That is something that I am not willing to do at this time. It is a shame that you would choose not to give benefits to those who lost a partner during our attacks. What you are doing to those who did loose a partner during the 9/11 attacks is not any different then those who attacked us. They did not have any care for those they killed, and our government does not care for those that lost a partner in the attack. They are being attacked twice, once by the Taliban and once by our own government. Those who attacked the hijackers and brought the planes down as heroes did so because they love this country. They did not ask themselves, well the government disregards us as people so should I do anything to help them. They did it because for their respect for there country and to save many more lives by keeping them from getting to there intended target. I know that it would be hard for anyone to understand, but those who lost a partner also lost someone that was assisting in paying bills, mortgages, food, etc., just as anyone who lost a spouse also lost someone that was assisting in paying bills, mortgages, food etc. I would have thought that after the attacks that we as a nation would get past the whole homosexual issue. If you as a law maker are uncomfortable with the whole homosexual issue then you need to get out of government and find something else to do. You are in government as a law maker to help our nation, not to choose and decide just because you are uncomfortable with different groups of people to make laws. Everyone should be entitled to the same benefits as the person next to them. I will end this with the unhappy notion that we have people making laws or helping others because it will benefit them and not help the victim. I am very upset that the 9/11 victims who happened to be gay or lesbian are not recognized as fully as the heterosexual victims. I write this because the heterosexual survivors will be compensated for losing their heterosexual loved one's but the partner of a gay or lesbian 9/11 victim do not receive that same right to compensation. Please reconsider this because illegal aliens and unborn babies have more rights to this compensation than a gay or lesbian partner of a victim. The death of any American heroe should not be discriminated against basedon race, creed, religious beliefs, or sexual orientation. The homosexual victim's life is just as equal to the heterosexual victim. ALL the victims spouses, significant others, and families mourn the death of their own heroe; thus, please do not ignore the gay or lesbian individual in grief based on who he or she loved. I am writing to urge you to change the approach concerning the designation of personal representatives to enforce and receive compensation as a result of the September 11 events. The creation of the fund to manage airline liabilities, give sure compensation to victims and avoid diversions of effort into investigations of possible fault and legal liability are all worthwhile, but do not adequately explain the best reason for this fund - to allow the entire country, in some measure, to shoulder the burdens of this attack, and make tangible measure that this was an assault on the entire country. This means that the hallmark of the administration of the fund needs to be practical justice and fairness, not tied to idiosyncratic issues of local law and certainly not subject to varying outcomes based on extraneous circumstances. Unfortunately, the proposed approach fails these elemental questions of fairness. You should adopt a federal standard, and use a broadly inclusive federal definition of the critical person - the personal representative. In particular, you should recognize the dignity and effect of long-standing domestic partnership relationships, including gay and lesbian relationships. The proposal intends to use state law to find persons entitled to compensation and use state law definitions, or equivalents, to define the person entitled to administer compensation - the personal representative. This would lead to varying results, even withi a state. In Maine, for instance, creditors, including contractors, may qualify as personal representatives of an estate. Domestic partners may register as long term contracting parties in Portland, Maine's largest city, but not elsewhere. Some county jurisdictions routinely approve adoption of children by gay couples, while others have never done so. Personal representatives may be nominated in a will. Claims for wrongful death are maintained under Maine law by the Personal Representative for the benefit of the heirs, not the devisees of a will. This means the Personal Representative who is a domestic partner may not be entitled to any portion of a claim, which must be distributed to sometimes distant relatives instead. The claims fund proceeds for an eligible individual are reduced by collateral sources - these claims, for disability or death insurance, survivor benefits, etc. are often contractual in nature with a named beneficiary. The interplay of this with all of the other factors means that individuals would have varying motivations to shop for forums where they are advantaged in some way. There are probably places in America which still define either domestic partner or gay/lesbian relationships as meretricious or even illegal. Millions of children are born each year in unmarried relationships. Allowing the varying details of state and local laws to dictate how the national purposes behind the victim compensation fund will function is not sound. The domestic partners and children of these murdered Americans deserve to come first. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. VIA FACSIMILE January 22, 2002 Kenneth Feinberg, Special Master Aviation Victims' Compensation Fund 78 Third Avenue Suite 2202 New York, NY 10017 Dear Mr. Feinberg: Regarding the proposed salary formula for the Aviation Victims' Compensation Fund, one of our members who perished in the World Trade Center has a circumstance which if not addressed would negatively impact her family's compensation. The victims, the mother of three- year-old twins, and her husband had made a decision that while the children were young, she would work a reduced schedule. Her employer the Port Authority had a "job-sharing" arrangement wherein she worked only twenty hours a week. To the best of my understanding, prior to the children's birth she had worked a forty-hour traditional full-time schedule. If the formula does not take into account this was not a permanent situation and after the children are older she would have returned to a forty-hour schedule doubling her current earnings, the base for her calculation will be half of what she would have earned once returned to the full time schedule. In addition to this particular situation, we do have concerns over the disparity in the final payout when using the proposed formula that relies on the current earnings as the base. It is hard to imagine that there could be such a wide margin in the compensation for a "stockbroker" and one of our victims who may have left small children behind. The impact on the families is the same: they have lost a person who is in the long and short run irreplaceable, Each family should receive the help they need and be justly compensated. As one of our surviving spouses said, there is no way to really make this right, but having financial burdens relieved goes a long way to start. He is currently not working as a result of his wife's death, so he can be with his three year old twins to allow all three of them to heal. So in this circumstance, not only have they been deprived of their loved one and her earning power, they have been deprived of his earnings as well. And as we all know, once you get off the "career track" it is difficult to get back on and make up those years lost. I hope these concerns will be considered when the final determinations are made on the distribution of funds. Thursday, January 17, 2002 9:02 PM RE: Inerim Rule of the 9/11 Victim's Compensation Fund January 18, 2002 Re: Comments on the Interim Rule of the September 11th Victim Compensation Fund of 2001 Dear Mr. Feinberg,  I am writing to ask for your help to correct two inequities in the Department of Justices Interim Final Rule for the September 11th Victim Compensation Fund of 2001 that will result in many families receiving no compensation from the fund. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: - "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. - "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved ones future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congresss goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harms way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceaseds job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. I am writing to lend my voice to the other victims' families of this unprecedented attach on our great country which took the lives of so many of our loved ones - and to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." I and all the victims' families would gladly give up all compensation to have our loved ones back. However, since that is not possible, we ask only for fairness so that we may piece together our shattered lives and hopefully, be able to move on as difficult as this will be. I implore you, as our elected official, to demand changes to the interim rules issued by Mr. Feinberg, the Special Master. As it stands now Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private Fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the Fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families' total compensation from the Fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the Fund under the interim final regulations. At the very least, there should definitely be an attractive significant minimum sum, which the family of a victim can receive by Fund participation, which would not be reduced by any "collateral source compensation." DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases. The presumed non-economic damages awards provided under the interim final rules are substantially lower than those paid in comparable cases. Non-economic damage awards in considerable excess of $1 million are typical for other airline crashes and terrorism cases, but in this instance, presumed non-economic damages awards are limited to $250,000 per victim and $50,000 for a spouse and each dependent. This dramatic undervaluation of presumed non-economic damages runs contrary to Congress's general intent to provide full and fair compensation and, significantly, to the specific language of the law establishing the Fund, which lists an extremely broad array of non-economic damages for which victims and their loved ones are to be compensated (regardless of what may be allowable under state law). The interim final rules can and should be fixed to increase presumed non-economic damages awards to amounts which properly reflect Congress's intent and are a more realistic assessment of the considerable pain and suffering endured by the victims of the September 11th terrorist attacks and their loved ones. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily caps a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Those victims, particularly from the financial sector, are specifically harmed by this limit. They were targeted precisely because of the jobs they held and where they worked - in The World Trade Center, the financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American business and commerce, democracy and freedom. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ has constructed a scheme that provides extremely low awards to those who lost loved ones due to the extraordinary events of September 11 and then declares that only in cases that are extraordinary, beyond those already extraordinary events, will awards be increased. This is virtually an impossible standard to meet and leaves families skeptical as to the Special Master's final decisions. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the Fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended nor is it what families really want to do. Additionally, before families blindly give up their right to sue, they have the right to be fully informed as to what their compensation will be. This is the American way. And lastly, but with no less importance, in many cases, parents, siblings and other family members should be assured recognition in the distribution of the awards received by the Personal Representatives. There are special circumstances in many families that do not conform with the norm. With respect to estranged next of kin parents, the surviving children and/or siblings, who alone provided love and support to the victim, should be considered as a special circumstance. Similarly, for parents, who spent their entire lives loving, nurturing and caring for their deceased child, the death of their child is the most devastating loss one can conceive of, particularly in such an unspeakably horrible act of terrorism. A vast number of these parents are now divorced, widowed or advancing in age themselves and had been assured by the victim that they would provide assistance to them. Their years of love and dediction to the victims should be acknowledged. Many parents who had worked before September 11, are unable to now because their grief is so great they are emotionally unable to perform even routine functions. Many of the victims were young, earning high incomes, married for only a short period of time, had no dependent children and did not yet have a will. These victims' intentions should be honored. This is what they would surely have wanted. In these cases, awards should not only be received by the "legal next of kin". Parents, siblings and other family members endured unbearable losses that will never by replaced. They were also dependent upon the victims for love, companionship and support (either present or future). Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and tell them of your concern that the interim final regulations fail to conform to the language and intent of the act. With the regulations soon to become final, I believe that only the swift and strong support of Congress can avert unnecessary financial and emotional damage. However, what I find most unfair is the deduction of Private Insurance from whatever one is awarded from the Fund.
