MEDICAL GROUP CALLS FOR LANDMINE AND CLUSTER BOMB MORATORIUM News Release from Physicians for Human Rights November 2, 2001   MEDICAL GROUP CALLS FOR MORATORIUM ON USE OF CLUSTER BOMBS AND ANTIPERSONNEL LANDMINES IN AFGHANISTAN; US MUST DISCLOSE MUNITIONS INFORMATION TO UN   Islamabad, Pakistan-- Physicians for Human Rights (PHR) today called on the United States to impose an immediate moratorium on the deployment of cluster bombs and antipersonnel landmines in Afghanistan. The group also called on the U.S. to comply with the request by the UN Mine Action Program for Afghanistan (UNMAPA) to be informed of the targets, types, and quantities of munitions used so far during coalition air strikes. Lastly, PHR called on the US to commit to and implement full clearance of all unexploded munitions deployed during the military campaign in Afghanistan.   US military have confirmed the use of cluster bombs in Afghanistan. PHR has not been able to resolve conflicting reports about US landmine deployment in Afghanistan, but US military leaders recently indicated that they have not ruled out using antipersonnel landmines in the military campaign.   As a co-recipient of the 1997 Nobel Peace Prize for its founding role in the International Campaign to Ban Landmines, PHR has documented the indiscriminate nature of this weapon that leads to thousands of civilian deaths each year. With the current high dud rate of cluster bombs estimated to be between 5 and 30%, the group believes that cluster submunitions, like antipersonnel landmines, could result in loss of human life, threaten refugee movement, obstruct farming, and hinder aid delivery. Cluster bombs have reportedly killed 9 Afghan civilians in recent weeks near Herat. Landmines and NATO-dropped cluster bombs also caused high rates of civilian casualties in Kosovo in 1999.   "The world has condemned the use of antipersonnel landmines. It is now time for all nations, including the United States, to recognize that both antipersonnel mines and cluster bombs are indiscriminate and cause a devastating civilian toll," said Leonard S. Rubenstein, executive director of PHR.   Even before the current conflict, landmines led to tremendous civilian casualties in 27 out of 29 Afghan provinces. Eight to ten million landmines remain in the ground after two decades of war in the country. The International Campaign to Ban Landmines reports that in Afghanistan in the year 2000, there were 88 casualties each month. Reports from UNMAPA indicate that this number has increased dramatically since the US aerial bombing commenced.   The US government reports that one third of US military casualties in the Vietnam Conflict and the Persian Gulf War were due to antipersonnel landmines. Additionally, at least 25 U.S. military personnel were killed and others injured by submunitions fired by their own forces in Operation Desert Storm. Similarly, the hidden weapons could pose a serious threat to US soldiers on the ground in Afghanistan.   Since September 11, UNMAPA's regular mine clearance operations have ground to a halt. Emergency teams are in desperate need of information to identify and defuse new weapons on the ground.   According to PHR interviews, UNMAPA's 4,800 mine clearance specialists are unable to prevent civilian casualties by safely disposing of new unexploded ordnance (UXO), especially cluster sub-munitions, because they lack detailed information about the weapons on the ground. Without full knowledge of the types of weapons that planes are dropping, how these weapons are defused, and where and in what quantities they are being deployed, clearance specialists are unable to proceed with their life-saving work. This information can also be used by the seven non-governmental groups that conduct mine awareness classes for Afghans, teaching them how to identify and avoid UXO that they may be encountering for the first time.   UNMAPA's mine detection dogs are unable to effectively discriminate between mined and non-mined areas due to the explosive residue and multiple munitions spread by cluster bombs. Thus, human mine removal teams must find each landmine or bomb, putting them at an increased risk of detonating the devices.   "The United States must demonstrate true concern for the impact that the air campaign is having on the Afghan people by giving UN demining teams the information they need to save civilian lives," stated Dr. Lynn Amowitz of PHR, currently on the Afghan border. "Coalition stalling only prolongs the inability of Afghan deminers to remove the weapons that Afghan men, women and children fear everyday they step outside their homes, never knowing if their next step is their last," she said.   The CBU-87 cluster bomb is reportedly being deployed in Afghanistan. Each canister can hold up to 250 "bomblets." Cluster submunitions are distinct from other ordnance because of their unusual shape and bright colors, making children particularly susceptible. Clusters are also the same bright yellow color as the humanitarian daily rations being airdropped by the US, though military officials have indicated that they will change the color of future food packets.   Physicians for Human Rights (PHR) promotes health by protecting human rights. The organization has documented health and human rights in Afghanistan since 1998. My feeling from the meeting was that the "two pronged" approach people want us to follow is:     * proceeding with our ("weaker" - ick, I hate that characterization) initial resolution, slightly amended - deleting the "U.S. support democratic processes" clause AND adding a clause DIRECTLY calling for the bombing to stop;     * drawing up and also trying to introduce to the Council a resolution more directly reflecting the 3 MAPC points of unity - in other words, calling directly and emphatically for the bombing to stop but not limiting the reason given for it to humanitarian purposes, etc. X, what did you understand from the meeting?  The feedback was a little confusing.  Basically, people felt that (as a peace coalition) we needed to at least attempt to get a strong anti-bombing resolution passed, and that even if it didn't pass it would help generate debate on the issue and be something for us to organize people around.  Then we'd have the other, more politically palatable humanitarian-focused resolution which would hopefully pass (and send a message nationwide). Regarding the Senate anti-terrorism bill (SB 1510 - http://Thomas.loc.gov ) that passed almost unanimously (Sen. Russ Feingold, D-WI, was the exception) last Thursday and its companion bill in the House (HR 2975) that passed 337 to 79 last Friday: By voting for these bills in your respective Houses, you have betrayed both liberty and justice--those great American values that you are purporting to defend. Indeed, the freedoms guaranteed by the Constitution and Bill of Rights are one of the few things that make this country great. You should be fiercely protecting these freedoms; instead, you have betrayed them. SB 1510 and HR 2975 are unconstitutional. However, there is still time to right this terrible wrong: If both Houses negotiate a compromise between their respective bills in conference, you can take the opportunity to create a bill that does not violate the basic tenets on which this country was founded. Currently, these bills strike no balance between security and liberty. These bills both directly violate the Constitution and existing laws that ensure the public's rights to privacy and due process, and in addition, because of the vague language used to define "domestic terrorism" and what constitutes "supporting terrorism," they also pose an enormous threat to Freedom of Speech and Freedom of Assembly--the public's rights to openly criticize and thereby change policies and institutions. A major concern here is that the Powers-that-be could use this legislation to eradicate public dissent--in particular, the Administration and the Special Interests it serves (e.g., Big Oil, Big Business) could use this legislation to silence its critics among the general public. Already in a speech to Congress, the Administration's Trade Representative Robert Zoellick has outrageously equated opponents of "free trade" to terrorists. According to the ACLU, the most troubling provisions in both the Senate and the House anti-terrorism bills include the following, which should be corrected in conference: --Permits Information Sharing: Allows information obtained during criminal investigations to be distributed to the CIA, NSA, INS, Secret Service and military, without judicial review, and with no limits as to how these agencies can use the information once they have it. --Authorizes "Sneak and Peek Searches": Authorizes expanded use of covert searches for any criminal investigation, thus allowing the government to enter your home, office or other private place and conduct a search, take photographs, and download your computer files without notifying you until later. --Allows Forum Shopping: Law enforcement can apply for warrants in any court in any jurisdiction where it is conducting an investigation for a search anywhere in the country. This would make it very difficult for individuals subjected to searches to challenge the warrant. --Creates New Crime of Domestic Terrorism: Creates an entirely new type of crime, which is unnecessary for the prosecution of the "War on Terrorism." Greetings - This is X from the media working group.  We're compiling information about MAPC activities to put in a press pack for a press conference on Friday (about the 11/17 action), and we would very much like to include something about the city resolution you're working on.  In addition, we'd like to do some publicity about the resolution specifically (definitely press releases, perhaps a press conference).  Since I'm preparing this information for the press pack, I'd like to be able to get it by tomorrow (Wednesday) by 5pm. The story about Al-Jazeera offices being bombed in Kabul in today's WSJ reminds one of the "accidental" bombing of the Chinese embassy in Belgrade in 1999.  That "accident" just so happened to hit exactly where the embassy newspeople were located. This reminds one of the lie told Saudi Arabia that Iraqi troops were massing on the border of Saudi the day after the invasion of renegade Iraqi province Kuwait.  This lie enabled the US to send in troops. A woman journalist was going to print with a story about that big lie and went to the pentagon seeking photos to disprove her story.  Naturally, she was refused.  Years later commercial satellites confirmed that indeed there were no troop formations on the Iraqi border on that date, the day after the invasion of Kuwait. An article last month in WSJ said the US has bought all rights to commercial satellite photos of Afghanistan. HI, X, I hope you got BV's email saying we should get the TITLE only there by 9am.  Were we able to do that?   I think her suggestion of getting the title only in by today, then having the next few weeks to edit the text and organize our alder-contacting strategy, is great. I feel strongly that we NOT try to present anything to alders until we know what we're doing and have the final resolutions ready.  I realize the ball is already rolling, but it's better to be credible and have a strong plan and finalized materials in this case than to rush around with something in a state of chaos.  As the bombing isn't going to stop anytime soon, we unfortunately have some time to work with (a week or two, in any case). My impression of the two pronged approach was to have a Plan A and Plan B - Plan A, the stronger version, being introduced first, to stir debate, and Plan B to serve then as a type of compromise.  They were not to be introduced together - what would be the point of that? BOOKSELLERS THREATENED BY FOREIGN INTELLIGENCE SURVEILLANCE ACT For Immediate Release: November 15, 2001 Rainbow Bookstore Cooperative recently received a letter from the American Booksellers Foundation for Free Expression (ABFFE) concerning the chilling effects on booksellers of the new antiterrorism bill that President Bush just signed into law. If the bookstore were served with a court order under the Foreign Intelligence Surveillance Act (FISA) to search our business records, including the titles of books purchased by our customers, we would have no right to object in court or the court of public opinion. The new law includes a gag order that prevents us from disclosing "to any other person" the fact that we received such an order. The ABFFE says that depending on the specifics of the subpoena, the gag order could extend to contact with an attorney! No right to legal counsel is outrageous but is suddenly a very real and terrifying possibility. This terrifying encroachment on the privacy rights of citizens is itself a form of terrorism. "Terrorism", according to the New Shorter Oxford English Dictionary, is defined as "…the systematic employment of violence and intimidation to coerce a government or community, especially, into acceding to specific political demands". President Bushs declaration of a war on terrorism and subsequent military actions, combined with the presumption that U.S. citizens should willingly surrender our civil liberties for the good of the country certainly constitutes such a political demand. The FBI shows up at your home or workplace, demands information and refuses to let you contact legal counsel would sound like coercion and intimidation to most people. With the passage of the new antiterrorism legislation, if you dont cooperate, if you resist, your freedom and livelihood will be in jeopardy. Ironically, the first definition of the word "terrorist" in my dictionary refers to the Jacobins, the radicals during the French Revolution who "advocated and practiced methods of partisan repression and bloodshed in the propagation of the principles of democracy and equality". The prospect of increasing "partisan repression" at home and "bloodshed" abroad, in the name of democracy, a founding principle of this country as well as in France, is our new terrifying reality. We must collectively take a stand to defend our democratic rights, which includes the right to protest our government, oppose the war, and the right to read whatever we want . The new reactionary political climate, highlighted by the passage of FISA, dangerously expands the decade long government assault on our civil liberties and democratic freedoms. Coordination Committee: This is X, writing in with a status report for the arts and culture committee.  The status of the arts and culture committee, in short, is quite uncertain right now.  We have very few people showing up for anything.  There are lots of different reasons that we few core members have been speculating that this may be, but the gist is that we are on shaky ground right now. The Nov 17th props and posters should be getting finished up this weekend, and our goal is to have them finished for a count by Wednesday evening, at our next evening meeting.  We have a sticky situation on our hands regarding the Nov 30th proposed event.  Because of the unreliable nature of the committee (which has made itself clear this week), and unreliable communication, there has been confusion and disagreement within our committee over this idea.  A few of us would like the event to go forth, perhaps on the one week postponed date of December 7th, while others are apprehensive about the time frame, even if it's postponed a week.  Others still have no opinion to speak of since they have not participated in the dialogue.  If any of you could think this over, and come up with some advice or suggestions for us,  I would greatly appreciate it.  I think it's appropriate to ask, and to take a few minutes to discuss at the meeting, since this situation affects the entire MAPC; there have been postings now on the website and possibly in the mailing -- cancellation would certainly have repercussions, but a poorly planned event would, too.  However, a core group of committed, organized people willing to simplify the plan and put something together could be a solution as well.  Right now we don't have that group.  We have maybe part of that group.  I will be (theoretically) meeting with the group on Saturday, and will try to figure out what we've got, both in terms of the Nov 17th event, and in terms of the committee in general and the People for People, People for Peace.
