Comments on Interim Rule Published December 21, 2001 These comments are restricted to Part 104, Subpart D- Section 104.47 Collateral sources. The SUPPLEMENTARY INFORMATION found in the transmittal of these interim rules contains a Statement by the Special Master. This statement, in part, recites that awards under the enabling act be offset by all collateral source compensation such as benefits from life insurance and other government programs. The Special Master then wrote that he found ambiguities in the statute as to gifts provided to victims and their families by private charities. Thereafter he said: "These regulations do not require that awards be offset by such private charitable assistance." It appears ambiguities might continue in the publication of Section 104.47 of the Interim Rules. Sec.104.47 (a) sets out payments that constitute collateral source compensation to reduce the amount of compensation by the Fund. Subpart (b) sets out payments that do not constitute collateral source compensation including (2) Charitable donations distributed to the beneficiaries of the decedent-by private charitable entities. Provided, however, that the Special Master may determine that funds provided to victims or their families through a private charitable entity constitute, in substance, a payment described in paragraph (a) of this section. I have to assume for the moment that the Special Master has in mind some unidentified special circumstances that might arise causing him to conclude that unjust enrichment in a particular occasion is in fact not a payment that would constitute collateral source compensation. By withholding approval of some unidentified situation the Special Master might well have placed a damper on activities designed to operate within full compliance with the legislative intent as well as the precise wording of the initial sentence of Sec.104.47 (b)(2). For example, suppose a professional association suffered the loss of one of its members in the September 11, 2001 event.. Members of this association intend to establish a trust for the education of the son of this deceased member. While these members would prefer to proceed, some members are fearful that should they go ahead and set up the trust the Special master may conclude this trust is not a collateral source thus perhaps penalizing the recovery of the spouse of the decedentk Time tends to heal many wounds and we fear members may lose interest pending clarification of this issue. We would ask the Special Master to please clarify, perhaps by example, what is intended by this apparent reservation of the right to determine that a special circumstance might not in fact be considered a collateral source of recovery. In the alternative perhaps the Special Master might conclude, again as an example, that the activity contemplated by this association is in fact permissible. Thank you. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, March 15, 2002 11:06 AM 9/11 Fund Distribution Discrimination causes grief in this country every day -- to individuals, their relatives and friends, and groups. How is discrimination more hateful than what happened on 9/11? They both hurt. The fund administrator's comments relating to gay partners places gay people into the category of un-citizens, since they do not even rank up there with "illegal aliens," who take away jobs and taxes from "citizens." I am so pleased that Mr. Feinberg has never met with discrimination in his lifetime or that he was too stupid to see it. He has certainly not left anything to chance in his comments. Tuesday, March 19, 2002 11:05 AM 9/11 Victims Fund If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all.  We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family.  Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, December 04, 2001 6:17 PM Compensation of September 11 Victims Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. How can you exclude certain parties just because of their sexual orientation? That goes against the claims that this disaster has brought the nation together. My mother, &nbsp&nbsp&nbsp&nbsp , was killed during the September 11 terrorist attack on the World Trade Center. I just wanted to share with you some of my thoughts concerning the September 11 Compensatory Fund. I have a real problem with some of the methodology that has gone into creating this fund. As a 31 year old adult I do not expect to receive any economic windfall. I feel safe to say that my 29-year-old sister would agree with me. But we have both lost someone extremely precious to us. I understand that the primary focus of the relief efforts should be directed to families with dependent children. But it is wrong to discount the loss that my family must deal with. My children, when I do have them, will never get to know their grandmother. I will never again get to visit with my mother, nor will I be able to look forward to our weekly conversations over the phone. My sister just got married on July 28th. She was supposed to have dinner with my mother on 9/11 and pick out wedding proofs. My sister was cheated out of much of her honeymoon, and the joy that would go along with sharing those moments with our mother. To take people like my sister and I out of any formula used to calculate the effects of the terrorist attack drastically underestimates the hurt and loss that was caused. I also strongly object to the practice of subtracting out life insurance from any claim that will be granted to the families of the victims. How is this at all pertinent to the loss that we have suffered? My mother planned ahead and took out life insurance. This death benefit was bequeathed to her grown children. This is my mother's gift to me and my sister. We would receive this regardless of whether my family submits a claim to the September 11 compensation fund. Choosing to subtract this money from the award we would receive punishes the family of the victims. Those who had the foresight, and the prudence, to plan for the future well being of their families are being penalized. This is ridiculous. My stepfather should not be penalized because my mother decided to take out a supplemental life insurance policy that named her two grown children as beneficiaries. This is just not right. It was bad enough to learn that my mother was taken from us entirely too soon. Then we were subjected to the barrage of media coverage that forced us to relive this tragedy on a daily basis. Then we watched as many charity efforts mismanaged their funds, chose not to distribute the funds in a timely manner, or decided that families like mine were somehow not worthy to receive them. Now our own government has come up with this ludicrous policy. You can only imagine how frustrating and hurtful this has been. It is for the above-mentioned reasons that I doubt my stepfather, &nbsp&nbsp&nbsp&nbsp , will submit a claim to your fund. While it would be immensely healthier to be able to move past this entire experience, the illogical and often arbitrary methods used to settle these potential lawsuits are a lot to bear. I am sure our family will discuss this further in the coming months, but I thought you should know the effects of the policies being administered. Tuesday, March 26, 2002 12:11 PM Against Decision to follow state discremination laws Dear Department of Justice: Thank you for all of your hard work and the difficult task of running the 9/11 fund. (I can only assume that it is one of the hardest things your department has had to do.) I would like your department to know that I disagree with the decision to follow state law in determining whether to grant benefits to a partner of a same sex relationship. An article passed on to me on March 11, 2002 stated that many laws were being "over-looked" to compensate as many people that were affected from this tragic situation. I applaud your efforts to look at people and not laws in this VERY special situation. However, I also read that Kenneth Feinberg's decision to follow state law to avoid law suits from states with respect to same sex couples ( and his partner.) Senator John McCain stated that he was thankful that their were still people like in this world and that Senator McCain possibly "owed" these men his life for saving the government buildings. If we are going to "over-look" laws with respect to illegal aliens, I believe that our government and more importantly this fund should take a stand to treat ALL people fairly.
