On behalf of the members of NYCOSH, I submit the following comment on the Interim Final Rules: Anyone who sustained a disabling injury as a result of the September 11 attack ought to be eligible for federal compensation. It is completely unreasonable to deny such compensation to anyone who sustained a disabling injury, but did not obtain medical services within 24 hours of being injured. It is likely that many people received injuries that were serious enough to require medical attention, but not serious enough to visit an emergency room. If an injured person chose to seek treatment for the injury from their regular physician by making an appointment for treatment on the day after the attack, such a person would not be eligible under the interim rules? 24-hour time limit. It is very possible that some people who were injured in the attack were in such a state of psychological shock that they did not obtain medical treatment for days after the attack. It is reasonable to limit compensation to people who were injured as a result of the attack, but there is no reasonable basis for excluding anyone who, for whatever reason, delayed obtaining medical services for their injury. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." This is especially remarkable in light of the fact that funds WILL be given to illegal aliens, and the Justice Department has agreed to waive laws regarding their illegal status for that purpose. To maintain that individual state laws should rule on whether or not someone should be equally recognized by your organization on one hand, but that federal law should be suspended to help others is the worst kind of flim-flam, and must be recognized as such. Gay and lesbian Americans are no less deserving than any other American, and certainly no less deserving than illegal immigrants. I think it IS noble to take care of the illegals harmed by the events of 9/11, and applaud your efforts to do so, BUT to pair that with this disgraceful discrimination against gay and lesbian Americans is the worst kind of parody of fairness, equity and patriotism. When I give to help Americans hurt by 9/11, I expect those funds to be used to help ALL Americans hurt by 9/11! Therefore, I for one will discourage everyone I know from contributing to your efforts if those efforts are to be discriminatory and biased, and will encourage my friends and family to donate only to organizations that DO help all Americans regardless or race, color, creed, religion, OR sexual preference. Please reconsider your plans. Honor the gay Americans who died so valiantly on 9/11 as fully as you honor all the others who died that day. Monday, March 11, 2002 12:40 PM American Heros and the 9/11 Fund Dear Sirs; Kenneth Feinberg's comments regarding compensation for the partners of the Gay and Lesbian American Heros of 9/11 given on "Meet the Press" yesterday, March 10th, reflect an attitude which is totally unacceptable. These are just a FEW of the Americans who died as heros of that day, who were also gay Americans. Are they less of a hero because they were gay? Are their life partners suffering less because they were gay? Members of our church in New York lost people that day. One woman who walked down 60 + flights of stairs, burned so badly that no one could touch her to give aid, who lingered in a medically incuded coma for over a month, left behind a son and a life-partner of 20 years. Is that loss to be in vain as our country honors the heros of this new war? Members of that church who are policemen and firefighters worked around the clock along side of their straight co-workers and of their gay fellow policemen and firefighters. Have we not suffered the same as other Americans? Mr. Feinberg said this: "I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state." It is time that this administration demonstrated the same courage as the previous administration, and to take a stand on the equality of ALL AMERICANS, no matter how far behind the individual states may be on issues of equality and justice. When Allied forces liberated the camps of Germany and Poland almost 50 years ago, when Mr Feinberg's relatives were set free, the gay and lesbian prisoners were transfered to local jails and prisons. Don't let this sort of gross injustice continue into the 21st Century. I believe that there are people who truly need financial help as a result of what happened. The government should do all it can to identify these individuals and provide monetary support to help them meet their financial obligations for the short term. However, I do not believe it is the role of the government to compensate people because of their poor financial planning (i.e. insufficient life insurance). Yes, it is hard to recover from the loss of a loved one, especially if that individual is the source of the primary income. However, if you change the tragic element to another unforeseen tragedy such as a heart attack, stroke, drowning, etc. the government would not step in to provide economic support to the survivors. I have the utmost respect for police officers and firefighters. However, they chose to work in hazardous occupations and they know the risk of fatal injury is part of the job. They are no different than say our service men and women who defend our nation's security day in and day out. I commend them for serving their country and I am glad that they do so but it is their choice. We have people in this country who choose to live on faults in California, in the flood plains of the Midwest, and on mountain slopes with potentially dangerous rock slides. They made the choice and know the potential consequences yet they still take the risk. I believe that the government is setting a dangerous precedent. It opens up the door to define the government's responsibility and accountability in all tragedies (e.g. terrorist actions, natural disasters, acts of war, etc.). Will the government have to compensate for injury or loss of life because of the next major earthquake in California if thousands are injured or killed? If the Titanic or the Lusitania were US ships and were to sink today, would the government compensate the survivors? I know this a very emotional topic because of its magnitude but it must be handled with a rational frame of mind. I have had my say and I thank you for your time. After going to the information meeting that Mr. Feinberg held for the Cantor Fitzgerald families I came away a little discouraged. I know Mr. Feinberg has some control but I know there are others in the justice department that are helping set these guidelines up for the compensation amounts. There are 3 points I would like you and your colleages to consider. 1. Set a minimum amount that the families can receive. After insurance, pensions and chartiable donations there will be little left if any. 2. Extend the tables that calculate the compensation for people who made above $236,000 to at least $500,000. How can you expect a person to sign a legal document forgoing any type of legal action if they have no accurate idea of what they might end up with. 3. Make the awards and compensation consistent all the way up the chart. I'm sure that justice department is hesitant to provide these tables and make these rewards public because middle America will not understand why these people are getting this money from the government. I can just say that the people that worked is those building were not the average working person. They were in the tops of their fields and the countries economic growth and development depended on them. As well as the fact the airlines, security companies and our government let these people down. They should have been safe in their place of work and we should have seen this coming. I have read the letter that Congressman Marty Meehan sent to you on behalf of the victims.I couldn't voice my concerns and objections any better than he did in his letter.I urge you to strongly consider his objections and recommeendations. Specifically I believe it is important to establish a substantial meaningful minimum that all victims will receive.The figure of $250,000 per person for non-economic damages is completely unacceptable and sends a statement to the victims that their losses are not valued in either a legal or humane way.I also want to voice my concern and bewilderment regarding why you have capped the incomes to be used in the calculations at $231,000.I have read and re-read the original bill and I can't find anything in it that required this type of cap on economic losses.I can only assume that this limit was set to appease those who object to the "government supporting these people."Those who have this view need to be reminded that this bill was put in place primarily to protect the airlines and secondarily to address the fact that the victims would have no recourse to sue for just compensation.Please do not give into this pressure of public opinion.All of these families are entitled to be compensated for the full extent of their economic and non-economic losses since they really have no other recourse at this point. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
