January 9, 2001 To Our Elected Officials: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims" Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such Success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"...every death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. As Mayor Giulani stated in his farewell address: "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..." Friday, January 11, 2002 10:55 AM Interim Final Rule of the September 11 Victim Compensation Fund of 2001 This letter is submitted to furnish comments and recommendations regarding the Special Master's 98 Percentile Rule incorporated as part of the Interim Final Rule. Amidst all the uproar regarding the compensation rules contained in the Interim Final Rule, the central question seems to have been overlooked. Simply, it is this: Is the Special Master administering the Act, as he is charged to do in Section 404, Administration, or is he rewriting the Act, which only Congress can do. Let's examine the evidence to answer that. Determination of Economic Loss The Special Master has decided that the determination of economic loss from earnings shall be based on earnings up to but not more than the 98 percentile of US income, equal to $231,000 maximum. He concludes in the Interim Final Rule that payments based on income higher than $231,000 would be "excessive" relative to survivor's needs, but he indicates that "extraordinary circumstances", not defined, might increase the actual payment. The statute never uses the word "excessive" nor any synonym for it regarding the amount of compensation, nor does it specify nor suggest an upper limit to the victim's compensation. However, the statute does define "economic loss" as any pecuniary loss, including the loss of earnings, due to death. It does not place a cap on the loss, as the Special Master, has done. In fact, the statute requires the Special Master to determine the extent of the harm to the claimant, including "any economic and non economic losses". Obviously, the term "any economic losses" does not mean "some" of the losses, or "losses up to $231,000", but "all" of the losses. Amount of Compensation The statute also requires the Special Master to determine the amount of compensation to which the claimant is entitled, based on the harm to the claimant, the facts of the claim and the individual circumstances of the claimant. The Special Master has zeroed in on the term "individual circumstances" as a way to cap the victim's compensation and throughout the Interim Final Rule has offered various reasons for reducing the amount of compensation for high income victims to less than their actual economic loss. The first sentence in the previous paragraph is included in Section 405(b)(1)(B)(ii). That section describes the amount of compensation to which a claimant is entitled. The inclusion of the term "individual circumstances" in that section would more logically be interpreted to justify an increase in the computed compensation, not a reduction. The only place in the statute where reductions in compensation are covered is in Section 405(b)(6), but there is no provision there or elsewhere in the statute suggesting or requiring that the earnings used in determining the amount of compensation be limited. If Congress wanted such a limit, it would have so specified, as it did by specifying the types of collateral compensation which it wanted to be deducted. As previously shown, the Congress required that all economic losses be used. It seems that the Special Master decided at the outset to cap such compensation and then searched through the statute to find a phrase to justify it. In fact, in the section entitled "Statement by the Special Master", he states that "The statute specifies that individual circumstances beyond economic and non economic harm should be taken into account". The words "beyond economic and non economic harm" do not appear anywhere in the statute, contrary to his assertion. This unrelenting assault on the earnings of high paid workers results in regulations which exceed both the spirit and the letter of the Act. The Special Master's primary justification for rewriting the statute is based on his interpretation of Section 407 of the Act which requires the Attorney General ".... to promulgate regulations to carry out this title...." on four procedural matters as well as "other matters determined appropriate by the Attorney General." The "other matters" phrase does not authorize the Special Master or Attorney General to expand or restrict the terms of the statute, as the Special Master has done, but merely "....to carry out this title". Webster's dictionary defines "carry out" as follows: to put (plans, instructions, etc.) into practice; to get done, bring to completion, accomplish ---- not to revise, expand, restrict or change. The Special Master has repeatedly said in public that he has not capped the amount of compensation that will be paid, but his 98 Percentile Rule does, in effect, cap the payment. His 98 Percentile Rule is arbitrary and not in compliance with either the spirit or the letter of the statute. It is a rewriting of the statute. Fair Treatment In the Interim Final Rule he has also stated that an objective of the regulations is that each claimant shall "be treated fairly based on the claimant's own individual circumstances and relative to other claimants". But in many instances, probably most, his 98 Percentile Rule results in unfair treatment. The following illustration is not hypothetical nor theoretical; it is a factual representation of an actual situation and, as noted previously, also represents the situation of many victims whose income is being capped by the Special Master. The statute includes life insurance as a collateral source which must be deducted from the computed payment. Obviously, the larger amount of life insurance one had, the greater would the deduction be. But what type of person would have large amounts of life insurance? Firstly, he would be a hard worker who worked long 60 and 70 hour weeks in a stress filled job enabling him to achieve a high income, and, secondly, he would be one who was a prudent and loving spouse and parent who paid high premiums for many years in order to provide his loved ones with some financial protection after his death. He was not the high living, free wheeling, big spending guy who spends everything on the good times today and lets tomorrow take care of itself. Congress, in its wisdom, chose to repudiate the concept of hard work, prudence and self reliance by reducing the victim's compensation by the amount of life insurance he paid for. This amounted to more than one million dollars for high income individuals in many instances, including the one in this illustration, substantially reducing their compensation under the statute. Then, the Special Master decided to slam these victims a second time by capping the amount of income they can use in computing economic loss, resulting in a lower amount of compensation from which they must deduct a high insurance payment which they wouldn't have been able to afford in the first place if they were in the 98 percentile. The message seems to be don't work hard, don't save, don't be prudent because the government will penalize you if you do. Obviously, by introducing a second penalty to high wage workers, but to no one else, on top of the one imposed by Congress, the 98 Percentile Rule voids the objective of fairness. Litigation In conclusion, the Special Master states that the Fund offers the claimant an alternative to litigation. Unfortunately, his unilateral imposition of a salary cap, on top of the reductions mandated in the statute, will force most high income workers into litigation if it isn't rescinded. I would like to first express my appreciation that such efforts have been initiated and that public comment has been requested. Unfortunately, these issues are very dear to me, because I lost my father-in-law, , who was working at One World Trade Center on September 11th. I read the proposed regulations quite closely and feel that much of the plan for the Victims? Compensation Fund is fair to the victims and their families. I am quite concerned, however, with one of the specific clauses in the proposal: I believe that families? compensation should not be reduced by the amount of supplemental life insurance received. Such a reduction would punish those victims who sacrificed some of their earlier earnings to offer their family some extra security. Certainly, we do not want these earlier sacrifices by the victims to result in less funds being obtained by their family members. In addition, we do not want to discourage others from planning in the future for their heirs. I hope you consider my suggestion when you develop the final rules for the Fund. Those who were directly affected by the attacks came from every walk of life. Those terrorists did not discriminate agaist anyone based on race, religion, gender, sexual orientation, marital status, or disability. The only category that was targeted was nationality. That nationality was American. Just as Caucasians died, so did Latinos, African-Americans, Asians/Pacific Islanders, Native Americans, and others of mixed races. Just as Christians died, so did Jews, Muslims, Hindus, Buddhists, and those who don't subscribe to a religious belief. Men, women, and those caught somewhere in between died. Just as heterosexual Americans died, so did gays and lesbians and bisexuals. Married persons, as well as those who are single or living with a domestic partner, died as well. Just as those who were able bodied died, so did those who are disabled. The families and friends of those persons also suffered much loss. My point is that the US government has a responsibility to help out all those who suffered from the events of that horrific day without regard to any of the aforementioned characterstics. I heavily encourage the US government to please allow everyone who suffered, including the same-gender partners of the gay, lesbian, and bisexual persons, to receive compensation for their loss. Zwick, Director Office of Management Programs Civil Division, U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue Washington, DC 20530 Re: Comments on the Interim Rule of the September 11th Victim Compensation Fund of 2001 Dear Mr. Feinberg: The September 11th Victim Compensation Fund of 2001 issue does not personally affect me financially. However, I am writing to ask for your help to correct two inequities in the Department of Justice's Interim Final Rule for the September 11th Victim Compensation Fund of 2001 that will result in many families receiving no compensation from the fund. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims' families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
