It sounds like a corollary of socialism: take from those who build and so you can give it to those you favor. When will our government understand the meaning of a free market and free association? The older I get, the more I realize that the only difference between a "conservative" government and a "liberal" one is who it favors. Those who lost their partners during 9-11 should be fairly compensated. It shouldn't be that hard for the government to assess economic inter- or co-dependence in such situations. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The pain my family has experienced in this tragedy is difficult to communicate. The loss of my father and stepmother are devastating. I would exchange all compensation to bring &nbsp&nbsp&nbsp&nbsp back. The interim final rule increases the already intense pain to an even higher level. I ask you to help bring some fairness and balance to our lives. Please give me a reason to participate in the fund. Please adjust the interim final rule to provide economic and non-economic amounts at fair, balanced and acceptable levels. Please establish a fair appeal process. Please preserve worker's compensation payments for surviving victims. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. The Interim Final Rule provides little incentive to participate in the Fund because it seriously understates our losses and undervalues the compensation for those losses. Consequently, the Interim Final Rule will defeat the intent of Public Law 107-42. When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted our right to sue the airlines, which bear responsibility for our loved one's deaths because of lax security procedures. In exchange for denying Family Members this right, they provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit. This includes economic losses, such as lost income, and non-economic losses. Non-economic losses described in the law are very broad and inclusive. They are described as losses for: physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium, hedonic damages, injury to reputation, and all other no pecuniary losses of any kind or nature. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule issued by the Department of Justice (DOJ) falls far short of these stated goals and does not comply with the statute passed by Congress.: a) Under the Interim Final Rule, my family would receive only one-tenth the amount of non-economic losses recovered in other air crash and terrorism cases, which commonly result in awards of between $2 million and $5 million. b) b) The Interim Final Rule understates economic losses in two ways: It caps the salaries of high-income victims and underestimates the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the interim final rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. Because the initial award amounts are so low, many families will receive little compensation from the Fund after the collateral payment deductions have been subtracted. There will be little reason to participate. To compound the unfairness, my family would have little real opportunity to appeal the determination of the Fund Master. A family's award may be increased above the "presumptive" award only by showing "extraordinary circumstances" beyond those suffered by other victims or victims' families. This makes the hearing or appeal to the Special Master extremely arbitrary, unclear and unfair. In addition the proposed compensation to the spouses, children and other innocent victims of the attacks is out of balance when compared to the generous compensation to the airlines. Not only did the law cap the airlines' liability at the limits of their insurance (which saves the airlines billions of dollars), but it also provides for direct cash payments and loan guarantees to the airlines totaling $15 billion. The underpayments to the spouses, children and other loved ones suffering from this attack will shift the cost of these airline subsides and liability limits to the innocent victims of the attacks. Please correct the inequity. Please give me a reason to participate in the Fund. Please adjust the interim final rule to provide economic and non-economic amounts at fair, balanced and acceptable levels. Please establish a fair appeal process. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Wednesday, March 13, 2002 5:34 PM Presumed Loss Calculations Dear Sir: I am a certified public accountant who is involved in advising some of the families of the September 11th attacks. I have reviewed the final regulations with respect to the Victim Compensation Fund, issued by the Department of Justice on March 7, 2002. I have developed a model to determine economic loss based on the Department's recently issued, Explanation of Process for Computing Presumed Economic Loss. I would expect that using the explanation and the accompanying tables I should be able to replicate the calculation of the amounts reflected in the revised tables of Presumed Economic and Non-Economic Loss. As a test case, I tried to calculate the presumed loss of a married decedent with one dependent who was 30 years old and earned $100,000 at the time of death. Unfortunately, I have not been able to come close to the amounts in the Table. My calculation of combined economic and non-economic loss totals $3,992,028 compared to $3,007,608 as reflected in the table, representing a difference of $964,420. I have reviewed my calculations as well as the DOJ Explanation and the accompanying tables to no avail. This is very perplexing. Obviously, I have misinterpreted something somewhere, but I am at a loss as to where. I would ask that you please provide an example illustrating how the presumed economic losses were determined. My son ,a married firefighter with seven months on the FDNY, because his surviving spouse will receive a pension, life insurance benefits, federal line of duty public officers benefits, etc. will not be compensated for her loss. In fact,it would seem that she would owe the government money because of the aforementioned benefits which were a part of his employment agreement. So my son's life, in the governments eyes, is worth nothing, because he was thinking of his spouses future by taking out a life insurance policy etc. Should someone that purchases flight insurance before flying be penalized if the plane crashes and their survivor collects on his policy? December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate.
