Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. At the same time, however, I respectfully request that certain specific modifications to the rules be made in an effort to more fully comply with the Congressional mandate for full and fair compensation in both economic and non-economic terms. The current interim final rules fail to meet this mandate, in my opinion, due to a lack of clarity in determining economic damages and presumed non-economic damages being held to a level, which is utterly at odds with historical precedent through litigation. In order to more fully comply with the clear intent of Congress and to prevent the conclusion that litigation is the only fair alternative, I would request that the rules be amended to allow for economic damages calculated on incomes in excess of the $231,000 cap currently proposed and that such calculations be done in a consistent fashion and documented across the earnings spectrum. While the elimination of such cap would have no potential benefit in my case, I feel that only through consistency can true fairness be achieved. Additionally, in order to fully and fairly compensate victims whose combination of specific circumstances and collateral offsets might result in no payment from the Fund, I would request that a meaningful minimum compensation level be established as well. By far my area of greatest concern, though, pertains to the subject of non-economic damages in that the proposed formula dictates compensation of $250,000 for the deceased plus $50,000 each for the surviving spouse and children. Such an award represents only a fraction of what would likely be awarded through litigation, and, therefore, does very little to minimize pain and suffering. My late husband, having been a proud alumnus of Georgetown University is survived by our two wonderful young boys who eagerly look forward to attending, as did he. When they are both of college age in the year 2012, however the projected annual cost of attending Georgetown is in excess of $52,000. Are my children to grow up with the realization that our government felt that fair compensation for the tragic loss of their father was less than one year of college expenses? Should this terribly distressing conclusion be deemed acceptable, then I fear my children and perhaps thousands of others will grow up disillusioned and forever bitter toward our government. Certainly this outcome would only serve to further the tragedy, which our nation has already suffered. I must admit that no financial award, regardless of size, could ever adequately compensate for the loss of someone who was the perfect son to his parents, the perfect husband to me, and the perfect father to our children. Truly full and fair compensation from the fund, however, will at least forever comfort us in the realization that our government too, views not merely as a victim but as the hero he will always be to me and my family. An example has already been set by New York's Republican Governor George Pataki. He has granted compensation benefits on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and emotional bonds of family, needs and deserves this kind of help during their time of loss. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Since then female labor force participation has grown substantially. Studies using more recent data (and replicating the methods used by the BLS) give female worklife expectancies that are 10-16% higher than the outdated BLS study. See, for example, James Ciecka, Seth Epstein, and Jerry Goldman, "A Markov Process Model of Work-Life Expectancies Based on Labor Market Activity in 1997-98," Journal of Legal Economics, Volume 9, Number 3, Winter 1999-00, Table 8. 2. I am puzzled by the table showing losses for a single decedent without children. Who would qualify for this award? In those cases where there is a spouse and/or children it is clear that they would have shared the earnings of the deceased. For single decedents, who would have shared the after consumption offset earnings? Perhaps after adjustment for dededent's consumption there will be little remaining for distribution for this category of victim. My point here, essentially, is that in presenting explanation of the calculations of economic loss to the public some specific comments need to be made about this special category of victim. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I urge you to at least consider my comment and then make the decision you feel is appropriate. Every life that was lost in September 11th is equally valid. Discriminating against gays and lesbians partners sends the message that their partners' lives were worse less than others. Years ago women and African American's were the target of discrimination. However, today most people agree that all people are equal and that discrimination is not an American value. Then, how can discrimination for gays and lesbians be acceptable.
