Leher as an aside says President Bush authorized the use of military
tribunals for suspected terrorists. I was simply stunned. After having read
the AP article below I was no longer stunned, but lamenting our loss of

Bush Order: Terror Trials by Military

WASHINGTON (AP) - President Bush approved the use of a special military
tribunal Tuesday that could put accused terrorists on trial faster and in
greater secrecy than an ordinary criminal court. The United States has not
convened such a tribunal since World War II.

Bush signed an order establishing the government's right to use such a court
but preserving the option of a conventional trial.

``This is a new tool to use against terrorism,'' White House Counsel Albert
Gonzales said.

Bush's order does not require approval from Congress.

Detention and trial of accused terrorists by a military tribunal is
necessary
``to protect the United States and its citizens, and for the effective
conduct of military operations and prevention of terrorist attacks,'' the
five-page order said.

The order sets out many of the rules for any military tribunal and the
rights
of anyone held accountable there. A senior Justice Department official,
speaking on condition of anonymity, said only noncitizens would be tried
before the military commission.

``These are extraordinary times and the president wants to have as many
options as possible,'' said Justice Department spokeswoman Mindy Tucker.
``This option does not preclude any Department of Justice options that might
also be available.''

In either a military or a civilian court, any suspect would retain rights to
a lawyer and to a trial by jury, the administration said.

Anyone ever held for trial under the order would certainly challenge its
legitimacy, said Eugene Fidell, president of the National Institute of
Military Justice in Washington, and a lawyer who regularly practices before
military courts.

``There's no recent history in this country of this. It's an extraordinary
step for the president to have taken,'' Fidell said, adding that it moves
the
country closer to a genuine war footing.

There is precedent for such panels.

President Franklin Roosevelt had suspected World War II saboteurs secretly
tried by military commission, and six were executed. The Supreme Court
upheld
the proceeding. An enemy who sneaked onto U.S. soil ``for the purposes of
waging war by destruction of life or property'' was a combatant who could be
tried in a military court, the Supreme Court ruled.

Military tribunals were also used during and after the Civil War.

Gonzales, the president's top lawyer, said a military commission could have
several advantages over a civilian court, including secrecy.

``This is a global war. To have successful prosecutions, we might have to
give up sources and methods,'' about the way the investigation was conducted
if the trial was held in a civilian court, Gonzales said. ``We don't want to
have to do that.''

A military trial could also be held overseas, and Gonzales said there may be
times when prosecutors feel a trial in the United States would be unsafe.

Recent terrorism trials have taken place in U.S. criminal courts, where the
rules require the government to reveal its evidence either in open court or
in filings it must fight to keep secret.

Michael Scardaville, policy analyst for homeland defense at the conservative
Heritage Foundation, said there are legitimate reasons for holding the
trials
in private.

``This isn't Judge Judy, two people fighting over who gets the car after a
divorce. It's about very classified elements of America's national security.

``They can say, `Not only are we not going to let the press in, it's going
to
be in the middle of a military base.''

Michael Ratner, an international law and war crimes expert at Columbia
University, said the government would lose all credibility with the Muslim
world if it tries terrorists by a military commission.

``I am flabbergasted,'' Ratner said. ``Military courts don't have the same
kind of protections, you don't get the same rights as you do in a federal
court. The judges aren't appointed for life, there is no civilian jury.''

The order is the latest effort by the administration to toughen the nation's
laws against terrorists.

After the Sept. 11 attacks, the administration pushed through Congress an
anti-terrorism bill that Bush said was vital but civil liberties groups said
went too far, violating Americans' constitutional rights.

It expands the FBI's wiretapping and electronic surveillance authority and
imposes stronger penalties for harboring or financing terrorists. The
measure
also increases the number of crimes considered terrorist acts and toughens
the punishments for committing them.

Under the new order, Bush could establish a military commission in the
future
by asking the secretary of defense to establish the rules for one.

``This does not identify by name who should be exposed to military
justice,''
Gonzales said. ``It just provides the framework that, should the president
have findings in the future, he could'' order Secretary of Defense Donald H.
Rumsfeld to establish such a commission.

shouting, the singing, the banners, the posters, the films, the waxworks,
the rolling of drums and squealing of trumpets, the tramp of marching feet,
the grinding of the caterpillars of tanks, the roar of massed planes, the
booming of guns - after six days of this, when the great orgasm was
quivering to its climax and the negeral hatered of Eurasia had boiled up
into such delirium that if the crowd could have got their hands on the two
thousand Eurasion war crimilas who were to be publicly hanged on the last
day of the proceedings, they would unquestionably have torn them to pieces -
at just this moment it had been announced that Oceana was not after all at
war with Eurasis. Oceana was at war with Eastasia. Eurasia was an ally.

There was of course no admission that any change had taken place. Merely it
became known, with extreme suddenness and everywhere at once, that Eastasia
and not Eurasia was the enemy. Winston was taking part in a demonstration at
one of the central London squares at the moment when it happened. It was
night, and the white square was packed with several thousand people....

....A little Rumpelstiltskin figure, contorted with hatred, he gripped the
neck of the microphone with one hand while the other, enormous at the end of
a bony arm, clawed the air menacingly above his head. His voice, made
metallic by the amplifiers, boomed forth an endless catalogue of atrocities,

messages when a messenger hurried onto the platform and a scrap of paper ws
slipped into the speaker's hand. He unrolled it and read it without pausing
in his speech. Nothing altered in his voice or manner, or in the content of
what he was saying, but suddenly the names were different. Without words
said, a wave of understanding rippled through the crowd. Oceana was at war
with Eastasia! The next moment there was a tremendous commotion. The banners
and posters with which the square was decorated were all wrong! Quite half
of them had the wrong faces on them. It was sabotage! The agents of
Goldstein had been at work! There was a riotous interlude while posters were
ripped from the walls, banners torn to shreds and trampled underfoot. The
Spies performed prodigies of activity in clambering over the rooftops and
cutting the streamers that fluttered from the chimneys. But within two or
three minutes it was all over. The orator, still gripping the neck of the
microphone, his shoulders hunched forward, his free hand clawing at the air,
had gone straight on with his speech. One minut more and the feral roars of
rage were again bursting from the crowd. The Hate continued exactly as
before, except that the target had been changed."

all (this is really a response to x's friday morning
call to potential action/questions and x's friday
night hey it looks like we should at least do a picket
line sat afternoon emails):

if we are going to do this tomorrow, as x is
suggesting, i am out, as i have to work, but pls keep
me posted, as i will then start the arts chain going.

i wonder if, and this is just a wonder, having even a
picket when the action is not being well-publicized is
a good idea. i know that there is much going on in
this war, like all other us "actions" which is
underwritten dramatically, and we need to call
attention to it, however, folks are more likely to
understand what we are calling for and call with us if
it is of a dramatic nature. subjective nature, i
suppose. as we all agreed at the last meeting, from
here on out it is much more subjective than just the
bombing beginning.

regardless, i will pass the word if i hear back from
more folks.

	Folks may be interested in reading the story in the Sunday
(11/4) New York Times Money and Business Section titled "A Muscular
Lobby Rolls Ups its Sleeves" by Leslie Wayne and Melody Petersen.

	Among the highlights of the article:

	*There are more registered drug industry lobbyists in DC than
actual elected politicians - half of these lobbyists are former
Congresspeople, Congressional staffers or ex government employees
(hmmm...revolving door, conflict of interest, anyone?)

	*Between 1999 and 2000 drug companies spent $197 million
lobbying Congress - now the largest lobby group on Capitol Hill

	*Last year alone the anti-anthrax drug, Cypro, earned its
corporate patent holder, Bayer, a whopping $1.6 billion

	*Former WI Governor now turned Bush White House Health and
Human Services Sec., Tommy Thompson, has been boasting in the press
about what a "tough" negotiator he is when it comes to the drug cartel
	- well, thanks to his "herculean" effort, Bayer agreed to cut
its profit margin on Cypro from 95% to "only" 65% in exchange for
protecting its patent monopoly.  In other words, taxpayers are now
paying $1.00 per pill that costs less than a dime to make, versus the
$1.77 that was charged in the pre-9/11 "free market"...

	Of course, no corporate "free trade" apologists in the
mainstream press, the Democratic/Republican party leadership, etc.
etc. are willing to address the real issue of why we are still
allowing private interests to profit off of war and disease.  Isn't
affordable quality healthcare a human right of ALL people?
And aren't government sanctioned monopolies an oxymoron in a free
market system?

ACTIVITIES UPDATE:

(1)  Grantwriting.  Our application for annual funding from Wisconsin
Community Fund has survived the first cut, and will be reviewed by the full
Grants Committee.  Our application for a $500.00 Special Opportunity Grant
from WCF is awaiting final revisions and will be submitted on Monday.

(3)  Donations from organizational members.  E-mails and letters went out
November 14-15 to all MAPC organizational members, requesting donations in
the $25.00 to $100.00 range.

(4)  Direct mail fundraising.  First mailing scheduled for early December.
All MAPC organizational members have been asked to consider allowing MAPC to
use their mailing lists on a one-time basis.

(5)  Dance Party.  All systems go for November 20 at the Cardinal Bar, 9:00
p.m. until bartime.  21+ age rule applies.

(6)  Art Auction.  Scheduled for December 2 at Mother Fool's.  Posters &amp;
leaflets soliciting art donations are being printed today.  We are still
looking for a coordinator for this event.

(7)  Buttons.  The first 150 buttons have arrived, with another 150 expected
on Nov. 17.  47 buttons were sold at the general membership meeting; this
covered our production costs for the full order.

(8)  Finances.  A complete financial report will be provided at the meeting.

PROPOSALS:

(1)  Budgeting for Working Groups and Caucus

(a)  The last time we established budgets for each WG/C was one month ago,
on October 14.  We should establish allocation levels for the upcoming month
at this meeting.  I will have up-to-date information about the Coalition's
finances on Sunday.

It has also been suggested that the CC should include a budget for itself in
the list of allocations.

The Fundraising &amp; Finance Committee requests that its allocation remain at
the $150.00 level.

(b)  It appears that several committees have substantially overspent their
allocated funds.  The problem appears to be that members are spending money
autonomously, either charging printing to a MAPC account at Lakeside Press
or expecting reimbursement, but the WGs and Outies are not being kept aware
of how much is being spent, or discussing budgeting when decisions are made
to spend money.

 The Co-Treasurers recommend that we review these budget overruns, and
develop policy/procedures to ensure that the WGs/Outies know what is being
spent before it is spent, and, where overruns are anticipated,  bring
requests for additional funds to the CC in advance.

Wisconsin Green Party Opposes Patriot Bill
The Wisconsin Green Party wishes to express its unequivocal opposition to current attempts to undermine civil liberties in the United States since the Sept. 11th attacks in New York and Washington. It's highly disturbing and downright dangerous that our own elected officials have now become so willing to compromise our nation's democratic freedoms in the supposed interest of waging war against global terrorism.
Specifically, the Wisconsin Green Party strongly objects to the recently enacted Patriot Bill and related activities at both the state and federal level. Among these concerns are:
1.) The U.S. Attorney General assuming the power to incarcerate or detain non-citizens based on mere suspicion, and to deny re-admission to the U.S. of non-citizens (including lawful permanent residents) for exercising their free speech rights;
2.) Expansion of telephone and internet surveillance by federal law enforcement agencies in counter-terrorism investigations AND in routine criminal cases unrelated to terrorism with minimal judicial oversight;
3.) The WI Attorney General's "Domestic Security Plan" against "general terrorist threats" that enables judges to issue a 48 hour "temporary order" for wiretapping without any evidence beyond mere suspicion;
4.) Expanded "sneak and peak" searches of personal homes and offices by federal agents - without a warrant - for both counter-terrorism investigations AND in routine criminal cases unrelated to terrorism;
5.) The U.S. Bureau of Prisons decision that allows federal authorities to "eavesdrop" on private conversations between defendants and their lawyers as part of "counter-terrorism" activities in blatant violation of "attorney client privilege."
6.) The U.S. Attorney General and U.S. Secretary of State expanding their power to declare organizations "terrorist" and to block any non-citizen who belongs to such groups from (re)entering the country;
7.) The U.S. Attorney General reserving the right to use payment of membership dues to particular political groups determined to engage in or assist "terrorism" as sufficient criminal evidence for federal deportation;
8.) The CIA, FBI, and INS assuming broad "search and seizure" rights to private medical, financial, mental health, and educational records without having to show prior evidence of a crime and without a court order - this would include the power to subpoena customer databases from booksellers. Such court orders would be issued "ex parte" (ie. without any chance for legal objection) and the subject of the search falling under "gag rules" to not publicly disclose their investigation;
9.) The CIA, FBI, and INS being allowed to pursue coordinated large-scale investigations of citizens for "intelligence" purposes. These agencies would be allowed to supercede normal "probable cause" requirements. The CIA Director now has the unilateral power to identify priority targets for intelligence surveillance;
10.) The recent White House executive order creating U.S. military tribunals for trying and convicting those accused of "terrorist activities" both domestically and overseas. Such tribunals were last employed during WW II against suspected Nazi saboteurs;
11.) A broader vaguer definition of "terrorism" that would include a wide array of political activities currently protected under the First Amendment, violators being subject to enhanced penalties. In Wisconsin, this definition of "terrorism" now includes any crime "dangerous to life, limb or property;"
12.) Expansion and enforcement of various "patriotic" requirements for citizenship. In WI this includes mandated recital of the pledge and/or anthem in state public schools, proposed state-issued ID cards for voting, and draft registration as a prerequisite for employment within state higher educational institutions beginning in Feb. 2003.

These measures have only exacerbated an already hostile fearful climate that is now stifling freedom of expression, freedom of movement, freedom of association and other political activities essential to a democracy. Nancy Oden, a Green Party activist was recently harassed by law enforcement agents at the Bangor, ME airport and was eventually denied travel. Greens in Hartford, CT were attacked, pepper-sprayed and arrested by police officers for peaceful protest activities. Even in WI, Greens and other social justice activists have not been safe. At UW-Madison, campus activists have noted increased police surveillance of one of their offices, while at UW- Stevens Point a student peace camp endured several nights of rightwing harassment and outright attacks (with fireworks, eggs, homemade bombs) before local police finally intervened. Throughout the nation several murders, hundreds of hate crimes and other racial profiling incidents, as well as over 1500 detentions of suspected "terrorists" have been reported since the Sept. 11th attacks.
Such acts - whether instigated or tolerated by the state - are simply unacceptable in a free democratic society, and must be challenged. The Wisconsin Green Party urges all citizens to not be intimidated by these clearly illegitimate counter-terrorism measures and to continue to exercise their hard-won constitutional freedoms. Those who suffer violations of their civil liberties are encouraged to immediately publicize their experiences and contact the National Lawyers Guild, the Center for Constitutional Rights, the American Civil Liberties Union, and other legal advocacy groups for assistance. Furthermore, the Wisconsin Green Party pledges to support anyone who is willing to resist these unjust laws in a nonviolent manner.

              <text> The disconnect between last Tuesday's monstrous dose of reality and the
 self-righteous drivel and outright deceptions being peddled by public
 figures and TV commentators is startling, depressing. The voices licensed
 to follow the event seem to have joined together in a campaign to
 infantalize the public. Where is the acknowledgment that this was not a "
 cowardly" attack on "civilization" or "liberty" or "humanity" or "the free
 world" but an attack on the world's self-proclaimed superpower, undertaken
 as a consequence of specific American alliances and actions? How many
 citizens are aware of the ongoing American bombing of Iraq? And if the word
 "cowardly" is to be used, it might be more aptly applied to those who kill
 from beyond the range of retaliation, high in the sky, than to those
 willing to die themselves in order to kill others. In the matter of courage
 (a morally neutral virtue): whatever may be said of the perpetrators of
 Tuesday's slaughter, they were not cowards.
 Our leaders are bent on convincing us that everything is O.K. America
 is not afraid. Our spirit is unbroken, although this was a day that will
 live in infamy and America is now at war. But everything is not O.K. And
 this was not Pearl Harbor. We have a robotic President who assures us that
 America still stands tall. A wide spectrum of public figures, in and out of
 office, who are strongly opposed to the policies being pursued abroad by
 this Administration apparently feel free to say nothing more than that they
 stand united behind President Bush. A lot of thinking needs to be done, and
 perhaps is being done in Washington and elsewhere, about the ineptitude of
 American intelligence and counter-intelligence, about options available to
 American foreign policy, particularly in the Middle East, and about what
 constitutes a smart program of military defense. But the public is not
 being asked to bear much of the burden of reality. The unanimously
 applauded, self-congratulatory bromides of a Soviet Party Congress seemed
 contemptible. The unanimity of the sanctimonious, reality-concealing
 rhetoric spouted by American officials and media commentators in recent
 days seems, well, unworthy of a mature democracy.
 Those in public office have let us know that they consider their task
 to be a manipulative one: confidence-building and grief management.
 Politics, the politics of a democracy -- which entails disagreement, which
 promotes candor -- has been replaced by psychotherapy. Let's by all means
 grieve together. But let's not be stupid together. A few shreds of
 historical awareness might help us understand what has just happened, and
 what may continue to happen. "Our country is strong," we are told again and
 again. I for one don't find this entirely consoling. Who doubts that
 America is strong? But that's not all America has to be.

 I\'d like to add some ideas from here, down south.

 There\'s an important point in the power of press, specifically the power of
 CNN.

 All around the world we are subjected to 3 or 4 huge news distributors,
 and one of them - as you well know - is CNN. Very well, I guess all of
 you have been seeing (just as I\'ve been) images from this company. In
 particular, one set of images called my attencion: the Palestinians
 celebrating the bombing, out on the streets, eating some cake and making
 funny faces for the camera.

 Well, THOSE IMAGES WERE SHOT BACK IN 1991!!! Those are images of
 Palestinians celebrating the invasion of Kuwait! It\'s simply
 unacceptable that a super-power of cumminications as CNN uses images
 which do not correspond to the reality in talking about so serious an
 issue.

 A teacher of mine, here in Brazil, has videotapes recorded in 1991, with
 the very same images; he\'s been sending emails to CNN, Globo (the major
 TV network in Brazil) and newspapers, denouncing what I myself classify
 as a crime against the public opinion. If anyone of you has access to
 this kind of files, serch for it. In the meanwhile, I\'ll try to \'put my
 hands\' on a copy of this tape.

 But now, think for a moment about the impact of such images. Your people
 is hurt, emotionally fragile, and this kind broadcast have very high
 possibility of causing waves of anger and rage against Palestinians.
 It\'s simply irresponsible to show images such as those.

 Finally, I\'d like to say that we all regret and condemn all that has
 happened in the last days; but Nikos has a point here. I really don\'t
 want to be misunderstood here, but the truth is that US government had
 shown no respect for other countries in the last decades. In the 60s and
 70s they had halped lots of military coups throughout the world
 (including Brazil in 64). Later, with Reagan and Bush Father, the
 Washington Consensus have been demolishing the bases of our economies,
 making us more and more dependant (and, many of us, prehocupied with
 this situation).

 Your current president quickly made things worse: Kioto Protocol, Star
 Wars, Colombia Plan, the exchange of rain forest for pieces of external
 debt, tha abandonment of the position of third party in negotiations
 between IRA and England, and between Palestinians and Israel. All those
 mistakes in US external politics made your country more hatred than
 before, and, of course, more vulnerable.

office, spewing peace-nic rhetoric and demanding action to protect community
members of color and Muslim-Americans, and to protect our civil liberties.

SPECIAL MAPC AGENTS: x, x, x, x, x (x) x

DEBRIEFING REPORT: MAPC special agents met with new regional office director
x and staff assistant x. Meeting mood was cordial.

MAPC agents introduced the coalition, our 3-point platform, organizational
members, and strong support from individuals (150-200 people at general
meetings, an estimated 5000 individual members). We thanked the Senator for
his support of anti-racist resolutions (in the wake of the attacks; everyone
voted yes...), and then got down to business.

We detailed current "anti-terrorism" legislation and our concerns regarding
it, especially highlighting the "Uniting and Strengthening of America Act"
(S.1510), an especially scary measure which may be voted on by the Senate as
soon as this week. Among other things, the "U.S.A. Act" would allow
indefinite detention of non-citizens (even if they've won immigration
hearings), expand the federal government's ability to conduct secret
searches, extend the ability to conduct warrant-less internet and phone
surveillance to anyone if "relevant to an ongoing investigation", etc.

We also called on the Senator to support the establishment of an
International Criminal Court, and to oppose the U.S. Servicemembers
Protection Act (S.857), which would actively oppose the ICC, levy sanctions
against other countries signing the ICC charter, and provide the Prez with
the authority to "take any measures necessary" to free U.S. citizens
detained against their will by the ICC (!!!).

Kohl staff were not able to provide us with the Senator's stance on this
legislation, but will report back to us. They will relay the extensive
meeting notes they took to the DC office, and contact us with information on
the Senator's stance on S.1510, the ICC/ S.857. They will also provide us
with names and contact info for the relevant DC aides to contact regarding
each issue we discussed. For interested readers, the general phone # for
Kohl's DC office is 202-224-5623. We will share the other info with you once
we receive it.

Kohl's local staff also said they would relay info on MAPC to local people
who call the office to express pro-peace views. They also told us that,
except for the first day or so after the Sept 11 attacks, the many calls to
the local office have been overwhelmingly pro-peace! (Hey, join the
bandwagon. The phone # for the local office is 264-5338.)

We left with the office written materials on MAPC, news reports on Sunday's
rally, an article on the ICC (in the current issue of Ms. - check it out),
and MAPC member x's recent Badger-Herald editorial on the
complexity of getting involved with Afghanistan's politics.
