Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinbergs self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King, Severe death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene that will be repeated in the media for decades to come - is a horror these families will never escape from. The Special Master cannot take it upon himself to restrict the rights of the families. Therefore, we request that the interim rules be amended to more appropriately compensate the victims families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: we have an obligation to the people who did die. Sometimes our government must step in after disasters to aid the affected citizens. I am writing because I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. EVEN FETUSES AND ILLEGAL ALIENS ARE COVERED!!! Imagine even fetuses and illegal aliens will be receiving benefits under this program - heck, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - &nbsp who helped bring down the flight in Pennsylvania, NY Fire Dept. &nbsp who died in the line of duty when the first tower fell, and &nbsp who was co-pilot of the plane that crashed into the Pentagon (there are many more) - we are told the law is the law and no exceptions can be made. ENOUGH IS ENOUGH If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, January 08, 2002 6:53 PM Comment I respectfully request and pray you read this entire message/comment and give it some thought. I am just as sorrowful and sympathetic as anyone for the victims of the 9-11 murders. I fail to see why the taxpayers owe the victims anything, however. The US government doesn't compensate others in the same way. The government didn't compensate the victims of the Murrah building bombing with any special compensation AT ALL, (unless they had a federal pension, insurance or similar policy in place) and they were in a Federal building! That being said, I will accept the argument that the action was an attack against the entire USA, government included, and therefore something could be done, if for no other reason than to avoid even the appearance of our government not caring about its people. Why give such a windfall to them, however? No one on this planet has a guarantee he or shee will be alive tomorrow, much less employed or making at least as much as he or she makes today. Why is the government treating this incident like that fact is not so? Things happen in life and the only things that are guaranteed are death and taxes. That may sound cliche, but it is as true as anything that can be said. To give the survivors upwards of a million dollars and more, up front, is obscene. This essentially guarantees those people who have any skill in managing money a lifetime guarantee of prosperity. No one else gets that. This is not envy. This is a taxpayer asking the government to, FOR ONCE, be responsible with my, and other taxpayers', money. Don't take my word for it. Find out how many of the general public think those survivors should get getting such a windfall. I'll bet it is a minority. MY SUGGESTION: Take the money that is going to be doled out to the victims and put it in a money market account, or some kind of interest earning financial vehicle. Use the interest earned to fund the following benefits to the victims, and when all benefits have been accounted for, retrieve the money and put it back where you got it. (1) Guarantee the victims that all expenses they incurred, be they burial expenses, medical expenses, etc, will be paid for by the government. (2) Guarantee the family members who lost wage-earners the equivalent of the lost salaries, insurance coverage that was covered by their employers, etc, payable monthly or annually, for three years. (This of course would be subject to the same mitigation that is in place now with any life insurance, etc, being considered.) That should give the survivors a chance to get their lives back together and become responsible for themselves. That is what this country is about. I don't see how one can justify just making instant millionaires (from the taxpayers' pockets) out of a bunch of ordinary working people just because they lost a loved one, for whatever reason. This largesse being proposed is being called "Compensation." That money doesn't represent compensation for a loved one. Ask any of the survivors if they'd take even $5 million versus getting their loved ones back. This is being done to make the doers feel good about themselves and look good in the public eye, pure and simple. Otherwise, why not do it a little more sensibly, as I have suggested? It could be done so that it wouldn't cost the taxpayers and it would still help the victims. As for the victims crying about the proposal not being enough, can you spell greed? This country is infamous for the degree with which slick talking lawyers and gullible juries (remember the DuPont implant pseudo-science and the New Mexico hot coffee award? What? Coffee is hot??) hold the country hostage in the guise of reparagions/compensation. Everybody wants a chance to catch that magic ship coming in and the victims all see this as theirs. Again, they say it is not enough, but ask them what they would turn down if they could get their loved ones back. AS you can tell, I am a proponent of Tort reform. I am also a proponent of MY government being fiscally responsible. I imagine I'll go to my grave frustrated on both accounts, but I must try. My family and I were living on reduced income in order to pay premiums for a life insurance policy. My husband's foresight to provide for his family's future and the sacrifice of current income for potential future protection should not be used to penalize his heirs.
