law is the law and no exceptions can be made. If the fund that Congress created can overlook federal immigration and labor law, create new classes of victims (fetuses) and even compensate the surviving unmarried heterosexual partners who were affected, it seems rather transparent and cowardly to hide behind the guise of "state law" to effect a denial when considering the victims whose life partners happen to be of the same gender. It is yet another sad day in America when this kind of terrorism can be compounded by additional insult and injury based on nothing more than sheer prejudice and malice. I am a gay american who has paid taxes all his adult life and regularly contributes to and volunteers with multiple charities, and I really believe in the ideals this country was founded on. The inhumane way in which this fund is being administered has me ashamed and embarassed at the lack of compassion and appropriate consideration our leaders display in allowing the fund administrators to act in this manner. Monday, March 18, 2002 1:47 PM Sept. 11th Fund I have heard that partners of gay and lesbian heroes aboard flight 93 will not qualify for the same benefits as their heterosexual counterparts, including the unborn, and illegal immigrants. While I do not believe the former deserve to be left out of being compensated, it is outrageous and offensive to deny compensation to the loved ones of gay/lesbian heroes of flight 93. The memory of &nbsp and other gay or lesbian Sept. 11th heroes is defiled by the mere gesture of not standing up to what is obviously right: providing the Kudos, and compensation to all heroes equally. If rules can be bent for illegal immigrants, why hold different standards for gay and lesbian heroes. This perpetuates a hypocrisy in America, a great country offering democracy and freedom that many gays and lesbians have lost their lives fighting for, yet are not protected with the basic civil rights afforded others. Even non-citizens have more rights than gays and lesbians in some states. it is a sad day when the government asks it's gay and lesbian citizens to risk their lives in the armed forces, and as heroes, such as on flight 93, and yet will not be given even the courtesy of what is morally right: equal respect and equal treatment under the law. This importantly should include the partners and children of same sex unions. Tuesday, March 19, 2002 8:49 AM Gay Americans lost to on September 11th. I think it's the gravest injustice I've ever heard regarding the interview on Meet the Press that aired on March 10th. According to Kenneth Fienberg, head of the victims compensation fund for the September 11th event some Americans are likely going to be left out because of who they are. I think it's a travesty of justice and the personal beliefs of attorney general , John Ashcroft, and his department that will likely isolate the gay and lesbian citizens from recieving some compensation for the heartache and sorrow that so many Americans experienced on September 11th. In short Mr. Fienberg's comments that it will be ultimately up to each state to decide if gay and lesbian Americans will be compensated is a cop out. What will it take for this country and in particular our leaders in Washington to wake up and see that regardless of thier own personal feelings that all Americans suffered and lost on that day in September. Wednesday, March 13, 2002 8:41 AM gay partners It's a terrible nightmare, this September 11th tragedy.   So many people involved in suffering because the acts of a few.  It's a double tragedy that same-sex partners have to face while being discriminated against by their own country!  If we can't find a ray of hope in our own "family" (America), where can we find it?  Why do you choose to force the loved ones of gay victims to suffer again.  The tragedy will live with them their entire lives as it is, why would you choose to discriminate against them as well?  How can you honestly justify that treatment?  Is it laziness on your part?   Not willing to go to the trouble of finding out who these people are?   What does that say about you?  Their partners were allow to be killed under the same circumstances as those who were heterosexual.   Please stop being so insulting, so mean-spirited!   Allow all Americans to stand on equal ground.   Please help those gay loved ones be comforted a little too! Monday, April 01, 2002 10:45 AM Please do NOT deny benefits to Gay and Lesbian survivors I am emailing today to voice my concern that the government to which I pay taxes and turn to for justice and protection in the wake of these terrible events would deny benefits to the life partners of gay and lesbian victims of Sept. 11th. I can understand our government's commitment to prevent funds from falling into the hands of those seeking to improperly profit from the Sept. 11th attacks. But, in cases where the surviving partners of victims of the attacks have been identified, it would be morally and ethically reprehensible for our government to dishonor the dead by ignoring our responsibilities to their living loved ones. PLEASE honor ALL the fallen of Sept. 11th by treating gay and lesbian partners of lost heroes with dignity, respect and acknowledgement. Thursday, December 20, 2001 11:08 AM Equal Right for Surviving Gay and Lesbian Partners December 20, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Even fetuses and illegal aliens will be receiving benefits under this problem. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, NY Fire Dept. who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) - we are told the law is the law and no exceptions can be made. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. This discrimination is un-American. I urge you to change your biased and prejudiced point of view and create a policy that offers equanimity to all the partners of all victims affected by the horrible attack on New York City, Washington D.C., and the aborted attack of the third airplane that took place on September 11, 2001. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
