My son is survived by his wife and two children. She has read the fund's regulations and so have I. She being the personal representative has a choice of accepting or rejecting this offer. By signing this agreement and the way it is written I object to the fact that I as the parent have no recourse in this matter if she (the wife) accepts this offer. I feel that my civil rights are being violated by this agreement. My daughter-in-law and children are a separate and apart from my husband and I. Do you or Congress think that I have not suffered from that day and every day that goes by I don't think of my son suffering during this attack. I lost most of my friends in those towers and I will never recovery from the heartache. Who in his right mind would deny me the RIGHT to sue for pain and suffering? I think not, otherwise why would this fund be written to accommodate the airlines and not the grieving families of all those who have died for no accountable reason other than being there. Dear Mr. Feinberg: My husband, , 28, was killed in the horrendous events of September 11, 2001, while at work at , floor of Tower 1 at the World Trade Center. At the time, I was also working as a teacher, and pregnant with our first child. In the trauma that followed September 11, I had to leave my job. I also had to sell our house, which I could not afford, having lost both of our incomes, and expecting a baby. I moved in with my parents to conserve resources. On December 9 our baby was born, and now I must concentrate on raising her without the benefit of my husband's company and support. I was grateful and had a measure of hope when Congress passed the Victim Compensation Program, reflecting the fairness and generosity of the American people. I followed with interest the news about the Program and your appointment. And I was dismayed when I read the Interim Rules and Regulations and the justifications that were published. With a constructive intent, I would like to offer the following comments to improve the workings of the Program: 1. The Victim Compensation Program offers an alternative to suing and going to trial, to seek compensation for wrongful death from the murderers and from those who failed to provide protection: the U.S. government, the airlines and the owners of the buildings and the land. As an alternative to the right to trial, the Program's methodology for estimating the awards, as well as the magnitude of the awards, should be similar to those followed and obtained in court. Since by opting into the Program a claimant loses the rights to go to trial and to appeal, the Program should offer much fairer, better defined and guaranteed results. 2. The published methodology to arrive at the economic loss portion of the awards is unfair and inadequate in the following ways: a) The proposed averaging of the victim's earnings for the years 1998, 1999 and 2000 as the basis for the calculation of lost lifetime earnings, immediately discounts the victim's earnings by 2 years worth of gains. The logical and fair basis to begin the calculation of lost lifetime earnings, should be the victim's earnings for the year 2001, annualized. b) The estimated annual earning increases based on national statistics do not reflect the typical, actual earning increases of victims in the financial industry in New York City. At a minimum, a claimant should be able to provide the victim's actual history of earning increases and statistics applicable to the victim's profession and industry. c) The victims' presumed retirement age should be the standard age 65, not an arbitrarily assumed early retirement. 3. The pain and suffering portion of the presumptive and actual awards should be reflective of awards reached in comparable court trials. The published presumptive awards for pain and suffering are woefully inadequate and inconsistent with those from court trials. 4. Life insurance is an economic remedy to protect from economic loss. If life insurance proceeds must be deducted from the awards (highly unfair, but stated in the statute creating the Program), then they should be deducted ONLY from the economic loss portion of the award. Deducting life insurance proceeds from the pain and suffering portion of the award would be an injustice. In effect, the portion of the award attributable to pain and suffering should be made the MINIMUM GUARANTEED AWARD. 5. The proposed deduction of Social Security and Workers Compensation benefits is outrageous. The victims and their employers PAID for that protection, which represents a minimum level of protection MANDATED BY LAW. If these benefits are subtracted, one can only conclude the absurdity that Congress did not really intend to create a Victim Compensation Program. I appreciate your dedication to your difficult task, and look forward to seeing improved Rules and Regulations for the Victim Compensation Program. Thursday, November 15, 2001 3:47 PM comment I recently read the hr2926 and found that this special fund only covers persons who are physically hurt. I was in 7 WTC on the 40th floor on the 11th. By the skin of my teeth did I make it out of the area alive. Since then, I have been to numerous doctors and physiciatrists and I continue to be seen on a regular basis for sleeplessness and anxiety problems. I am currently on medication for my illnesses. I have lost my girlfriend along with 3 longtime friends. The amount of pain is unbearable and the fact that people who were there and who work there are not included is appalling. Ashcroft Attorney General of the United States United States Department of Justice 950 Constitution Avenue, NW Washington, DC 20530 Re: Victim Compensation Fund in the Air Transportation Safety and System Stabilization Act Dear Mr. Attorney General: As you know, on September 21, 2001 Congress passed H.R. 2926, the Air Transportation Safety and System Stabilization Act (now Public Law 107-42). This measure will provide a much needed tool for help and healing for the families affected by the terrorist-inflicted tragedies. The Victim Compensation fund created within Title IV of that Act was created for just that purpose. As I am sure you are aware, this fund is a major undertaking not only because of the multitude of victims for whom it is intended to provide relief and tremendous cost to the American taxpayer, but also because these victims very likely will receive relief that they would not recover if they choose to go to court as per the normal course. This is because the fund was created to compensate without requiring proof of fault or liability - which relieves the victims of the normal legal burden they will have difficulty overcoming in court with regard to this particular tragedy. There are victims of other tragedies for whom we were not able to provide such a means of "no fault" relief. For these reasons, the class of individuals entitled to recover from the fund was expressly limited only to those that suffered physical injury or were killed as a direct result of the terrorist incidents of September 11, 2001. See P.L. 10472 Title IV, section 405(c)(2)(ii). Moreover, the damages forwhich they are eligible to be compensated must be the direct result of the qualifying physical injury. Individuals other than those victims explicitly covered under Title IV, including family members of the defined class of victims, may have colorable legal causes of action in their own right. Under the clear language of the statute, those individuals are not part of the class entitled to receive "no fault" relief under the fund - however, they are not precluded from pursuing their claims in court. That should be made clear to the American public - by limiting the class entitled to relief under the fund, we did not preclude those outside the class from their day in court. Similarly, those who are within the defined class intended to be compensated are also free to choose to go to court rather than access the fund if they feel unduly restricted by the parameters of the claim process. Moreover, the intent in including a provision in the legislation that funds received from collateral sources be deducted from any award was not to unfairly penalize those who receive compensation to which they are entitled through insurance or otherwise. It was, however, to ensure that there is no duplication of compensation, regardless of the source. This is important to the administration of this unusual fund in order to ensure that there are adequate funds to be distributed to those in need. We must remember that the resources of the American taxpayer are not unlimited and truly they have responded very generously to these horrible events. It would be wrong to take undue advantage of their generosity by an increasing their burden exponentially beyond the defined parameters of the fund. As we all know, the fund was not created to give a windfall to these tragic victims, but rather to assist them in their time of need to get through the loss suffered at the hands of these terrorists. It goes without saying that this fund was not intended to be a boon certain classes of people who may opportunistically assist or represent the victims. And as noted above, due to the intervening criminal act of terrorists, this likely will be relief that these tragic victims may not receive as effectively or expeditiously through the normal legal process since in court their lawyers will be required to establish liability of entities other than the terrorists. Common sense parameters for the fund were necessary, clearly expressed in the language of the statute and need to be enforced. I urge you to adhere to the language and spirit of the statute and not be misguided by those that seek to expand the parameters of the fund's compensation, whether or not the effort is well intentioned. If you do not, we risk the possibility that many of those intended will not receive adequate, needed relief in a timely manner. It is clear that you face a herculean task of creating and administering this unusual fund and I have every confidence in your ability to do so. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The husband a young 39 year old big breadwinning bond broker died in the WTC Sept. 11 tradgedy. He was only married for 1 year .(13 months.)No children.He left his wife a stock account and 2 real estate properties. He had $900,000 in life insurance which he named his 3 siblings and his Mom as the beneficiaries. The victim's wife received a smaller $100,000 policy. The policy's were purchased years ago.My understanding is that only the wife can make a claim under the victim's compensation fund for economic and non-economic losses. I assume the mother and siblings can not make a claim.Will the $900,000 in insurance proceeds penalize the widow's claim to the victim's compensation fund. She did not receive these insurance proceeds. They were divided among the 3 siblings and mom.This issue is dividing several families away from us as well. The assumption is that it should not penalize the widow because she did not benefit or participate in the $900,000 policy.Also, because the recieving beneficiaries are not in a position to make a claim against the fund because they are not the widow.
