Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Feinberg, Special Master Dear Special Master Feinberg: This office has received several inquiries with regard to the Final Rules of the Victims Compensation Fund. There is a concern that, parents of married children who were victims, have no standing to collect under the Fund. Many of these parents suffered as grievous a loss as the spouses and children of the victims. Several parents witnessed the horrific incident either via television, or were in the area of the tragedy. It is my understanding that should surviving relatives accept payment from the Fund that they mustwaive their rights to bring suit against the airlines. Many of the parents of the married victims have suffered extreme emotional distress as a result of being witness to this tragic event. Should the parents of the married victims be denied compensation from the Fund, they would not have waived their right to bring suit against the airlines. It is certain that such a suit by the parents of the married victims would defeat the purpose of the Fund, which was created to shield the airlines and their insurance carriers. I respectfully request your response as to the status of this unique group of parents, so that I may advise them as to the Fund's position with regard to this matter. Thursday, January 31, 2002 5:01 PM PLEASE CONSIDER STRUCTURED SETTLEMENTS Reasons: 1. Payments are made over a period of time and designed to come at times when people need them - college funds, etc. 2. History has shown that people are given large amounts of money they spend it all within five years -- nothing would then be left for children and they would be looking at airlines and government to collect more later. 3. We are in the DC area and can meet with families who were affected by the Pentagon disaster and let them know how structured settlement payments work. 4. It would save the fund benefits because money would not need to be paid now, but could be paid monthly, etc. There are many other benefits and ways to help families and the fund using structured settlement annuities. We would welcome the opportunity to meet with anyone who is interested in exploring this option for these families or sending materials to anyone who is intersted in considering this option. All the travel we do is at our own expense and the fund does not pay us anything. If a structure is done we are paid by the insurance company. Both the fund and the families should benefit from this financial tool. We try to work to heal religious differences, racial differences and educational differences...yet our own country is going through its most devastating time emotionally and economically for the last 50 years and we are not showing compassion to our citizens. If I understand correctly the will of this Fund is to EXCLUDE domestic partners of gay VICTIMS of 9-11. WHAT!? We have overcome so much to learn to not hate people for their sexual preference and this fund seems to take the country back 20 years. Do domestic partners of gay victims not have house payments, or credit card bills, or need money for food and medical care? Most Fortune 500 companies now pay life insurance benefits to domestic partners in a homosexual relationship if they can prove they have been in that committed relationship for 6 months or longer - why can't a fund formed in 2001 follow suit? Is the only reason that you have excluded this group of people is because you don't feel their argument for punitive damages will hold in a US court of law, if they attempt to sue the airlines? Seems to be a purely financial decision in a time when this country needs compassion, from the top down. If the United States wants patriotism and compassion among its citizens, the government needs to start to treat all citizens fairly. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. It puts a face on each and every victim of this horrendous attack. Then I would ask you to reflect on the innocent children that have been affected for the rest of their lives. And, here is my two cents - the government should come up with a flat figure (for example, $250,000 per person - please feel free to go higher). If a family has three remaining members they would receive $750,000. In addition, the charitable organizations should compensate each family and the government should mind it's own business when it comes to these compensations. The money the charitable organizations have received was sent in by the world public specifically for the families affected. They should distribute EVERY PENNY!! The businesses affected should be compensated by the city, state and federal governments. They should not be compensated by the charitable donations. Lastly, these compensation decisions should be made quickly. The families have suffered enough - they should not have to worry how they are going to make their rent/mortgage payments. This was a terrible tradegy for all involved. Partners of gays and lesbians killed in this incident should not be overlooked. They too are suffering. To exclude this group only adds to the pain. Zwick, Director My daughter husband, ,Jr. was killed or should I say murdered on Sept. 11, 2001 at the World Trade Center. He worked for . was a loving, caring husband and father to his wife and two children, 12 years old and 10 years old. He gave his all to his community of Woodcliff Lake, NJ. could never turn down anyone when they asked for his help. was always there when he was needed. He never gave a thought to his own needs. Now he is gone forever. Never to see his girls graduate high school, college, marry or have grandchildren. And they will never have the pleasure of seeing their father at these wonderful occasions in their lives. This will be a very sad Christmas for his family. Almost too much for them to bear without him by their side. & were married 18 yrs they were the traditional American family. I have heard that the compensation package offered by the government will be determined by the amount of life insurance my daughter receives. I feel as she does. They paid life insurance for 18 years. This was not funded by the US government. The government should not consider that as part of the compensation package. Billions of the American peoples tax dollars are sent to foreign countries year after year but when comes to our own you start to count the pennies. Shame on you! Tuesday, November 27, 2001 11:46 AM Comments on Title IV, H.R. 2926 To Whom It May Concern: I am a volunteer facilitator working with the New York City Bar Association on behalf of victims and survivors of the 9/11 disasters. A common question among those who are involved is how, and to what extent, compensation from the September 11th Victim Compensation Fund will be "offset" by other compensation and/or support claimants have or will receive pursuant to these tragedies. This seems to be a key issue that could greatly affect a person's decision of whether it makes sense to forego certain legal rights by participating in the Fund. For example, one possible scenario is that a claimant who chooses to participate in the fund is required to present evidence of his or her losses, as well as any other sources of compensation he or she has or will receive, prior to obtaining a judgement award from the Fund. In this instance, the amount awarded for the person's loss is directly affected by the additional compensation information. A second scenario is that a claimant who participates in the fund presents evidence of loss to obtain a judgment award, but is not required to present evidence of other compensation received until after the award is determined. Once the award is determined, the amounts the claimant has previously received are deducted from the award. In the first example, a person might be less likely to forego his or her legal rights for suit because it permits the receipt of earlier benefits to influence the extent of that person's loss. In the second example, a person's loss is determined independently without regard to the level of support previously received. This seems to be the more equitable procedure. In the end, obviously, Congress will make the ultimate determination of what the procedures will be. But, in the interim, any information is greatly appreciated.
