I sincerely urge Mr. Feinberg to extend funds to all of the victims' families, regardless of the victim's sexual orientation. I am one of the many New Yorkers who witnessed the Trade Center collapsing (from 10 blocks away), a site I will not soon forget. I also lost friends to this attack. And I am a gay man. Please do not allow politics to prevent the families of the victims from receiving some sort of closure. This is the only way for them to make some sense of all of this and to be able to grieve their loved ones. Do not deny them this decency, as it will only drag on their pain for an extended period of time as they fight for what was rightfully theirs to begin with. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. I believe that the intention of the law is reduce the compensation received by all collateral sources, such as the specifically mentioned life insurance and pension benefits. Charitable donations weren't mentioned because when the law was drafted, no one foresaw these unusual circumstances. They never thought it would be an issue. However, as one who contributed to several 9/11 related charities, I would rather see the charities direct their money towards those who are not eligible for help (ex. those who lost their jobs or homes) than to subsidize the government awards. Of course, this tragedy brings out the most sympathetic feelings in almost every individual that I have discussed it with in the last six months. I've heard members of Congress say that there would be help and assistance for EVERY person that lost a loved one. I've heard Senator John McCain say that as a tribute to we will "claim victory over these atrocities." I've heard average citizens say that we should do anything that we can to help! But suddenly the sympathy seems to have come to an abrupt halt for a select few. Now we are hearing things like "well, we didn't mean THOSE kind of people." I didn't send my money to help out those "faggots" who should have died along with the rest." "I'm glad that faggot died. It's a shame he had to take the other good people with him." did not want to be a hero. did not want to die. did not stand up and shout I'm gay and I'm hero. He simply offered his life as a means to save others of any race, creed, color or sexual orientation, and to apparently save a national treasure, the United States Capitol. Now the surviving loved ones of others like are being told that they have no claim to any compensation because they are not recognized by state governments as being "legally" entitled. Yet people who have entered this country illegally and have made a mockery of our laws are given special dispensation from the very justice system that they skirt around every day. Why? Because they are heterosexual, of course. How silly of me to question that!! I beg of you to find a way to provide the same kindness, courtesy, justice and love for all the survivors of this tragedy. Gay men and women in this country are beaten, set afire, butchered, tied to fences after being raped and tortured, spit on, chased by cars, - the list goes on and on - almost every day. We have so little recourse for these events because we can't even get Congress to see fit to include us in a hate crimes bill. Our country tells us we aren't even worthy of being protected, that our lives are worthless because of the person we love. Please don't add to one tragedy by perpetuating this hate. I assure you that as a gay man, I feel; I hurt; I cry; I bleed and I love just as any other human being. Friday, December 21, 2001 1:00 PM Help all victims of terrorist attack Dear Mr. Zwick: The very humane Fund for relatives of victims of the September 11 terrorist attacks must include all relatives of all the victims. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. My best friend was killed in the WTC and I established a foundation for the education of the children which has been very successful. So one side of me wants everything that the families can attain. The other side of me speaks to logic and fair thinking. I have no problem with the private charities giving millions of dollars to every single family! In fact I believe these charities are beginning to get there act together and the focus should be to get all these charities to distribute the monies. People who gave monies here expected the families to receive every cent. I believe our efforts should be in getting it distributed! I also agree that Social Security, Workmens Comp etc. Should be made available to everyone. I think the companies themselves including the insurances should be looked at and made sure all benefits are being paid and nobody is getting caught up in semantics to deny benefits.( i.e act of war or not for Life Insururers). The waving of income taxes for families was also a good thing. Where I begin to have my doubts is when the Government begins to give out compensation to victims. I guess if they get it I say God Bless them take the money. But as a citizen I have to look at the total picture of the precedent we are setting. This was indeed a horendous act of unimaginable proportions but what makes these victims any different from Pan Am 103, or Oklahoma City or The Uss Cole or the Anthrax attack or for that matter God forbid another attack of even bigger consequences. Where will we have to draw the line and what is fair? Will the Government have to compensate everyone killed in this war? I just think this should be left up to the private sector to work out . Did the British or French compensate all victims killed in WWII by the bombings by Germany. I just think we have to watch out the example we set for the future. As much as everyone wants to place the blame for this , it was almost an unimaginable event that no one could have totally expected or planned for the way we lived pre 9/11. I know I may sound like I am talking out of both sides of my mouth but this is the way I feel. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
