We have already made huge donations to organizations and funds for the victims and their families. Without limits and a cap, people will be demanding much more than "their fair share". This is mine, yours, and every American's tax money. Would we have been so generous helping our fellow Americans if we had known that our tax money would also be diverted to helping the same people again? Getting paid double for their loss isn't the American way. Who is to say that any person's loss is not worth $10,000,000? Without limits and very specific rules I fear that this fund will become a way for many people to get more money than they ever imagined, and live only in the past, instead of moving forward with their lives. Wednesday, November 07, 2001 5:26 PM Comments to the DOJ I am a resident of Battery Park City. I live in Gateway Plaza which has been described as "Ground Zero minus One." I moved home recently after 6 weeks of displacement. During those six weeks, I lived in 5 different places. The displacement from my home along with the trauma associated with watching the events of 9/11 as it related to the WTC from my living room window, has negatively affected me both on a personal and professional level. This comment is directed more to the professional affects of 9/11. As a direct result of the attacks, displacement/homelessness, increased travel time, leaving work early to attend several meetings to determine the future of my living conditions and countless hours with various relief and charitable agencies, my work performance suffered dramatically. That is, as a lawyer with a yearly billable hour requirement, I will be unable to meet that requirement this year. The real result of that failure is immediate. I will not be considered for a raise. The other result is failing to meet my billable hour requirement will not help my quest for partnership. Thus, all the extra expenses that I have incurred, to date, as a result of 9/11 will come out of my pocket as well as the HEPA filters that I plan to purchase to combat the almost daily headaches and chest pain that I now suffer from and possibly moving expenses are costs that I will continue to bear.. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, November 07, 2001 9:50 PM victim I live in Battery Park City of New York, which is only a few blocks away from WTC. I have a two-year old daughter. We were displaced from our apartment, and had to purchase everything we needed in our lives in addition to finding temporary housing. I was also out of job for the period that I was displaced as our nanny couldn't work any longer. My work did not pay for those days. I still live in the neighborhood. I smell the awful odor on a daily basis, but I have to stay until my lease expires next year since I would have to pay $6,000 penalty to move out. I am thankful that my family is well, but I also feel that I have not received a penny of compensation. Saturday, March 16, 2002 1:35 PM Discrimination of Gay and Lesbian Victims of 911 BlankI watched Meet the Press a couple Sundays ago and heard that gay and lesbian families were being treated according to state law and, in most cases, would not be able to benefit from the 911 Fund. I heard how that this was perfectly logical because the 911 Fund could not go against state law. On its face, that logic seemed reasonable. Then, I listened further to how illegal aliens and their families could make a claim and receive compensation. It occurred to me that there was an inequality between how gays and lesbians were being treated and how illegal aliens were being treated. Illegal aliens are sure not being judged by state law. It then occurred to me that there is only one state I know of where gays and lesbians would even have an argument to be able to participate in the 911 fund and that state would be Vermont (perhaps there are other state legal theoriest, but they are just that, theories that will require litigation). This is fundamentally unfair and the decision to exclude gays and lesbians from the fund should be reversed immediately. Part of the policy behind the creation of the 911 fund is to unite our country. Excluding gays and lesbians segregates our country. I know we will all one day look back at the discrimination we as a society heap upon our gay and lesbian brothers and sisters, and we will all be embarrassed. Let's recognize this injustice and correct now. Let's not allow history to judge us as bigots. Tuesday, January 22, 2002 10:07 AM Absurdity of the Victims Compensation Plan To Whom It Concerns: The bleeding hearts need only go so far, this plan has far exceeded what is right and just. I, like all Americans, am appalled at the actions against all Americans on September 11, 2001. However, you have gone overboard with this proposed compensation plan! I feel a sense of great loss, but that does not transcend into a sense of public financial responsibility. Not to mention the absurd estimated average death benefit of $1,600,000.00! My office employs 23 individuals. If today a mad bomber, shooter, truck driver, car driver, airline pilot, helicopter pilot slammed into my offices killing everyone, I ask this, "What would you do for us?" Financially speaking, beyond any vested social security benefits, you would do nothing for our combined beneficiaries. Nor should you! It is our personal responsibility to plan for these catastrophic events, no matter how remote the possibility. Not the federal governments responsibility. We, moreover, you the financially irresponsible politicians are bankrupting this country. My conversations, with regular Americans, lead me to believe that this position represents the silent majority of our citizens whom feel that we have gone too far in taking financial responsibility for the victims of 9-11. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
