I have been following the Victim's Compensation Fund issue for that reason. I offer the following comments: The Interim Rule/Regulation describes the following intent of Air Transportation Safety and System Stabilization Act: The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001 {Interim Rule/Regulation, Summary Paragraph A.1.}. The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims. {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congresss goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harms way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are theoretically victims of negligent airline and airport security. The September 11 Victims Compensation Fund is supposed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. Awards for non-economic loss values under the Victim Compensation Fund should probably fall somewhere between the current proposal and a litigation result award. The Interim Final Rule reduces any compensation awards by the amount of funds received from collateral sources, including life insurance. The Interim Final Rule presumably does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, including my state of Virginia, the law on the collateral source rule has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and airports and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines or airports and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. Finally, the Interim Final Rule improperly lumps together economic loss with non-economic loss prior to collateral source offsets. While allowing for collateral source offsets is against the collateral source rule, it might be justifiable if the offsets were taken only against economic loss awards. In theory, since things like social security, workers compensation, salary continuation benefits and life insurance are designed to replace lost income, such an offset would prevent a double recovery of economic loss. Non-economic loss, on the other hand, includes loss of consortium, loss of companionship and other intangible emotional losses due to the sudden and untimely death of a loved one. Social security, workers compensation, salary continuation benefits and life insurance are not designed to compensate for such loss. Deducting economic-based collateral source funds from emotionally-based non-economic loss damages is improper and should be changed. Families should not be left empty handed merely because they planned for their economic future. At a minimum, each family should receive the non-economic award without collateral source deductions. Tuesday, November 06, 2001 1:42 PM A question not a comment and a request for help! Two friends, a husband and wife, were severely burned (both with third degree burns) at WTC 1 on 9/11/01. They are out of the hospital now and at home but go back to the hospital a few days each week for treatment and are now undergoing physical therapy. Are there any funds available for victims who were severely injured? They seem to be hitting brick walls every time they ask for help from various charities, including the Red Cross. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, March 12, 2002 1:20 AM 9/11 Fund is discriminating against Gays Sir or Madam: This story has been passed along to me, and I must emphatically add my name to the list of people who think it an outrage that gays are being excluded from benefits of the 9/11 fund. It is really counter to what we claim our stand to be as a country in this war, and is not justified by Mr.Feinberg's facile evasion and downright hiding behind state law. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, December 18, 2001 9:36 AM Protect Traditional Marriage Mr. Kenneth Zwick Office of Management Programs Department of Justice Washington, DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Monday, January 21, 2002 1:52 PM Victims compensation fund Kenneth Zwick Department of Justice I would like to express my disagreement with the rules issued by Kenneth Feinberg, the Special Master, for the Victims Compensation Fund of 2001, P.L. 107-42. Mr. Feinberg is not satisfying the intent of this legislation. Asking victims families to sign documents that sign away future rights for an unknown settlement is ludicrous. Deducting insurance, 401K and other assets from this unknown settlement is an insult to the victims that acted responsibly to provide for their families. Wednesday, February 06, 2002 12:04 PM Hypocrisy on the highest level Although I grieve with those who lost loved ones on September 11th I am appalled that the U.S. government has decided to pay reperations to the victims. How dare the United States pay money to the victims of the WTC attacks when they refuse to even consider reperations to the descendents of slavery. Without question the horrors that were committed in this country and by this country under the name of slavery was far worse than those that occured on September 11th. It should also be noted that the crimes of September 11th were committed by individuals who were not citizens of this country while the crime of slavery was not only committed by U.S. citizens but encouraged and protected by the United States Government. The effects of the attacks of September 11th will live with those families for years to come but the effects of slavery, black codes and Jim Crow will continue to divide this country forever. In closing by paying money the the families of the WTC vicitms while refusing to acknowledge the horrific acts and effects of slavery is another blatant example of the racism and contempt for African Americans that the United States Government continues to foster. You encouraged individuals to contact you about our concerns. I do not need to reiterate the obvious complaints that have previously been voiced regarding the Victims' Compensation Fund. I do however feel it is necessary to let you know that I am most uneasy about the fact that it seems the federal government is forcing you to keep within the parameters of a program that ha s already been established. It seems the guidelines for the fund have been in place nationally for more "common" disasters, if there is such a thing as a common disaster, and I do not think that you will find anyone who would disagree that this unique tragedy calls for "new" unique guidelines. This is especially crucial considering our country's financial center was intentionally targeted by terrorists. Further, I respect the fact that the government is acting in order to save the airlines and ultimately head our country in a positive direction but at the same time you have presented this program as a competitive type of challenge. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions.
