Help all victims of terrorist attack
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.
This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones as do
other survivors, and their need for assistance is just as great.
Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions. They are interested in a political
victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

September 11 Victim Compensation Fund
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

My husband did have the foresight to purchase insurance but why
should we be punished for this. Americans donated money to relieve
the suffering of all the victims. Our lives will be as much disrupted, our
grief as great and loss of stability such as to compare to any
survivors of this tragedy.
Our family emphasizes the need to consider the lifetime
potential earning power of my husband and the collateral
damage, both financially and psychological, done to my immediate
family (Mother, Father, Sister, in laws.)

DESCRIMINATION amongst recipiants of benefits
Hello,
Just a friendly note to let you know that I am out raged that this fund will be discriminating against survivors of a tragedy because they have lost their gay partners. This is Un-American and is un-acceptable to me AS an American. These survivors should receive the same benefits as all others, including the "illegal" aliens that the government is turning it's legal eye away from.
Please reconsider this decision, ALL of the deceased deserve EQUAL treatment!

Why is the government paying anything to anyone concerned with the Twin Towers/Pentagon tragedy? The only people that should be getting anything from the government is the military personnel who were killed or the civil servants who were killed and had an insurance policy. We can't and should not expect the government to pay for a situation like this when there is no way to prevent someone who is willing to give up their life for a cause. We did not pay the families of the Oklahoma bombing, any embassy bombing, 93 UN bombing, McDonalds shooting in Cal, disenchanted postal employee, disenchanted individual with the stockmarket in Atlanta, etc. All of these events left peoples lives destroyed but we did not try to make them whole or take care of their families for the rest of their lives. The American public made extremely large contrributions to the Twin Towers funds and this, along with the insurance policies that each of these families have should be the extent of compensation. We all feel for each of the victims and their families but the government can not take on every victims family for everyone that may be killed by the numerous idiots that are in this world. Why is someone who was killed by a terrorist who happens to be from another country any more of a victim than someone killed by a demented person from the U. S.

Relief for All Partners

Dear Mr. Kenneth Zwick,
I write as a supporter of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination. I am asking for your support of equal access to
benefits under the September 11 Victims Relief Fund for all victims,
regardless of sexual orientation or marital status. As you know, the
United States has committed to uphold international human rights standards,
including the Universal Declaration of Human Rights and the International
Covenant on Civil and Political Rights, which prohibit arbitrary
discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Victims Compensation COMMENTS
Dear Sirs:
I am the parent of , Brooklyn, NY, who
is still listed as missing at the WTC site.
I have many concerns and reservations as to how the Compensation Act is
written to date.
My overall main concern is - no amount of money could ever compensate for
the loss of my son, but do not insult his memory and all his heroic deeds by
offering such low token amounts for his lifetime's worth and then
collaterally subtract out all the things that he worked for and paid into
such as insurance and pensions. Why should he now be penalized for wanting
to provide for his surviving loved ones?
And second of all, do not fool the public into thinking we're all going to
become millionaires over this, when in fact, after all of the required
collateral items are subtracted out most people would be left with nothing.
Lastly, If our government can send over billions of dollars to Afghanistan,
a country that caused us all this pain and suffering to begin with, do not
make us (United States citizens) quibble with our government over a few
dollars one way or the other.

Equal Rights for ALL concerning 9-11
Dear Mr. Kenneth Zwick,
I write as a member and supporter of Amnesty International, a worldwide
human rights movement committed to ensuring respect for the basic human
rights of people without discrimination, in support of equal access to
benefits under the September 11 Victims Relief Fund for all victims,
regardless of sexual orientation or marital status. As you know, the
United States has committed to uphold international human rights standards,
including the Universal Declaration of Human Rights and the International
Covenant on Civil and Political Rights, which prohibit arbitrary
discrimination.
As a gay man, I know that society can be incredibly dismissive of the idea
of gay partnerships. The fact that same-sex marriages are still the butt
of jokes is disturbing. I think that official recognition of VALID
same-sex partnerships will help not only society in accepting love in all
its forms, but help gay men and women see that their love is valid and that
partnering can help build a support community from which all can benefit.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards by including among
relatives eligible for compensation those who lost their life partners, as
well as de facto parents or children, without regard to sexual orientation
or marital status. The State of New York has already adopted such a
policy, granting compensation benefits "on a showing of mutual
interdependence with the victim, in recognition that anyone who shared with
the victim living expenses, day to day activities and the emotional bonds
of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick
Safe Horizon is responding to the Department of Justice's (the "Department")
request for comments on the interim final regulations issued on December 21, 2001
(the "regulations"), addressing implementation of the " September 11 Victim
Compensation Fund of 2001" (the "Fund"). As the country's leading victim services and
assistance to victims of the September 11, 2001 terrorist attacks, Safe Horizon directs
its comments toward helping to ensure that the FUND is administered in a manner that
most effectively and fairly serves victims and their families. We are joined in these
comments by the National Center for Victims of Crime and the Hispanic Federation.
Since September 14, 2001, Safe Horizon has been offering financial assistance
and other services to the victims of the September 11 tragedy. As of January 17,
2002, we have distributed $119,288,016.84 in assistance to 29,513 victims of the
disaster. Based on Safe Horizon's longstanding experience in serving victims of
crime, and on our recent experience serving victims of the September 11 terrorist
attack, we submit the following comments in response to the Department's request
for comments to the Regulations:

I. Claimant eligibility
a. The Regulations should specify that all individuals who suffered loss can recover
a claim.
1. Claimants should be eligible regardless of their immigration status.
The Immigration and Naturalization Service (the "INS") has stated that families in those
circumstances should be treated with compassion and their cases treated with discretion.
Families of Victims of Terrorist Attacks, INS News Release (Oct. 10, 2001). As the INS has
recognized, families of the September 11 terrorist attacks whose immigrant or non-immigrant
status was dependent on the victims's status should not be concerned about facing immediate
removal from the United States. Id. By contrast, the Regulations are silent and the program
information is ambiguous as to undocumented individuals' eligibility . Consequently, it would be
entirely reasonable for those individuals to assume that they are not eligible to receive
compensation.
In order to ensure that undocumented individuals will file claims with the FUND, the
Regulations, as well as program information and application forms, should make abundantly
clear that they are eligible and will not be penalized for applying. Therefore, the Regulations
should explicitly state that immigrants who meet the eligibility requirements may recover from
the FUND regardless of their immigration status. They should also affirmatively assure applicants
that information gathered through the application process will not be released to the INS and
may not be used against a claimant in any immigration proceeding.
In addition, program information and application forms should reflect this policy. As
currently drafted, program materials may discourage otherwise eligible undocumented
immigrants from applying. For example, it appears that a social security number is required in
order to submit a claim form. The application form should clearly state that a social security
number is not required and should also indicate the multiple languages in which applications and
supporting materials are available, and these materials should be readily available to claimants.
2. Regulations should specify that non-traditional relationships will be recognized
as families.
As currently drafted, the Regulations do not explicitly protect an unmarried life-partner's
right to file a claim with the Fund. By deferring to state law in determining the beneficiaries and
personal representatives of the deceased victims, the Regulations may effectively preclude
assistance for same-sex and other non-traditional life partners, because those relationships are
generally not recognized under state law. The Regulations should specify that these relationships

will be recognized for the purposes of determining who is a dependant, a beneficiary, and a
personal representative, for purposes of administering the Fund.
b. The standard for "physical injury" will preclude claims by many individuals
who suffered direct harm.
The Regulations currently limit recovery only to those who suffered physical injury,
which is defined as " partial or total disability, incapacity or disfigurement." 28 C.F.R.
§104.2(c)(1) (2001). On its face, this determination seems to have the perverse effect of penalizing those
persons who were injured and suffered as a result, but were fortunate enough to recover. The
regulations shoold be amended so that those who suffered serious physical injury that can be
documented, are eligible for recovery.
Additionally, we reiterate our recommendation that the term "physical harm" should be construed to
cover psychological as well as discernable. Many of those who were injured may suffer tangible loss
even if they do not have a discernable physical injury, and should be eligible. For example , someone
whho worked in the World Trade Center and escaped without physical injury may nevertheless have
experienced psychological distress that may have produced longstanding damage, including disability.
The fact that these victims were lucky enough to have escaped without observable physical harm should
not render them ineligible for recovery. In order to ensure that only those who suffered measurable
injury can recover, the regulations could impose some additional requirement. For example, the class of
eligible claimants could be reasonably limited by requiring eligible claimants to establish that they were
physically in the vicinity of the World Trade Center and were rendered unable to work or engage in a
major life activity as a result.
Furthermore, requiring the claimants to have received medical care within 24 hours of the attack is
overly restrictive and unrealistic. 28 CFR Sec. 104.2 (c)(1) (2001).This requirement will
exclude many individuals that the statue clearly contemplates as eligible claimants. For a
significant amount of time after the attacks, many of those injured were in a state of shock and
did not realize that they required medical attention. With the public transportation and
telecommunication systems severely disrupted, the primary focus of most surviving victims was
to escape the affected area and reach their families. Many victims were required to walk miles to
reach their homes, and were simply too exhausted, physically and mentally, to navigate the
disrupted transportation system and seek immediate medical attention. It is contrary to the
language and the spirit of the statute to exclude these victims from recovery.
II. Nature and Amount of compensation
a. The definition of "Dependents" should clarify that all those who were actually
dependent on the victim will be considered to be beneficiaries in calculating non-
economic loss.
The Regulations should adopt the same inclusive approach to calculating non-economic
loss that we recommended be applied when determining eligibility. Currently, the Regulations
set $250,000, plus an additional $50,000 for a spouse and for each dependent, as the presumed
amount of non-economic loss. 28 CFR §104.44 (2001) This language is unclear as to who will
be considered a dependent, but could be construed to limit the term to those claimed as
"dependents" on the victims' income tax returns for the 2000 tax year. However, our
experiences with family members of deceased victims has revealed that in many cases the
deceased victims provided crucial financial assistance to family members other than their spouse
and children. these include family members who are not U.S. citizens or residents, parents
whose children helped support them, other relatives who relied on decedents and those in same-
sex partnerships. Applicable tax laws may preclude many of these family members from being
claimed as "dependents" on the deceased victims. To accurately establish a level of
compensation that reflects all family members substantially affected by the attacks, these family
members should be included as "dependents" in determining the amount of non-economic loss.
b. The Regulations should clarify the circumstances, if any, in which charitable
contributions will be considered in determining what is a "collateral source."
Although the Regulations state that charitable donations distributed to beneficiaries of
deceased victims do not constitute collateral source compensation reducing the amount of award
from the Fund, 28 CFR §104.47(b)(2) (2001), it also authorizes the Special Master to determine
that such charitable donations can constitute collateral source compensation. Id. This ambiguity
should be clarified. As Safe Horizon stated in its previously submitted comments, it opposes
treating charitable contributions as collateral sources, among other problems, such a
determination would negatively affect charitable giving by removing the incentive for donors to
provide assistance. Nevertheless, if the Department authorizes the Special Master to treat
charitable contributions as collateral sources in some situations, the Regulations should clearly
identify what these situations are.
c. Only collateral sources actually received by the claimants should reduce
payments from the fund. The regulations require that payments from the fund be reduced by
"all collateral source compensation". 28 C.F.R. Sec. 104.47 (a) (2001) the regulations should
clarify that only collateral source payments designated to be paid eligible Fund claimants will reduce
payments
from the Fund. For example, payments made to beneficiaries other that eligible Fund
claimants,
such as organizations or entitles, (e.g., pursuant to a corporate key-person life insurance policy)
should not reduce Fund payments made to eligible Fund claimants.
d. The procedure must promote consistency and equity.
As a final matter, a procedural mechanism should be built into the process to ensure that
similarly situated claimants receive comparable payments. For example, rather than one hearing
officer conducting the proceeding, a panel comprised of rotating hearing officers could conduct
the proceedings. A separate review board should periodically review the decisions to make
certain that there is no substantial divergence in payment to similarly situated claimants.

has in connection with establishing the Fund, or to provide more detail about the responses outlined

WTC VICTIM COMP FUND

Dear Dept of Justice:
I wish to state my disagreement with the interim rules issued by Kenneth
Feinberg, the Special Master, regarding the Victims' Compensation Fund of
2001, P.L. 107-42, to compensate the relatives of the victims of the brutal
attacks on September 11, 2001.
Mr. Feinberg took the fiduciary responsibility to act on behalf of the
relatives of the victims and, as it stands, the rules fail to satisfy the
letter and the spirit of the legislation. Specifically, we request that you
act on our behalf and demand the following changes to the interim rules:
1. Collateral Sources:
The victims' relatives are being asked to give uninformed consent to
something that has no certainty - a fund that may provide little or no
compensation to some of the victims' families. The deduction of insurance
proceeds, pension funds, 401K proceeds and other collateral sources could
eliminate awards to some families and, therefore, should be eliminated from
the terms of the fund. To penalize a victim for acting with responsibility
and compassion for their loved ones is unjust.
2. Consistency:
The arbitrary income limits and the calculation of award amounts imposed by
the Special Master are inconsistent.
3. Non-economic rewards:
Mr. Feinberg has arbitrarily restricted the award for pain and suffering.
In the words of Rep. Peter King "...every death is tragic. A murder is
particularly tragic. But to have your loved one murdered in a burning
building in full view of the world - in a scene which will be repeated in
the media for decades to come - is a horror these families will never escape
from...The Special Master cannot take it upon himself too restrict the
rights of the families." Therefore, we request that the interim rules be
amended to more appropriately compensate the victims' families for the
immeasurable pain and suffering endured by our loved ones.
As Mayor Giuliani stated in his farewell address: " we have an obligation to
the people who did die...Their families need to be protected just as if they
had been alive, financially and every other way that we can help and assist
their families...There should be no compromise about that ever...". We
request that the interim
rules be amended and redefined to the extent that collateral sources are not
deducted from the recovery; arbitrary income caps are not imposed;
compensation for pain and suffering more accurately reflect the unimaginable
horror which was suffered by the victims.

Dear Sirs,
After reading the newspaper today, in particular an article on the reactions of the various parties involved in the compensation fund, I found myself wondering about the entire situation. Meaning no disrespect to those who lost their loved ones in the 9/11 attacks, I feel I must speak my mind. I grew up as a military dependant, my father served in Korea and in Vietnam. Knowing that the possibility of my father never coming home was very real, and knowing those whose fathers did not return, I fail to see the logic in the US government compensating anyone for something not of it's doing. We do not compensate the families of soldiers who die serving their country in times of war, why then in this case? Is the government then going to begin compensating the scores of families whose sons, fathers, and husbands gave their lives in war? Granted it was a great tragedy, more so to those whose lives were impacted by the attack, but this seems to go beyond logic. If payment were drawn upon the frozen assets of the perpetrators, this would seem to make more sense. I feel that although this is a well intentioned response to an event that we are completely unaccustomed to in this country, it is not the right response.

Our son,      , was lost in the September 11 attack on the World Trade Center. He
leaves
his wife,      , and his      daughters,      , as well as      brothers

On the night Mr. Kenneth Feinberg and the Department of Justice announced the "Interim Final
Rules"
which establish certain parameters for distributing compensation to bereaved families, we also
watched
another news segment. In this report we learned that our government is subsidizing the building of
two
giant luxury liners for a cruise company in Mississippi. To our shock and dismay we also learned
that, if
the cruise company should fail and declare bankruptcy, we taxpayers will foot the bill.
We question the priorities of a government which seeks to limit awards to bereaved families but is
willing to risk millions of taxpayer dollars on so frivolous a project.
     was the youngest of our five children, a loving husband, an involved parent, a caring brother
and a
respectful son. His family and other close family members require therapy. His children are fearful
when their mother is out of sight.
Each day we awaken to face the reality that our son was burned to death. He and nearly three
thousand other victims are lost because our government agencies of protection (e.g. the CIA, FBI,
FAA,
etc.) dropped the ball following the 1993 Trade Center bombings.
In the name of humanity we ask that you revoke the arbitrary limits you have set on economic and
non-
economic loss.
We believe these limits are discriminatory and anything less than full compensation for the
families of
all victims is a betrayal of our trust in our government to assume its responsibilities and do the
right
thing.

Victim Compensation Concern
To Whom it May Concern:
As the of the I have been working with the 22 families in our area who were directly impacted by the World Trade Center attack.
It is misleading of the government to continue to say that the average family will receive $1.6 million dollars when in fact most of the families in our area will receive nothing! Once again, our government is awarding people who are not responsible. Those families that did not live above their means, who took out life insurance policies, who were older and had pensions and annuities will lose considerable, if not all, of the amounts awarded. For many of these individuals even deciding to sue the government is not an option.
The government is proposing to do what many nonprofit funding agencies do and that is "deficit funding". We take care of those, who on the surface, can not take care of themselves, but in reality did not attempt to save and look at the future. The individuals who have lived well beyond their means;who had no life insurance; and lived a wonderful lifestyle will be given the most, and the responsible ones will be penalized.
This is very much like the families who save for their children's college tuition and then are told they have too much money to qualify for any types of grants or financial aid. The families that took the extravagant vacations and have multiple cars, and big houses can't afford school and then get assistance!
The government, whether right or wrong, made an offer to these families. If they are having second thoughts at this offer and attempting to lower the amount awarded, then this is not the way to do it. Hurting responsible and most often older women is what is going to happen. When an accident happens, and a settlement award is offered, then there should be no stipulations on who should receive that award. Your criteria is wrong. This needs to be modified.
If you need statistics on what percentage of individuals would be hurt and how many would be actually helped I would suggest you contact the local United Ways who are directly involved with these families. We have the information you need, but as with most instances, we are the last to be asked.

Please Protect American Ideals

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist      , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
     accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Dear Mr. Zwick:
We represent , decedent's surviving spouse and Executrix of his estate.
I have reviewed the "Air Transportation Safety and System Stabilization Act," which authorizes compensation to any personal representative of a deceased individual who was killed as a result of the terrorist attack on the World Trade Center on September 11, 2001. Pursuant to Section 104.47 of this Act, "the amount of compensation shall be reduced by all collateral source compensation, including life insurance, pension funds, death benefit programs, and payments by federal, state, or local governments related to the terrorist-related aircraft crashes of September 11, 2001."
In the case at issue, decedent created an irrevocable trust which owned certain life insurance policies. The proceeds of the life insurance policies ere subsequently paid to the trust, which incorporates a marital trust and a minor's trust.
In both trusts, decedent's surviving spouse is the income beneficiary and the decedent's children are the remaindered. The language of the statute is unclear as to whether or not the surviving spouse's income stream from the trust will be taken into consideration, thereby reducing the compensation she is otherwise eligible to receive under the Act.
Nor is it clear, whether the remainder interests of the decedent's dependent infant children in the two trusts described would reduce their benefits, if they were the "claimants."
Furthermore, pursuant to the Interim Final Rule, ยง104.21 (d), submission of a claim itself
constitutes a waiver of right to sue. Is a preliminary inquiry to determine compensation, if any, possible without waiver of a right to sue?
Finally, has there been any amplification as to what constitutes "pension funds" or "death benefit programs"?
I made a prior inquiry under the interim rules and received no answer. May I prevail upon you to provide me with an answer this time. It would seem, that the very purpose of the Fund is to prevent litigation and limit liability. Weighing one's options should be something the families of the victims of this tragedy should be entitled to.
