We are writing today to comment on the rules and regulations being drafted for the U.S. Victim Compensation Fund. First let us say that we are grateful to Congress for creating the Fund, and to all of the people at the U.S. Justice Department for their hard work in drafting the Fund's regulations. The Fund's existence is a great comfort to us and our family. Nothing could ever replace . 's children have lost the loving, caring relationship and the guidance that she was able to provide her 3½ and 7 year-old daughters. 's mother wakes up each morning not being able to believe that she can no longer talk to her beautiful baby. was a significant contributor to the income of the household. Though no amount of money could make up for what has happened, hopefully the Fund will be able to provide 's children and family with the long-term financial security they lost when was killed. We believe there are two things that could help ensure the Fund gives our family their full security: individual consideration of claims and a prohibition on deducting charitable contributions from claim awards. Individual Consideration of Claims: was an individual; she was a human being and had very unique characteristics, as did all the individuals who were lost. Each family has different economic losses related to the tragedy. It is only fair for all of these circumstances to be considered when deciding on a claim. We understand that the people administering the Fund have a limited time to hear cases. We are told, however, that there are ways to make the hearing process streamlined, yet still individualized. We ask that you make every effort to do so. Page 2 Comments of and Families deserve to have their individual circumstances heard, and to have their losses fully and individually compensated, as Congress has promised. , and of course, each of the victims, had special and different relationships with their spouse, children, parents, friends and communities, and to chart or otherwise depersonalize these relationships would be an affront. Please do not reduce the realities of familiesâ?? terrible losses to a "grid" or "matrix" system that does not take the merits of every case, and the devastating losses of every family, into account. Charitable Gifts Should Not Be Subtracted: Please do not allow charitable gifts to be subtracted from Fund awards. People gave those charitable gifts in order to help our family and others in an emergency situation. There is no reason our family, or any other victims family, should be penalized for the American public's generosity. It is hard to believe that any donor intended that their gifts be used to subsidize the Fund. The compensation the Fund provides is supposed to ensure the future of 's children and the families of others who have suffered irreparable losses. Reducing that compensation will have a direct affect on 's children's lives and the lives of thousands of other children. There is no reason that these children should be shortchanged any more than they have been already. In addition, this is not money our family would have received under the Fund anyway. Charitable gifts have covered short-term expenses that the Fund was not designed to cover â?? like the costs associated with family membersâ?? time lost at work due to the tragedy. One last note: We hope that arrangements will be made for hearings to be held in many cities throughout the U.S. so that victims are not burdened with the costs of travel. Monday, March 11, 2002 12:25 PM Full Compensation for 9/11 Victim's Families Dear Madam or Sir: I was sent an e-mail this morning that stated, "In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a fund created by Congress and run by the Department of Justice), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones." Unfortunately, I did not see "Meet the Press" yesterday morning, Sunday, 10 March 2002. I normally do watch this show, but happened to miss it yesterday. After having read this reference I certainly wish I had watched the show. If this is, indeed, true then I think it is unbelievably cruel to exclude financial relief to the partners/families of any 9/11 victims on the basis that they are gay or lesbian. The e-mail also states, "And as an indication of how generous the fund will be, even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits. Feinberg even says that the Attorney General has promised that if undocumented aliens come forward, they won't be kicked out of the country, and their employers won't be penalized. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press. Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state. Otherwise, Tim, I would find myself getting sued in every state by people claiming that I'm not following how the state distributes money. I can't get into that local battle. "That's a long-winded way of saying that if state law discriminates against gay people, then so will Feinberg and the 911 Fund. The problem for gay Americans who lost loved ones on September 11 is that most states do not legally recognize gay relationships, and the very few that do tend to do so only for state employees, not for citizens at large. And while a handful of cities do in fact recognize such relationships, under Feinberg's formula, it's the state's law that counts, not the city's. So, in the end, pretty much everyone who died - including people who aren't even American citizens and were living in the US illegally - will be honored by the September 11th Fund as deserving of America's special recognition and thanks. The sole exception will be gay and lesbian Americans, because Feinberg and the 911 Fund wouldn't want to do anything contrary to US law. (Unless of course it involves an illegal alien who isn't even American - then apparently it's okay to bend the rules.) I think it is incredibly kind and correct to recognize the 9/11 victims who are illegal aliens, their families and the people that employ them. I applaud the fact that these people, their families and their employers will not be penalized. This is kind, this is correct. This is precisely the view that should be adopted. Please reconsider the matter of excluding the partners/families of the gay or lesbian 9/11 victims. Let us be equally kind and correct with them. If anything good is to come from the 9/11 incident, let it be that we now recognize we must take responsibility for more than we have in the past. It is now a very different paradigm. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, February 20, 2002 7:39 PM Victims Compensation Bill I was married to a 26 year old beautiful woman, who had her whole life ahead of her. She did what she was suppossed too, was a productive member of society and paid her taxes. One morning - 6 days before our 1st wedding anniversary, she was murdered by terrorists. Not only do I blame the terrorists, but I also blame the US Government from not doing anything to stop this tragedy before it happened. You were more than aware of the threats to our citizens, but did not release this info. My wife worked on the floor of tower 1 and this is something we discussed on a weekly basis. She had a plan to evacuate and kept a gasmask in her desk. If she was aware of the imposed threat, we would have gone on vacation that week. But because, you the US Government failed to inform us of said threat and failed to protect its citizens from terrorism, my wife and 3000 others are dead. Then, i find out I am being forced to take a settlement from the GOVT, because they are more interested in bailing out the airlines and saving face. This totally disgusts me. And the fact that most americans dont seem to understand, is that this is not charity, but a bailout by the government so that airlines do not go bankrupt. Most americans feel that the amount of money is way to high. Let me tell all you farmers out there, we are talking about people who made millions a year. 1.65 million is not even a years salary, let alone more than most people make in thier lifetime, as others have written to you. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. Thursday, November 08, 2001 1:50 PM Victims Compensation Fund Before 9/11, my husband and I lived in Battery Park City (BPC)one block west of the World Trade Center. My husband lived there since 1990 and loved being that close to the Trade Center. He had a special relationship with those structures and with downtown Manhattan. On his recommendation, I acquiesced to stay there after we married in 1998. I quickly learned to love city living since it was nothing like typical city life. AND I was able to walk to work! Being so happy to live there, my husband did his daily drive to work over an hour away in Westchester. I do not exaggerate how we loved living in BPC. It was a quiet spacious enclave where we could live close to the financial district, the focal point of our careers. And, the apartment was rent stabilized. I was walking to work and was a block away from the WTC when I heard the first plane hit. I saw the floor burning and stayed to help out anyway I could. The first shock was seeing people leap from the building. It was unbelievable! Then another plane flew right over my head and crashed into the second tower. We ran to a park further south. It was such a beautiful day! We congregated there in that beautiful space with the Statue of Liberty at our backs watching the towers burn as we tried to phone our loved ones. "Thank God they built those buildings to withstand that kind of impact and not collapse", the woman to my right commented. That was about 5 minutes before we heard the rumble of the building coming down. Within seconds the dust was falling all around us. Eventually, after the other tower collapsed, a bus drove us north. My husband and I haven't lived in our home since. Because of the effect of the poor air quality on my health, we can't move back to our apartment at this time. Although we'd like to keep the apartment and wait a few months and move back, we could never afford two rents. Our only choice seems to be to move. Do you know what all that means? Tuesday, November 06, 2001 9:32 AM Rules for Victims Funds I don't usually respond to requests for public comment, but I do have strong feelings regarding this issue. The attack has had an impact on all Americans not just those directly affected by the events of September 11th. I live in New Jersey and work midtown on the Eastside. Many days can be stressful with all of the hoaxes and threats. I agree that the victims should be made whole, not enriched. My opinion for distribution of funds for the victims of the World Trade Center attack follows. I am not sure that "victim" has been defined, but it should be anyone directly affected by the immediate attack. This would include people who lost their homes, jobs, etc, not just the victims injured or those who perished in the attack. * There should be no penalty if a person is beneficiary of an insurance policy, pension plan, etc. These funds should be outside the purview of any distribution. Monies they receive from a private disability plan should reduce the amount they receive from a federal distribution. * If a victim or a victim's family receives compensation form a charitable distribution, the amount allocated by federal funds should be reduced by the charitable contribution. * Since many low paying workers lost their jobs because of the attack, they should be compensated for lost wages during the time they seek new employment. Monies they receive from unemployment insurance should reduce the amount they receive from a federal distribution. Again, they should be made whole, not enriched. * Persons severely injured should be adequately compensated for their injuries, rehabilitation and long-term care, and potential loss of future income. * Funds should be held for future stress claims. I feel that only claims for stress for those directly affected should be considered as part of the distribution. Someone who is stressed because of the potential for another attack or who is afraid to travel to work in another part of the City should not be compensated. * Since it is not known, with any certainty, the effect the inhalation of air in and around the site may have, funds should also be held for any future medical claims. * Many children lost one or both parents. A fixed amount, for each child, could be set up in a trust for college funds. The amount can be based upon the age of the child within a certain range. Obviously, a younger child would receive less than a child closer to college age.
