Friday, March 22, 2002 12:32 PM Justice and equality for ALL To Whom It May Concern, The terrorist actions of September 11th have left an indelible mark on the American psyche. How we react to these acts of hate and war will define our legacy for generations to come. That said, I am appalled at our government's stance with regard to survivors of this tragedy. While benefits are being extended to citizen, non-citizens, and even illegal aliens, gays and lesbians are effectively excluded from support. We are NOT second-class citizens and there is evidence that were it not for one particularly BIG gay hero ( ), another plane-bomb would have struck killing thousands more Americans. I know the victims were innocent, hence the word victims, and yes much money was send to help NY and Washington recover, but this will set a standard that all acts of terrorism victims will use to obtain money from the government. I know children lost their fathers, mothers, or other close relatives. Are we entering into an age of more and more victims, what happens next time? Or the next? What about those from the federal building in Oklahoma, is their loved ones not as worthy--their life not as valuable or was it just timing? Americans die on the nations highways at a rate more than those killed in the bombings (CDC, 1997). It is the fifth leading cause of death, are their lives any valuable, where is the money for their family to get on with their lives? Who pays their families millions to carry on, to bury their death, all in silence from media or government? Do they sue the government for highway money; after all, it was there? Suing has gotten out of hand, I am worried about the future, making all those families millionaires is not going to accomplish much, money was sent to help the victims families, should the families not be grateful for the outpouring of aid? Yes, there are flaws in the airlines, but the buildings were flaw too, since they collapsed under the burden of heat. Do they sue the company who owns the buildings cause of acts of people who were working for a man so corrupted in the mind that American are enemies? This is a wake up call! A call to make our airlines more secure, a wake up call to realize American is not as safe as we naive people believe. However, making many people millionaires will not bring them back. Can we say if one must die they should have died in the terrorist attacks, at least their families are being taken care of. Are the victims both unlucky--death--and their families lucky--they died in terrorist bombings? Tuesday, March 19, 2002 3:51 PM 9/11 fund and gays Mr. Zwick, It is so frustrating to be marginalize by our government. The gay and lesbian community pay millions in taxes each year yet we are left out of so many benefits that our heterosexual counterparts are entitled to via our government agencies. As a lesbian taxpayer I am subsidizing their benefits and have no choice in the matter. The main rational used for this tends to be that God meant marriage to be a man and woman. I am not going to argue this point one way or another. I will simple make a statement about fairness and I am sure God would not have a problem with that. Any 9/11 surviving gay or lesbian partner/spouse should be compensated in the same manner that a heterosexual partner/spouse does. It is easy enough to prove that someone has been in a committed relationships. We buy homes together, pay bills, go on trips, take care of each other when we are ill, celebrate anniversaries, the list goes on. It seems as though you have found a great scapegoat by stating you will abide by what state laws say in the matter. You knew, as did everyone else, the answer to that criteria before you came up with the question. It would be one thing if you were always consistent with that state rules rational, but it seems this administration has taken over several decisions for states on other issues. I pray your conscience will prevail and you will reverse your decision to one that treats all Americans with fairness. It would seem we can all learn one lesson from this tragedy and that is that peoples misperceptions of other people can have dire consequences. Thursday, March 14, 2002 7:22 AM 9-11 Benefit distribution To Whom it May Concern (or not), I would like to register my concern at Kenneth Feinberg's disclosure that the loved ones of gay and lesbian victims of the September 11 disaster will not not receive any benefits from the 9-11 fund. While I understand that some state laws may make it a bit complicated to distribute donations to survivors of gays and lesbians who were killed in the attack, I feel it is a grossly discriminatory gesture to indicate that those who lost their lives and those who loved them are somehow less entitled to financial compensation than those who are heterosexual and survivors who are illegal aliens. As a contributor to that fund, I feel that ALL the survivors are entitled to compensation from the donation I sent. To deny that benefit to the families of gay and lesbian victims on the basis of state laws is a cop out. It sends a message that those lives lost are less valuable and not as important than the others - on the basis of their sexual orientation. Here's a question: Were the celebrities who went on television and asked for donations aware that everyone would be compensated EXCEPT for the survivors of gay and lesbian victims? I believe if this had been publicized prior to the event, there would have been fewer celebrities asking for support and the tally would have been significantly less than the tens of millions of dollars that were raised. I ask you to reconsider the exclusionary tactic of omitting the survivors of gay and lesbian victims of the September 11 tragedy. Friday, December 21, 2001 2:40 PM This is an embarassment Honorable Kenneth Feinberg Special Master of Sept 11 Victims Fund My father was an employee for . He was killed on September 11th in the World Trade Center. I went to a meeting on December 17, 2001 with Kenneth Feinberg where he addressed the group on the outline of the compensation program. One of the first things he mentioned was that there would be NO CAPP on the payout. Once the plan was formally introduced Feinberg capped earners at $240,000. My father was earning north of 2 million dollars a year. On top of this they also announced that all insurance (despite the fact that my father went out on his own, and paid for his own insurance) would be deducted from the payout. My father was 55 years old. Ironically enough, I had a 2 hour conversation with him on Monday, September 10, 2001, where he explained that he loved his work and would be working at least another 5-10 years. He was in the peek of his career. In Feinberg's own words: "The payout will be calculated based on the combination of economic loss -- what the person would have earned -- and non-economic loss -- pain and suffering, emotional distress and loss of consortium." Doing very simple math, my father would have averaged earning (because he has for the past years) north of 2 million dollars. I know for fact he had every intention of working for at least 10 years. Had he worked this entire time, he would have earned north of 20 million in that time. Where is the justice in capping my father at $240,000? In Feinberg's plan my family receives the minimum or nothing. This plan from the beginning, was intended to remove a litigation cloud over the vital airline industry. My family and many many many more families as you will soon find out, will be forced to commence protracted, paralyzing litigation against the airlines. The way the "Program" is set up now the families of high earners (and especially high earners who had the prudence to buy adequate insurance) will not receive any award. Why must these families be punished by not being fairly compensated for there losses. Why must Feinberg feel the need to even the disparity in payments, there were a disparity of people that were lost that earned a disparity of earnings. Why would they compensate all families equally? My family will be missing most importantly my father one billion dollars can't fix that. However my family will also be missing around 20 million dollars in my father's earnings over the next 10 years, yet the Program says we deserve nothing. My family along with many families have no choice but to bring a law suit against the airlines. I hope this letter makes it to Mr. Feinberg, why are the families of the wealthiest victims lost being punished there is at least 6 billion dollars in the fund and less then 3000 deaths from Sept 11. The money is there to compensate families for there actual losses. Why is Feinberg's program refusing to compensate the families of wealthy employees with what they are due? And one final question why does this program keep referring to the compensation as a "reward." This is not a reward, this is compensation for a loss. I speak for myself only, after all that we have had to endure since Sept 11, now we have to watch as we are lied to, and abandoned by Feinberg's Program. Something must be done. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape form... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise account that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. January 17, 2001 Congressman Sununu, I would like to express my concerns regarding the September 11 Victim Compensation Fund of 2001. My faith in our government has long been instilled upon my by my parents and I believe it was Congresses' intent to treat the victims families fairly. Not in excess, but fairly while also protecting the airlines and other entities. Whether I agree with this tactic is not important at the moment. What is important is that the current regulations of the Victim Compensation Fund fall far short of the intent. I am a Republican and do not believe in entitlements, but it is my right as a citizen of the United States to seek full compensation for my husband's death. This right was severed in the Air Transportation Safety and System Stabilization Act when Congress limited the airlines and other entities liability to their insurance limits thereby leaving me with no recourse but the "Fund". If the current regulations are not changed I will receive nothing. Under the economic portion of the Victim Compensation Fund 's financial worth is grossly underestimated, if my economists are correct 75-100% off the mark. The retirement age of 62 is unreasonable. at 62 would have still had one of our daughters in her 2nd year of college. Retirement would not have been an option and as an engineer he would have done consulting for many years if he had received mandatory retirement from . I am not sure I can put into words how offended I am with the "Collateral Sources" that are to be deducted. Life Insurance was saved for and paid for by us, not the government. 's pension plan was earned by him alone and I will not collect this for 23 years. 23 years is a long time, who knows what could happen by then. Travel accident insurance was paid for by on behalf of their employees. The only collateral sources that do not entirely bother me are those payments I am receiving from the federal government i.e. Social security. All others are an offense. was a hard working, sensible man. We saved diligently and live very modestly. What we have was saved for and paid for by us in case the worst happened. It did and now the Victim Compensation Fund is punishing me for that. President Bush has long been an advocate of getting the money i.e. Social security back into the hands of the people to invest and save as they see fit. Why bother when it is held against you. It is incorrect to try to equalize people financially. Why should someone in the same salary range as who decided to go on vacation instead of buying life insurance get more from the "Fund" than I will. Congressman Sununu please do whatever you can to pressure the Department of Justice and Special Master Feinberg into changing the current regulations. I do not believe it was your intent to penalize the victims of the tragedy of September 11. Renew my faith.
