Dear Sir, Ma'am, It has just come to my attention that partners of gays/lesbians killed in the Sept 11 attack are not included on the list of "human beings affected by this killing of thousands of innocent Americans." I am 52 years old and have had to deal with this discrimination my whole life. It isn't easy maintaining a sense of loyalty to a country that doesn't recognize us. We are alive, work, pay taxes, and try to feel as if we are a part of society just like anyone else. The most important part about being a human being is that we have feelings. I'm not sure what many other Americans think but we bleed when we're cut, we cry when we loose a loved one, we have parents, grandparents, and many have children. We are just as much a part of this society as the rest. Isn't it the co-mingling of cultures, races, and lifestyles that has made this country great? Doesn't the idea of Democracy in America say that "all people are created equal?" Or is this just for a few chosen ones? Thursday, January 17, 2002 11:03 AM Non-economic loss Mr. Feinberg: My husband was one of the victims of the terrorist attack on the Pentagon, September 11, 2001. He left behind myself and our two children, ages 7 and 10. I cannot begin to put into words the magnitude of the loss felt by our children. I am asking for you to consider raising the non-economic loss amounts for the children. The program as it is designed (if the economic loss figures are adjusted) would be intended to provide the economic loss from my husband no longer here working and bringing home our sole source of income. Therefore (if I simplify to make a point) you would give us 100% of his projected income, then deduct what we receive for workman's comp and social security. While the children are dependents, this amount is 75%. This would give me 25% from the fund. (We would then deduct life insurance and add non-economic loss). A person who has lost their spouse, and does not have any dependents, would receive 50% from the fund since they already receive 50% from workman's comp. I understand why this is done, but it doesn't make sense to me fundamentally that as a stay-at-home mother with two young children I would receive so much less from the program than a spouse with grown children or without children. Therefore, it would make sense to increase the non-economic loss figures for the children who have been left for the rest of their lives without a father. They suffer this trauma everyday as they hear and see their friends with their dads and live without the important influence and love of a father. They have lost a crucial part of themselves--a part for which there can never be a replacement. This will affect them forever. PLEASE think about this and consider increasing the non-economic loss amounts for the children from this tragedy. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, D.C. 20530-0001 Re: Victim's Compensation Fund Dear Mr. Zwick: Below please find our comments to the proposed interim rules. Non Economic Loss: The statute provides for non-economic loss. This includes losses for physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium (other than loss of domestic service,) hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. Each family is entitled to full and fair compensation for each element per the enacted statute. The statute does not limit or cap the recovery of non-economic losses to a pre- determined amount. Nothing in the statute allows the special master to make a pre-determined amount of any of these damages. Additionally, the sum of $50,000 that he has determined is the amount to be awarded, regardless of the circumstances is arbitrary, capricious, unfair and unjust. The statute provides for hedonic damages, and for compensation for the pain and suffering of the decedent. It is not a matter of discretion. The pain and suffering of the victims of 9/11 is unspeakable. Many of these people had to make the choice of dying in the flames or jumping to their doom. The North tower took fifty-three minutes to collapse and the South tower took one hour and forty minutes to collapse. Courts have awarded and sustained over one million dollars for the pain and suffering of a decedent in an airline crash in a case where it was estimated that the suffering lasted only 12 minutes. Here, the awards should be multiples of that, not a flat amount of $250,000.00, which is then subject to collateral offsets. Economic Loss: The proposed awards for economic damages are grossly inadequate. Contrary to the Special Master's language, the statute does not make economic loss a needs based loss. Rather, the statute simply states that economic loss is defined as: any pecuniary loss resulting from the harm, including loss or earnings or other benefits relating to employment, medical expenses, loss due to death, burial costs and loss of business or employment opportunities. The statute does not give the Special Master the power to determine how much money a family "needs", it only allows him to calculate the actual loss sustained. There is nothing in the statute that allows the economic loss to be limited to a pre-determined or presumptive amount. Nor does the statute have a "cap" on earnings. The Special Master's arbitrary top amount of $231,000.00 is discriminatory to those who have earned, through hard work, more than that amount. The presumptive awards stated in the interim regulation for economic loss fail to set forth the manner in which they were calculated. The economic calculations are supposedly based on a variety of economic data, including, gross earnings, retirement age, tax rate, reduction of the award to present value (using an unknown discount rate),as well as a reduction for personal consumption (however, the regulations do not state what that consumption rate is.) The determination of economic loss should be based on the actual earnings, as well as the earning potential of each decedent. The Department of Justice relied on outdated work-life and life-cycle data, and fails to address promotions and other increases in earnings for victims. Each person's economic loss needs to be determined individually and not in mass. Additionally, services to loved ones should be addressed, and other elements of employee compensation, such as stock options must be recognized. Burden of Proof The burden of proof must be changed. The requirement that families must prove "extraordinary circumstances" in order to receive more that the presumptive award is an impossible standard to meet, and it is contrary to the statute. Again, this burden is discriminatory to those individuals who had been financially successful. The fund was designed to replace the tort system. The Special Master should look to the law to guide him in determining a reasonable method of implementing the congressional intent for fair and reasonable compensation. This importantly should include the partners and children of same sex unions.
