Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist      , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
     accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Dear Mr. Zwick:
I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund." I strongly urge the Department to
draft regulations that ensure compensation is available to all victims of
the attack, including the committed partners and the non-biological children
of gay and lesbian victims. The depth of loss and grief that is being
experienced knows no bounds, regardless of age, race, class, gender, or
orientation. The assistance that is needed should be equally available to
all who have lost loved ones.
I urge the department to address the needs of all victims in their policy
making so that everyone who needs help may be assisted. Thank you for your
time and consideration of my request.

widow will receive no benefit from the fund
Dear Sirs:
With my son sleeping peacefully in my arms, I watched as a plane hit
2WTC. I knew that I had just witnessed my husband's murder and I could do
nothing about it. I lost my soul-mate, my best friend, partner and
confidante. He was young, handsome and vibrant. He was outgoing and hard
working. He played every sport, he helped every neighbor.
Every aspect of my life has changed since September 11... People tell
me that once you get back into your routine it will be easier. My routine is
no longer possible. We cannot wave "Bye, bye" in the wee hours of the
morning and we cannot "Clap hands until Daddy comes home."
The widows and families have endured devastation, tragic loss,
frustration and repeated and careless reminders of September 11th every day.
The term "September 11th" is used flippantly by media, advertisers and
economists. We have spent endless hours dealing with paperwork, red tape and
poorly regulated charities. We have received he dreaded knock on he door in
the middle of the night, the police telling us that bone fragments have been
recovered.
I am a 31 year old full time mother of a one year old child who will
have no memory of his father. I am not "well off," I am not destitute. We
have worked hard, planned carefully and lived within our means to try to
ensure that we would never become destitute. I consider myself to be
"average." According to the interim rules, I will receive no benefit from
the Victims Compensation Fund.
We did not ask for this fund. But we must deal with it. The option to
sue has been made not viable. The reason "The Fund" exists is that our right
to litigate has been severely restricted. Congress' intent was to fairly
compensate the families in return for their loss. We are not greedy. We wish
to fairly and accurately be made whole for what we have lost.
In order to be fair and more accurate, the following concepts need to
be taken into consideration:
- Use the decedent's most recent salary. The interim rule ignores
2001. Many young professionals have significantly increased their wages in
the past year- do not minimize their hard work and accomplishments.
- Averaging the three prior years salary will result in significantly
reducing economic damage estimates-and penalize the victims for being young
and successful- consider using the best of three years income to more
accurately reflect the individual's earning potential
- Use statistical data that is more relevant to the population
effected- i.e.,- company and industry in which the decedent worked;
local/city/state averages vs national.
- Earnings potential should also factor in any eminent college degrees,
professional designations, etc., on a case by case basis. Such
accomplishments generally will dictate earnings beyond the formulas used.
- Collateral sources-Should not be deducted- I know...we need to fight
that with legislation but it is worth mentioning. Families should not be
penalized for responsible financial planning or being successful. The DOJ
and special master should seek to minimize any deductions that are mandated.
Social Security alone would reduce my benefit by half.
- Collateral sources- should be more clearly defined as to what is and
is not a deductible offset. To be considered a deductible offset, the amount
has to be identifiable. How can social security be accurately deducted? How
soon will I get a job? die? remarry? How long will social security actually
be paying these benefits? ; How can workers comp be deducted fairly? Will
families have to return workers comp payments?
-Collateral Sources- should it only include compensation that is
government funded? I can understand the government wanting to avoid "double
dipping" in the case of other government programs. Life insurance, company
benefits, etc., are not government funded. They are a product of the
individual's good financial planning and the contract they entered into when
accepting a position at their workplace. Those benefits were earned.
- As has been stated numerous times by TLC and many others, the
non-economic damages are too low.
This legislation was passed 11 days after the attacks to save the
airline industry and our economy. In doing so it diminished my rights. The
fund was established to make up for that loss. At the time it was
established, it was estimated that there were 6,000 victims. Congress was
prepared to set this fund up to compensate 6,000 families. Thankfully that
figure has been cut in half...The government will have to pay out less than
half of what they were originally preparing to pay.
The media is reporting that the average award from this fund will be
1.65 million dollars. They forget to mention that there are huge deductions
that will be taken from this amount. As a result the ill-informed public
think that the "average" widow will be made a millionaire and is greedily
looking for more.
I attended a meeting with Mr. At the meeting, said
that no one likes to admit it but our government puts a price on the value of
a life every day. He said that the price was a couple of million dollars.
If these perceptions were actually correct, I would not be writing
this letter.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Subject: Airline Victims
It should be presumed that all victims on the airlines charged their airline
tickets on their credit cards. As you must be aware all credit cards carry
some form of accidental death insurance. Therefore this insurance subtracted
from the governments generosity leaves the victims familles with No
additional compensation from the U.S. Government. When announcing to the
press the offer made by the U.S. government this important stipulation was
omitted. Therefore misleading the public as to the generosity that the
government has shown to the American victims on those airline flights.
The U.S. government should be ashamed of itself.

Dear Mr. Zwick:
Having seen the consequences of blind prejudice in WWII I came out of the Army with a changed goal in life; therefore, abandoning (albeit profiting still from engineering courses taken before enlisting) what my father hoped in his footsteps I would do, I went into seminary and have been in Episcopal ministry, now retired, for 52-years. Indeed, with reasoned measurement I have devoted my life to raising up the oppressed and downtrodden of life. I both regret, therefore, and protest the discriminatory policy of my government toward gay/lesbian survivors of the atrocities of September eleventh. In this respect I strongly disassociate myself from some of my Christian brothers, e.g. Pat Robertson and Jerry Falwell. Committed relationships are mutually creative and supporting regardless of sexual orientation. Indeed, in my experience I have observed that they, gay and lesbian people--just like divorced people in rigidly biblically forbidden second marriages--have been blessed by God. I ask that the United States of America strive after a morality of a higher order than that of the Taliban or the fanatical adherents of Christian, Jewish, Islamic, Hindu, or Buddhist fundamentalism! Survivors are survivors feeling pain and sorrow--not to mention economic suffering--whether they are survivors of committed heterosexual or lesbian/gay relationships. Please do not shame our Nation by playing to the pit!!!

While I, in no way, compare my problems with those actively hurt, I would like to make someone aware that there are others of us hurt by this terrible act.
I put 9 years of my life into what I thought was a lifetime career only to find myself laid off due to this catastrophe. I am unable to pay my bills, barely able to pay my mortgage, much less feed my family.
Is there no recourse for those of us who have been smiliarly hurt by this? I'm scared and angry. What do I do?

Help same sex partners of terrorist victims
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September
11 terrorist attacks must include all relatives of all the
victims.
This importantly should include the partners and children of
same sex unions. They suffer just as grievously for their
deceased loved ones as do other survivors, and their need for
assistance is just as great.
Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions. They
are interested in a political victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Dear Mr. Zwick-
I am writing to urge you to include gay/lesbian/bisexual/transgendered people
in the selection process for compensation for the Sept. 11 terrorist attacks.
GLBT are American citizens just like heterosexuals- one of the pilots flying
the doomed jet that crashed into the Pentagon was a gay man. His surviving
partner should not be denied benefits based upon his sexual orientation. To
deny GLBT of these benefits would go against the sense of unity that has
overcome this nation since the attacks.
To hear the words of , , and just made my heart ache.... As a gay woman I face discrimination on a daily basis-- I am fortunate in the sense that I did not lose anyone on Sept. 11-- but some of my GLBT peers were not as fortunate... please don't deny them the same compensation that heterosexual couples we be so freely given.

I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims.
It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks.
     was among those on flight 93 who apparently diverted the plane from its high profile destination. He was a gay man.       was a gay man.      , killed while performing last rites on a fallen firefighter was a gay man. How can you tell these heroes families that the compensation does not include them, because their loved ones were gay or lesbian?
Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.

9/11 Benefits
To whom it may concern,
I have just been made aware that citizens who lost their same sex partner in
the horrific 9/11 events will not be receiving the same benefits as those who
lost their "heterosexual" partner on that horrific day. As an American, this
concerns me. We have unborn fetuses and illegal aliens receiving more
compensation from the fund than two same sex people who promised their lives
to each other. I believe all who lost loved ones should be compensated, and
it absolutely stuns me that you would intentionally exclude a group of
people. It's not for you or anyone else to judge whether the "heterosexual"
partner who died is a greater loss than the "homosexual" who lost their
partner. Please reconsider for the benefit of all Americans. We all live
here, we all pay our taxes, and we all love America regardless of Race,
Creed, or Sexual Orientation.

Reponse to grief
I write to you today to encourage the Department of Justice to include among relatives eligible for compensation for the tragedies of September 11 those who lost their life partners or de facto parents or children, regardless of sexual orientation or marital status.
Discrimination, especially in this time of national tragedy, should not dictate response to grief.
