As an organization dedicated to advancing and securing the rights of Latinos, PRLDEF is deeply concerned that the Interim Final Rules implementing the September 11th Victim Compensation Fund (the "Fund") may discriminate against minority and female victims of September 11th by the use of raced-based and gender-based calculations. We write to let you know that we are immensely troubled by even the suggestion that the government would consider using such discriminatory criteria to determine eligibility for disaster assistance. In addition we urge you to seriously consider and give great weight to the detailed comments submitted to you on this date by the NOW Legal Defense and Education Fund, Inc. Located just blocks from the tragic events that occurred in New York on September 11th , PRLDEF has been working in a variety of ways to offer support and assistance to those directly affected by these events. In October, PRLDEF began offering translation and support services to the many non-English speaking immigrant claimants seeking assistance at the lower Manhattan disaster relief center. Realizing the need for these services were greater than PRLDEFs small staff could handle, PRLDEF has provided training to close to two hundred volunteer translators who have in turn assisted hundreds of claimants. In addition, PRLDEF is collaborating with other groups who are working with immigrant families affected by the tragedy to ensure that the needs of this population are not overlooked. Through this work we have observed that non-English speaking immigrants are disproportionately denied assistance for what we believe to be discriminatory reasons. Various estimates place the number of Latinos dead or missing at about 1,200 victims and although the exact number may be hard to pinpoint it is clear that Latinos have been deeply impacted by this tragedy. It would be adding insult to injury if immigrant families, who are already facing discrimination as they are attempting to have their basic needs met at the family assistance centers, are also discriminated against by the federal government by the use of race-based distribution of funds. A move in this direction is contrary to the letter and spirit of our nations civil rights laws and would negate decades of advancements that PRLDEF and other civil rights groups have fought hard to achieve. We urge you not to follow this path and to consider other means of determining eligibility that are nondiscriminatory. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. A lot of things changed since that day, especially for families that lost a loved one. It seems as though everyone wants to help in some way and that the government is trying to do their share, but it still doesn't seem to be enough. The interim final rule of the Victims Compensation Found express that the amount of compensation shall be reduced by all collateral source compensation, including life insurance, pension funds, death benefit programs, and payment by federal, state, or local governments related to the terrorist-related aircraft crashes of September 11, 2001. It seems unfair that the government is reducing the settlement awards by the life insurance received. This is the reason I am writing to you to express my concerns. I have read a lot of information about the Victims Compensation Fund and it seems to be a good plan. Not only will it help the victims' families but also alleviate the necessity of litigation. I feel that litigation would not only be time consuming and painful for the families, but it may also hurt the already suffering airline industry. As a Special Master, you are in charge of implementing the government package to those families. It seems as though the settlement amount is divided into two separate aspects: economic and and noneconomic losses. I understand your formula but if you can put a cap of $250,000 for pain and suffering to the deceased (noneconomic loss) then why can't you put a cap on the amount deducted for life insurance? Families who planned for themselves and obtained life insurance should not be penalized for having done so. For example, if a family's deceased made approximately $200,000 per year, that person, if they had a wife and two kids, would get approximately $2,500,000.00. That seems to be really fair until you take into consideration what you refer to as "collateral source adjustment". Life insurance, government, and employer benefits would then be deducted. So if a family had $1,000,000 in life insurance, it would seem that they would only receive $1,500,000.00. But then again you still need to deduct other benefits like Social Security and Workers Compensation How would you even get the deduction number for these benefits? There doesn't seem to an easy way to determine these other numbers because they are so dependant on other factors, like how long they will accumulate, etc. My idea is to cap the life insurance deduction (non-economic loss) number. So if a deceased had a wife and two kids, the cap would be $400,000.0 ($250,000 for the deceased, $50,000 for spouse and $50,000 for each child). This seems to be a much fairer solution because the settlement amount would then be $2,100,000.00, which would be enough for a family to survive on. I know there is probably no easy answer, but if you can put a number on human life with non-economic loss calculation, then you certainly should penalized that same person for have planning ahead. My other reason for capping the life insurance adjustment is that it would seem as though the government wants everyone to opt into the program. As I understand it "opting in" means giving up your rights to sue. It seems as though the whole idea of the program was two-fold, protecting the families and the airlines. But if families don't get enough of a settlement then what choice to they have but to sue? What good is the Victims Compensation Fund, if it doesn't end up meeting the criteria for which it was written? Thank you for your time and consideration in reading my letter. Thursday, February 07, 2002 12:03 PM Victim compensation program Hello I saw the Director or the "Manager" of the program on "The News Hour" last night. I agree that the government should do something to "help" the victims or their families. However, I do not believe that people should become millionaires because of this. I have nothing but the deepest sympathy for these people but to make millionaires out of some of them would be ludicrous. I saw one lady who complained that after cashing in her husbands life insurance she would be able to keep her house and keep her children in the same schools they are in. But she would get nothing else. What more does she want? It was obvious she was use to a life of luxury but life is tough and we sometimes have to make sacrifices to survive. Like getting a job. I believe we are setting a very bad precedent here. Where does it stop? Why not "compensate" the poor guy who goes to work and is run over by a train. Or the construction worker who falls off a building. What's the difference? I don't care how much money somebody's spouse made before. Life is tough and people sometimes have to make changes in order to move one. As far as law suits are concerned, I have serious doubts that a jury would award a huge settlement based on a lack of airport or airline security. I believe an attorney could show conclusively that the airlines provided the exact amount of security the public would tolerate prior to 9ll. For example, American airlines could show that if they implemented the security we now have in place the public would flock to another airline to avoid the "hassle" such security would have caused. In other words, we, not the airlines, were our own worst enemy prior to 9ll. Again, I can see "helping" people but making millionaires out of people is just wrong. The real kicker here is that the compensation doesn't include any charity they would get. The "Master" said that he came up with a figure of $250, 000.00, which I believe he got from the Dept. of Labor. That would be a fair amount if it allowed for life insurance policies and any money from charity to be added to it. If people would have to change their lifestyles because they were use to more money, too bad. Life is tough and it should be tough for all people. The fact that their distribution is diminished by what they will receive from other sources is appropriate - None of those victims were any kind of heroes - they just went to work that day and happened to be in the wrong place at the wrong time. Friday, November 09, 2001 6:36 AM Re: compensation As the former Crime Victims Assistance Coordinator , I have had the unfortunate opprtunity of dealing with victims compensation. This situation has hit me personally. My young cousin lost her young husband on 9-11. The maze she has had to travel with these charities is simply put, cruel. The solution is so simple. Everything that was collected after 9-11was ear marked for the victims of this tradgey--only--.The pain and suffering is equal among the surviviors, so must be the compensation. All these carities need do is simply divide the # of Victims into the amounts collected. No data base needed a copy of the New York Times's List of names of victims and a calculator. The Red Cross and the United Way must be told this is a New Day, not to continue business as usual. All charities must follow the same simple division. The good people who sent in their money did not pick and choose. They have no right to peanialize the victim who lived on a budget and whose bills add up to $1,500 per mo and dole out accordingly. There are victims whose bills may be $5,000 or $15,000, the only fairness will be to divide equally. If $7,000 was colleced and there are 7,000 victims each gets $1.00. The way things are being handled will later cause striff among the suffering. The charities will be the cause of more grief within the victim community. It is not the job of the charities to pick and choose (no matter what method the apply it will be the wrong method) Equal is the only fair way to both the victims and the donorw. These charities should not concern themselves with the finances of the victims or what insurance is paying out to them. It is not their job.
