As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am a veteran with service as both an enlisted man and an officer. Please read: Dear Senator McCain: I read your glowing tribute to . It's clear that at the beginning of this war, you may very well owe your life to this young gay man. I'm sure that this isn't the first time your life has been spared because of the bravery of another American gay man, as many served in the Vietnam conflict as well. Unfortunately, your plea for recognition for isn't being respected by the people running the September 11 Victims' Compensation Fund. Those people are going to pay money to unborn fetuses and illegal aliens who survive the victims of the WTC attack and our government has even promised not to deport those aliens nor prosecute employers who knowingly violated the law. However, when it comes to paying benefits to surviving gay partners the Fund overseers say that they must follow each State's laws in determining whether or not the partner of a gay or lesbian victim should receive compensation. They're just following the law to discriminate. It's never been wrong for gay men and lesbians to die for America as evidenced by our government's frequent STOP-LOSS orders during times when uniformed personell are placed in Harm's Way. But during times of peace it is officially "DON'T ASK, DON'T TELL" and unofficially it is clearly "GET THE HELL OUT OF MY (ARMY, NAVY, CG, MARINES, AF)." There is some indication that the Fund's organizers feel that benefits have to go "for the children" and that's why gay men and lesbian partners can't have benefits - and to get to that they are going to use State laws to stop funds from being distributed therefore. There appears to be no analysis as to whether or not the gay victims left children behind. Nor any consideration of the fact that many tried to adopt but homophobia has left their never adopted children in orphange facilities or state homes. In this country, more respect was paid to men and women of color in 1855 than a gay man or woman in the service of this country today. Gay men and lesbians are far more reviled, even if they happen to be one who, like , saved you from many tons of flaming gasoline and saved our entire government and ways of life on September 11. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, November 09, 2001 2:30 PM Victim Compensation Fund I have been a resident of lower Manhattan for nearly 12 years. I am a homeowner in Battery Park City, and a survivor of the September 11 attack on the World Trade Center. I witnessed the tragedy unfold from my apartment window, and was evacuated in the aftermath of the WTC collapse. I left with nothing more than the clothes on my back and my beloved pets. Because of city and federal authorities, and the damage to my apartment, I had to live in a hotel for nearly a month. When I returned, my neighborhood was shut down with security checkpoints, there were no grocery stores open and no services (dry cleaners, etc.) available. Deliveries of food, etc., were not permitted. Although I had a car, if I removed it from the garage, I could not bring it back. Transportation (subways, buses) was almost non existent. Life was barely sustainable. I count my blessings that I escaped with my life, and that my home was still standing. I feel a great deal of compassion and sympathy to other victims who may have lost loved ones, friends, a job or a business. These victims should certainly be entitled to benefits from the Victim Compensation Fund. However, I do not fit into any of these categories, and I am victim, too. I will have to live with (literally) the repercussions of the attack for years. This has impacted my property value and quality of life. Many of the retail establishments who supported the residents of my neighborhood were destroyed or have gone out of business. Services are harder to obtain, and are more expensive because it is so difficult to get around. Although I am certain that the commercial and business core of lower Manhattan will be rebuilt, it will take years, and the residents of lower Manhattan are the ones who will live with it everyday. Therefore, I urge you to consider making the residents of or homeowners in lower Manhattan eligible to receive benefits from the Victim Compensation Fund. Excluding us would make this tragedy even uglier and painful. Thank you. Sunday, March 17, 2002 1:43 PM compensation of gay partners In all fairness those who can document a committed homosexual relationship, functionly the equivalent of a civil arrangment found in Vermont law, should be compensated no less nor differently than those with the right to establish marital bonds. It may be traditional to find legal relationship based strictly on state law, such as the federal administration of the Social Security laws, but the victims of the 9/11 events should have their arrangements expansively not restrictively adjudicated. Thursday, December 13, 2001 11:20 AM Protect Traditional Marriage Mr. Kenneth Zwick Office of Management Programs Department of Justice Washington, DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist Michelangelo Signorile, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping Signorile accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." This importantly should include the partners and children of same sex unions. Does this mean that their loss is not as great as with a heterosexual couple? Or that the need is less? Or that their heroic deeds were tarnished?
