Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I was not in favor of the compensation law to begin with,but now I can see it has a benefit to society as a whole,as well to the survivors of the victims. I was mainly concerned about the validity of claims. It appears you have addressed that. Compensation should only go to those people who are lawful spouses and dependents of victims. Brothers,ex-spouses,"significant others" and various "shirttail relatives" not dependent on the victim so do not need to be compensated. Monday, January 07, 2002 12:21 AM September 11th Victim Compensation Fund of 2001 I am a taxpayer in the State of New York. I am also a NYPD Sergeant with numerous relatives in the NYPD and FDNY. While I think it is admirable that the government is trying to make the lives of those who lost loved ones in the attack on the World Trade Center more bearable, I believe they are going about it the wrong way. In life you may be able to determine a persons worth by how much he earned, where his job might have taken him, etc., in time of war I believe all people are created equal. Hence, the only fair way for a pool of money to be distributed is; First determine how much money there is to be given away. Second, determine how many victims there were. Third, determine how many survivors of those victims there are (this is where it becomes difficult, limit the survivors to spouses, children, siblings and parents. Any more than that and someone's long lost third cousin is going to try and collect, sad but true). Fourth, divide the total pot of money by the number of survivors and give each family an equal share for each. ( eg: a stockbroker leaves behind a wife and two kids, that family gets three shares. Also, a dishwasher leaves behind a wife and two kids, he also gets three shares. It should be the same amount. Because the stockbroker made more money while he was working, he is not worth more in death. Neither man is working anymore because of the terrorists not because of career opportunities. There is no way of putting a higher or lower price on what someone means to their family because of how much money they made while they were working.) This is not a perfect solution but in a perfect world we would not have to be doing this at all. I have spoken to many members of my family and friends who all believe that this is the fairest way to distribute our money to those who need it. I'm sure this is not the only letter you have gotten dividing the money this way. Which ever you decide thank you for the work you are doing on behalf of the victims. I know it is not easy. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Some in this situation were pregant mothers who were killed. Clearly the family suffers not only the lose of thier mother but they also morn the lose of the unborn child. The pain and suffering of the past few months is immeasurable in a dollar amount. If it was however it would far exeed $100-500,000. Let's be realistic. We,the families, went through weeks of not knowing if our loved ones were alive, we are left to imagine the way in which they died, and we have been forced to make many exhausting trips into the city. On top of that we have bee bombarded with the recognition of NYPD and FDNY. Everyone died doing their job. It is wrong to acknowledge people by occupation. A BADGE DOES NOT MAKE A HERO. And the statue that will be erected with the firemen putting the American flag on the antenna of the towers should not represent the firemen who died. IT IS THE AMERICAN FLAG, IT IS WHERE MY FATHER DIED, IT SHOULD REPRESENT EVERYONE. Also, this is AMerica, land of opportunity. Who is to say that one of the waiters, for example, working in Windows of the World was not saving money to go to college to be a doctor. Congress passing laws granting FDNY NYPD families $250,000 along with the biased Mayor Guiliani's Twin Tower fund is utterly disgusting. I think that the mayor is WRONG and DOING A TERRIBLE JOB WITH ASSISTING THE FAMILIES OF ALL VICTIMS OF 9-11. Something needs to be done, because right now I am not proud to be an American. I would appreciate a letter in return to my comments. I have made several attempts to contact the president and vice president and all I get is a response to donate money to the children of Afghanistan. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
