Sunday, March 17, 2002 10:59 AM Trade Center Pay-off Fiasco I am appalled that gay and lesbian people are being discriminated against as to recompense resulting from the Trade Center disaster. I am also at odds with not expelling illegal aliens and punishing their employers. But I am most angry at the policy of paying off people who were not in the service of their country at all. The families who deserve payment are those of our servicemen and women who will lose their health care and food stamps if their loved ones die or are maimed in the line of duty! As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. In order to ensure that the victims of the 9/11 tragedy and their families receive fair and just compensation,and to the fullest extent consisitent with the statute, I urge the adoption of regulations that will judge each case on an individual basis. I have read with dismay that there is a push to have the victims' damages judged according to a chart or matrix.Having specialized in this area for over 20 years, I know that no 2 cases are alike and that even when claimants suffer the same injury, so many other variables dictate a different result. This is especially so in the case of the victims who perished on 9/11. I am also a proud member of both the New York State Trial Lawyers Association and The Association of Trial Lawyers of America and signed up for their project in which I will be representing claimants pro bono. Tuesday, November 06, 2001 9:41 PM Suggestion 11/6/01 - One of the major complaints victims have expressed in trying to collect benefits from charities re 9/11 is the extensive paperwork they have to complete each time they go to a different charity.  DOJ could easily persuade or compel all charities to use a uniform information sheet with family's personal data.  Put that form on your web site and let victims' families download the form on their own floppy disk.  95% + of victims are computer literate enough to do this themselves, and the other 5% can get help from most libraries which now have computers.  Then when they visit each charity, the charity can download the information they need without having to write anything out.  Just sign the form to verify its accuracy.   Over time, perhaps a serialization could be entered on each disk so that every charity and agency could check and see what benefits every other agency had paid out, to avoid duplication and fraud.   In 5 to 10 minutes all of the 'paperwork' involved in processing a claim would be completed. Thursday, November 08, 2001 9:10 AM Please help!! Hello, I live across the street form the World Trade Center. I still have not been able to reoccupy my home. The problem that I am faced with is that my windows were opened during the incident on September 11th which left my apartment and all of its contents covered in a thick layer of ash, dust, etc. Now, I am faced with the expense of having to buy a new couch and a new bed. FEMA and the Red Cross said they won't help us with this. What do I do? I don't feel I should have to pay for new furniture when the stuff I had was perfectly fine. I also do not want to keep it due to the health risk it poses by having it in my apartment. There are millions of dollars that have been donated for the victims of September 11th yet no one can seem to help us. I don't have the money to just buy these new things and it aggravates me that I should have to pay for these new things when I was not the one who ruined them!!!! It is not the taxpayers duty to provide compensation when there's nobody left to sue. Now I respect the fact that the Airlines will go under if they had to provide the $$$ for these families and the market can't take them going out of business. But it is not right to take the taxpayers money and award it to the families of this horrible disaster. With the potential of 1.6 million dollars as an average, I feel it is just way over the top. I've been working for 16 years and I haven't even earned $80,000 yet. Now i'm married and am currently furthering my education with a scholarship i won in a competition. My wife is the only one with an income and believe me when i say that we watch every dime closley. We simply cannot afford this. Especially when they say that this is only the beginning. Will we continue to make victims millionaire's over night? And how about the victims at the Oklahoma bombing or the Embassies or even the father that get's shot down in Compton? What of them and their's? Will we always be liable? Me? I believe that there are other options available to compensate them with. The siezed assets of all of theterrorist organizations would be one way. Where's all of that money? How about all the charities? Where's all of that money? How about the airlines insurance companies because after all it is their fault for allowing the terrorists to get through their security gates? Where's that money? Let's face it. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, November 29, 2001 8:34 AM Inclusivity Please take note of the many Americans who are want to be reassured that the Victim's Compensation Fund is going to cover not just "traditional" families, but also those gay and lesbian families who lost loved ones during the attacks of September 11th. The President has spoken repeatedly of bringing the nation together and of taking care of each other, and this is the best possible way to demonstrate that at a time of incomprehensible grief, the federal government is not going to start making judgments about the way people live their lives. A lost breadwinner is a lost breadwinner, whether they are black or white, man or woman, straight or gay, married or co-habiting. Provided demonstrable evidence is available of co-dependence, be it a mortgage or lease or joint bank statements/credit cards, or less formal evidence, for not all of us merge our financial affairs with those we share our lives with, then the bereaved individual deserves support from this fund to the same degree as a "traditional wife and two kids" who lost a husband and Father. The appointment of a democrat has already gone a long way to ease the fears of those who suspected that AG Ashcroft would exclude all but married individuals from the fund - I hope very much that the new administrator of the fund will be as inclusive as possible in determining eligibility. Wednesday, November 07, 2001 2:46 PM re: charity and awards I strongly believe that the amount of charity a family has received should affect the amount of future awards they might be entitled to receiving from the government. It seems to me to be important to remember not only the victims and their needs, but to have respect for those that gave because they could, those that gave when they could have used it for their own families and those that pay taxes and have no choice in the matter. I hope that the award funds would be regulated in some manner so that abuses can be minimized. The Red Cross had funds available and I understand the need for immediate assistance, but I think that if a family received a large amount of money from this or any other charity, that amount should be taken into account when future award amounts are determined. Perhaps a figure could be reached as a guideline for that cap. According to the New York Times, some of the amounts distributed to the families were more than my yearly salary. I do appreciate the Red Cross and United Way and other large charities that are available to help in times like these, but the impression I have gotten since September 11th, is that they ask few questions, keep few records on how much or how many different charities these people have received funds from and I hope the Red Cross is taking into account that the funds they are using are not the Red Cross' but the money of hundreds of others who want to help that they are responsible for and would use the money with that responsibility in mind. I think most people would be disappointed to discover the possibility that a charity paid for a particular situation, such as a funeral, a car for transportation, several months of mortgage payments or rent, and then have the same family receive additional funds from the government for the same situation. My opinion only. Good luck in solving this dilemma.
