December 23, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." I am not happy that my tax money is going to them at all, despite my sympathy. But I gave money to the Red Cross to help them. I appreciate the hard work you, your Staff, and the Justice Department put into assembling the interim final rules. I also appreciate the fact that, under the interim final rules, charitable contributions to persons injured in the September 11th terrorists attacks or the relatives of those who lost their lives in this tragedy will not offset Fund awards. I had weighted in on that particular issue during the prior notice-and comment period, in correspondence dated November 26th, 2001. At the same time, I strongly and respectfully request that the interim final rules be modified to provide truly full and fair compensation for economic and non-economic harm incurred by victims of the September 11th terrorist attacks and their loved ones. I had emphasized the moral and practical imperative of providing full and fair economic and non-economic damage awards through the Fund during our meeting of December 13th, 2001. Unfortunately, I do not believe the interim final rules achieve this objective. More importantly, those directly affected by the September 11th terrorist attacks consider the interim final rules to be seriously deficient and are -- quite understandably--angry, hurt, and frustrated. A combination of unjustifiably low presumed non-economic damages awards, a flawed presumed economic damages formula, the collateral source offset rule, and an inappropriately steep evidentiary hurdle to securing modifications to presumed Fund awards will operate in many instances to prevent victims and their loved ones from receiving full and fair compensation -and, on occasion, any compensation-through the Fund. This would frustrate Congress's intent, deprive some families of resources critical to their economic security, encourage litigation, and send entirely the wrong signal to these families regarding our government's and society's estimation and appreciation of the magnitude of their loss. 1 In the airline relief and airline security bills, Congress limited the courtroom liability of airlines, the airline industry, the World Trade Center, and other parties. It recognized that these liability limits-operating alone-might deprive victims of the September 11th terrorist attacks and their loved ones of full and fair compensation for the terrible harms they have suffered. Thus, Congress created a government-funded program to provide full and fair compensation for the economic and non-economic harm suffered by victims and their loved ones, minus a narrow range of collateral source payments. Notably, it did not subject the program to the annual appropriations process. Rather, it funded the program through mandatory spending. In other words, the manifest intent of Congress was to ensure that the program fully and fairly valued the economic and non-economic harm suffered by victims and their loved ones--federal budgetary and cost considerations notwithstanding. Indeed, this would not only benefit victims and their loved ones but also reduce litigation arising from the September 11th attacks. Along these lines, the fact that courtroom litigation may be less attractive to victims and their loved ones due to liability limits imposed by recently enacted federal law certainly does not support valuing economic and non-economic damages incurred by victims or their loved ones for purposes of the Fund at levels significantly lower than what one would secure in a successful courtroom action. Those liability limits instead make it particularly imperative that damages estimates under the Fund be full and fair. Again, this is not only good policy but also the clear intent of Congress. To achieve this objective, I respectfully urge you to modify the interim final rules to increase presumed non-economic damage awards to amounts that fully reflect the damages that Congress listed as compensable, correct any and al methodological and statutory interpretation flaws in the setting of presumed economic damages, and allow increases to presumed awards based simply upon a showing that such awards do no accurately reflect the damages incurred by victims and their loved ones (as opposed to requiring a showing of "extraordinary circumstances" for increases to presumed awards). First, the presumed non-economic damages awards provided under the interim final rules are substantially lower than those paid in comparable cases. Non-economic damage awards in considerable excess of $1 million are typical for other airline crashes and terrorism cases, but in this instance, presumed non-economic damages awards are limited to $250,000 per victim and $50,000 for a spouse and each dependent. This dramatic undervaluation of presumed non- economic damages runs contrary to Congress's general intent to provide full and fair compensation and, significantly, to the specific language of the law establishing the Fund, which lists an extremely broad array of non-economic damages for which victims and their loved ones are to be compensated (regardless of what may be allowable under state law). This problem bears considerable responsibility for the fact that many victims or their loved ones would reportedly be severely under compensated or even receive no compensation under the Fund - potentially driving them to pursue litigation which, due to statutorily imposed liability limits, may shortchange them as well. The interim final rules can and should be fixed to increase presumed non-economic damages awards to amounts which properly reflect Congress's intent and are a more realistic assessment of the considerable pain and suffering endured by the victims of the September 11th terrorist attacks and their loved ones. Second, a number of economists or experts have pointed out flaws in the interim final rules' methodology for calculating presumed economic damages. The use of outdated and improperly aggregated federal government data and the underestimation of household services performed by victims and of real increases in earnings by administrative support and clerical workers, among other things, has resulted in the unjustified and unnecessary undervaluation of presumed economic damages. The interim rules' cap on the level of income a victim may be considered to have earned per year for the purpose of calculating presumed economic damages awards serves to exacerbate this problem. I strongly urge you to provide interested parties with all information that is necessary and useful to further evaluate the propriety of the interim final rules' presumed economic damages methodology and then correct all flaws that would tend to undervalue such damages. The fact that these are merely presumed economic and non-economic damages amounts - purportedly subject to upward adjustment based on specific evidence of loss presented at hearings or through supplemental evidentiary submissions by victims or their loved ones-does not excuse flaws in their calculation. Rather, presumed awards should be based on the best available data and methodologies regardless of the hearing or evidentiary submission option. Indeed, the goal of providing accurate compensation expeditiously through the Fund is furthered by having properly justified presumed Funds awards, as this may diminish the need for hearings or supplemental evidentiary submissions in each and every case. It also may be overly optimistic to assume that each fund claimant will be able and willing to present evidence at a hearing to correct inaccuracies in the presumed Fund awards in light of their individual circumstances. Indeed, one can reasonably expect that some victims or their loved ones may, upon viewing inadequate presumed Fund awards, have little faith in the ultimate fairness of the hearing or supplemental evidentiary submission process and decide to forsake the Fund altogether. More importantly, the misplace requirement contained in the interim final rules (though not contained in the statute establishing the Fund) that a Fund claimant demonstrate "extraordinary circumstances" through supplemental evidentiary submissions or at a hearing to justify increases to presumed Fund awards could serve essentially to "lock in" the unfair presumed economic and non-economic damage awards in any given case. Whether or not the presumed awards are fair, upward adjustments should be possible simply upon a showing by a claimant that a presumed award does not accurately reflect the economic and non-economic damages he or she has endured. But this degree of flexibility is particularly essential if the presumed economic and non-economic damage wards would in many cases provide less than fair and full compensation. The "extraordinary circumstances" threshold, however, may prevent the accurate and individualized Fund awards intended by Congress, because while all victims and their loved ones have endured extraordinary hardships, it may be difficult for a single Fund claimant to establish that his or her circumstances are "extraordinary" relative to all other victims and their loved ones. The hearing or supplemental evidentiary submission opportunities for victims and their loved ones must certainly be structured so as to afford them ample time and a convenient way to make their case. But even a properly structured hearing or evidentiary submission process would not remedy the difficulties arising from the inappropriately stringent "extraordinary circumstances" standard. Congress did not erect or envision any such obstacle to the award of accurate and individualized compensation to victims and their loved ones. Indeed, as Congress has considered bankruptcy reform legislation over the past few years, it has moved away from using an "extraordinary circumstances. Accordingly, the "extraordinary circumstances" threshold should be modified. I do appreciate the fact that the interim final rules will not offset Fund awards by the amount of charitable contributions received by a victim or his or her loved ones. I believe the collateral source offset provision of the law is misguided. To the extent the final rules do offset Fund awards by virtue of certain collateral source payments, I strongly urged that you construe the collateral source offset provision of the law narrowly, consistent with the tenets of proper statutory interpretation. In particular, amounts paid by victims or their loved ones to secure certain types of collateral source compensation-for example, life insurance premium payments -should be deducted from any amount considered to offset a potential Fund award. Likewise, where collateral source payments trigger new income or estate tax liability, that new tax liability should be deducted from any amount considered to offset a potential Fund award. Washington, DC 20530 Dear Mr. Feinberg: We congratulate you on your appointment as Special Master of the September 11th Victim Compensation Fund (the "Fund"), and appreciate your hard work in publishing Interim Final Regulations governing the Fund. Although no amount of compensation can replace a lost loved one, we believe that final rules governing the Fund will be critical to fulfilling the intent of Congress to fairly and promptly compensate the September 11th victims and their families. Generally, the Interim Final Regulations follow this Congressional intent. There are three areas of the Interim Final Regulations, however that we believe should be improved to fairly consider the individual circumstances of each victim to determine just compensation - the compensation for non- economic losses, the calculation of economic losses, and the standard for hearings. Specifically, we are concerned that the Interim Final Regulations may impose an arbitrary dollar limit on non-economic damages by inappropriately basing such damages on other federal programs that limit payments to $250,000. The Fund's statute regarding non-economic damages is quite clear. It defines the following elements as compensable non-economic losses under the Fund: [L]osses for physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium (other than loss of domestic service), hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. The types of losses enumerated in this provision were chosen deliberately. Congress intended that each be fairly considered and that victims and their families be compensated for all elements that are applicable to them. Concerning economic damages, we urge the Department of Justice to ensure that the calculations of the presumed awards are based on accurate data for relevant populations. Any estimates of likely lost income used by the Department should replicate, as closely as possible, the likely career earnings tracks of the victims. Moreover individuals and families should be given an opportunity to demonstrate that the Department's estimates do not accurately portray the likely earnings path of the victim on whose behalf they are filing a claim. If this demonstrations is made, the economic damages should be adjusted accordingly. Finally, the Fund's hearings should include a meaningful opportunity to demonstrate that the presumed award does not adequately compensate the victims and families or the damages they have suffered. If this showing is made, the award should be adjusted to provide the appropriate compensation. The Interim Final Regulations call for modification of the presumed award only in "extraordinary circumstances." This exceedingly high burden of proof appears to unduly limit the ability of claimants to obtain appropriate adjustments. In addition, the Interim Final Regulations limit the duration of the hearings to generally not more than two hours. We believe that a meaningful opportunity for a claimant to present information or evidence necessary to a full understanding of the claim should not include proof of "extraordinary circumstances" to receive fair compensation, and should not generally limit a hearing to an unreasonably short duration, such as two hours. By amending the final rules to improve these three areas, the Fund can be implemented in a way that meets the intent of Congress to provide fair, fast, and full compensation for victims and their families that truly reflects the losses they suffered in the horrific events of September 11th and avoids lengthy legal actions. This is in the best interest of all concerned, and we trust that you will revise the regulations to ensure that this Congressional intent is carried out. We look forward to working with you to deliver fair and prompt compensation to the September 11th victims and their families. Benefits to survivors of 9/11 victims should be evenly and fairly distributed. A gay or lesbian who has lost a domestic partner has experienced the same degree of loss as a heterosexual husband or wife. I hope that the victim compensation fund recognizes that its role is not to pass judgement on people and deny an equal share of the fund benefits to those families that don't fit a stereo-typical mold. I think you people who proclaim that no amount of money would bring their loved ones back should stop looking for people to blame. Bad things happen. It is a tragedy that people were killed but I fail to see how $1.65 million or $1.65 million minus life insurance and other death benefits is going to do much other than create a horrible trend for others to follow. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Individual Comment (Please Print) Dear Mr. Zwick: With heavy hearts we write this letter to you representing not only ourselves but the hundreds of other families who lost loved ones in the tragic events of September 11, 2001. On September 11th our lives spiraled out of control. Writing this letter to you in response to your request for comments about the Victims Compensation Fund is one step towards us regaining control over our new lives, and learning to have hope for tomorrow. The Victims Compensation Fund's intent is to attempt to make whole the families of the victims. While the fund is set up as a convenient, expedient process, we are concerned and do share some reservations about its ability to make us whole. OPPORTUNITY TO BE HEARD First, and foremost, we are concerned that we will not be given a complete and full opportunity to be heard, should we choose to do so. Each of us rightfully deserves the opportunity to be fairly heard before a hearing officer. We would like to have the occasion to present evidence though our own testimony and the testimony of expert witnesses. We would like for each of our cases to be considered on a case-by-case basis. For many of us, being given the right to be heard is a crucial and extremely valuable part of out healing process. We hope you understand this. RIGHT TO APPEAL AND FORM OF PAYMENT Secondly, we would like to not only have the right to appeal, but in addition, we would like the payment to be in one lump sum, and be paid out to the beneficiary, consistent with what our investment advisors counsel is the best for our individual family circumstances. Thus, for example, we should be allowed to request that any payment made to our minor children should be in trust. In addition, as the parent of said minor children, we should determine the date of vesting. The trust should not automatically vest at the age of 18, unless we determine it is in our children's own best interests to do so. ECONOMIC LOSSES Third, and of paramount importance to us, is the computation of economic losses. We are strongly against any cap being placed upon this portion of recovery. Simply put, no one should be penalized because their spouse worked long, hard hours and earned a "good salary." We would request an approach like that used in personal injury actions. Retirement should be set at age 68. The decedent's income should be averaged over the past 3 working years. The decedent" age should be subtracted from 68. Those two numbers should be multiplied together, thereby gleaning a starting point for computation. From this base point, other factors such as inflation, wage-increases, merit, likely bonuses and advancement and any other benefits should be considered. NON-ECONOMIC LOSSES Fourth, with regard to the non-economic losses of the fund, there should be absolutely be no cap on this amount. Each person's circumstances must be evaluated individually. Each case should take into account age of the decedent, marital status of the decedent, and the amount and age of the decedent's children, the severity of the pain and suffering of each affected individual (both mental and physical), including the person injured or killed, the spouse, the children and the parents. We would certainly hope that any non-economic recovery from this fund to be generous in light of the terrible circumstances of September 11th. COLLATERAL SOURCES Finally, with regard to collateral sources, we are very concerned about their use to offset any amount recovered from the fund. Life insurance should not be deducted from the fund payments. Simply put, life insurance is not taxed by the IRS for one reason - it encourages people to plan for their heirs. To deduct any life insurance from fund payments would penalize those who were merely responsible estate planners. The decedent's sacrificed and save hard-earned money to pay for such plans; they are already victims once, don't make them victim's twice. Moreover, pension funds, IRS's, and 401k plans should not be deducted from the fund's recovery amount. These plans were responsibly sacrificed and saved for by our spouses, essentially, they are saving accounts, and they should not be deducted from the fund. With regard to charity, Americans across this country donated their hard-earned money as a symbol of their patriotism, and our brotherhood as a nation. To deduct this charity money from any final payment would, in our opinion, be wrong. Donations made to families like us were generously and selflessly given to us as a form of healing for both donor and receiver. Every single dollar donated and received gives each of us hope for tomorrow and belief in our country as a united whole. Please do not denigrate this beautiful symbol of our nation standing together as one. In closing, we would like to sincerely thank you for asking us for our comments. We are all struggling through extremely difficult times. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
