In a country which is supposedly founded on the separation of church and state, this is a strange circumstance indeed. It appears that the government is taking the kind of stance that did in those days immediately following the tragedy....making it clear that fundamentalist prejudice is still very alive in the U.S., just as it is in many fundamentalist Islamic countries. The fact that it is Christians doing the discrimination is no comfort to those affected by this discrimination. Please realize that history will one day recognize the legitimate human rights of Gay, Lesbian and Bisexual people, who have always been a part of building this nation, and of defending it, as (a gay man on United flight 93) did on September 11th, 2001. How wonderful it would be if the manner in which the September 11th Compensation Fund is distributed could be a sign of a coming equitable and just future, rather than a remnant of a hypocritical and ignorant past. After hearing statements by Kenneth Feinberg this weekend on Meet the Press, I can't believe that gay and lesbian partners of victims will not be equally compensated. Why is it that illegal aliens will be provided financial compensation over US citizens who deserve this support just as much----even if they are lesbian or gay? Feinberg uses the excuse that the DOJ does not want to go against state laws. How can this be if the DOJ is turning a blind eye to illegal aliens thus affected! One of the heroes of this whole catastrophe was an openly gay man who prevented one jet from crashing into federal buildings in Washington. Instead it crashed into a field in Pennsylvania, perhaps saving hundreds of lives. The decision to not treat lesbian and gay people equally in this compensation plan is a mockery of the American people. The US has demonstrated how we can come together. Yesterday, 6 months after I witnessed the Towers burn and crash, I finally went to Ground Zero with my visiting 17 year-old niece from Kansas. As a New Yorker, I had no desire to go there. I had watched thousands of my neighbors and city-dwellers stream past my home in Manhattan that day, crying, bewildered, covered in dust or blood. I did not need the reminder of this heinous act. But now, after hearing Meet the Press and seeing Ground Zero, I feel terrorized all over again. Now this terror comes from within my own beloved country's government. The designated relief agency is choosing to treat gay and lesbian people differently than other citizens or even illegal aliens who have suffered in this tragedy. Sunday, February 03, 2002 1:16 PM Distribution of funds Dear Sirs: I read that compensation of victims will be based on future earning power of the victims, which in essence means that the wealthiest families will receive the most money and the poorest families will receive the least. Those most likely to have resources and savings will receive more, and those least likely to have resources will receive the least. To me there seem to be two fair ways to distribute funds. One would be to distribute based on need. The other would be to equally divide the money among all of the victims' families. To distribute the funds the way you are planning is to say that wealthy or well educated people are intrinsically more worthy than people with less education or money, which is anathema to the values the country was founded on. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We have two children, , 19 and , 17. Our address is Rockville Centre, N.Y. I have read Title IV of the Act, and my comments are as follows: The Rules dealing with Collateral Sources must make a distinction for insurance proceeds that are received under policies paid for by the decedent's family. Otherwise, similarly situated victim's families will receive unequal treatment depending on how they provided for life insurance. As a simple example, we paid substantial premiums for life insurance for almost 20 years. Assume that another family decided to self-insure, and instead of paying premiums, he/she places the amount equal to our premiums in a bank account or into a mutual fund. Twenty years later, we have the insurance proceeds, the other person has an appreciated bank account or appreciated mutual fund balance. Our insurance proceeds reduce our award, but his self-insurance fund does not reduce his/her award. At the very least, the collateral source amount should be reduced by the premiums paid plus interest. We would also point out that although some life insurance proceeds are paid through company plans, we, in effect, paid for the coverage by virtue of the fact that the premium amount was imputed as income to us. The Rules relating to Sec. 405(3)(B) should make clear that if our award is reduced by Collateral Sources, that we could file a civil action to recover the amount that reduced our award. Friday, January 18, 2002 8:33 PM compensation The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid incomparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable work life and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. Thank you for giving this matter your immediate attention. December 29, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. If it is true, I question the humanity of the following statement: In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. * * * I do not see how the sexual orientation of a hero should enter into the picture when it comes to financial benefits going to the partner of that hero. The tragedy of 9/11 was of such a magnitude that special dispensation should be given, and any law that bars rightful recipients of financial benefits is shameful and will arouse a great many people to take legal action. Of course, this may be merely a horrible rumor, but if it is not, you can expect a huge backlash if all the heroes families and partners are not treated equally.
