To Whom It May Concern:
a) We believe there should be no age cap on the earnings potential of
the victims of this terrible tragedy. Why should they have a cap if the rest
of us are looking at retirement now starting at age 70.
b) There should be no deductions for any charity received by the
victim's dependants. They are ENTITLED to their share REGARDLESS of any
gifts they may have received.
c) Life insurance was PAID for by the Victim and should not have any
bearing on what the family has a right to.
d) The right to appeal should not be denied to those who are suffering
due to the tragic losses inflicted on them by this horrific event.

To Whom It May Concern,
Recently I have read an article regarding the Sept, 11th funds being
distributed to illegal aliens and the unborn child of those whose family
members died in the attacks. That would sit well with me if it were not for
the blatant discrimination against gays in the same matter. Why is it the law
can be brushed aside when it comes to everyone but gays? Did we all not lose
in these attacks? Chaplain Father   who died in the line of duty
when the first tower fell, or   who was copilot of the plane
that crashed into the Pentagon and   who helped bring down the
flight in Pennsylvania, were all gay. Are they less than those who are here
illegally? Is their deed not that of a hero? Don't go down in history as
being a bunch of bigots too afraid to be human in a time when we all
supposedly stand united. The next time something tragic happens and it's a
sad fact in this day and age that it will, the person that saves your life
may very well be the one you've discriminate against. Not to sound cliche,
but remember "All for one and one for all." Make things right, show the world
that America truly stands United.

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?
Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Regarding Sept 11 Victim Compensation Fund
Dear Sir,
I am a British citizen writing to you in connection with the compensation fund set up to aid the families of those who tragically lost their lives in the terrorist attacks of September 11th. I understand that the guidelines regarding exactly who is eligible for compensation will be declared this Friday, and bearing in mind that a significant number of the bereaved are gay and lesbian partners of the victims, or otherwise unmarried partners, I would like to know whether they will benefit from the fund. The reason for my asking is because I am aware that many gay and lesbian people have applied for relief at the local level, but have not always been successful in obtaining equal treatment with married couples. New York state has already granted compensation benefits to anyone "showing....mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." I urge that this principle be respected with the Victim Compensation Fund, and that when allocating benefit to the families of the deceased, the term 'family' will be broad enough to include, for example, gay and lesbian partners, unmarried couples, and adopted family members. I believe that to do otherwise would amount to an act of arbitrary discrimination against the groups I have mentioned; regardless of the actual marital status or sexual orientation of those involved, the bereavement and the hardship this often brings is the same for each and all, and permitting them equal acccess to the fund is an essential way of maintaining their dignity in this very difficult time.

Benefits should be extended to same sex spouses.
Ladies and Gentlemen of the Justice Department,
The 9/11 fund was set up with the express purpose of honoring the memory of
those who died in the tragedy which befell our nation in September. However,
the position of the DOJ is that same sex partners will not recieve benefits
from this fund unless states recognize them.
As you are well aware, states are just now starting to realize that same sex
partners are worthy of the same respect as heterosexual partners. Since the
government has denied the right to marry to same sex couples, they are unable
to automatically receive many of the benefits heterosexual couples are able
to take for granted.
When Thomas Jefferson wrote the words "all men are created equal" he meant
everyone. Including homosexuals.
I urge you to adopt a policy of tolerance towards ALL people who lost family
members on September 11, 2001.

This relates to the September 11 Victims Compensation Fund (the "Fund") established
upon the enactment of the Air Transportation Safety and System Stabilization Act (Public Law
107-42), and the regulations to be promulgated to govern the administration of the Fund.
The New York State Bar Association considers it very important that the Department of
Justice obtain as much input as possible on the development of substantive and procedural rules
to govern the administration of the Fund. The extraordinary circumstances surrounding the
creation and administration of the Fund nevertheless do not lend themselves easily to
conventional comment letters. Therefore, I am writing to offer the assistance of The Association
and its members to work directly with the Department and the Special Master. It is the belief of
many of our members who have expertise in the areas of personal injury litigation and
compensation programs that the best way for us to assist the Department in this enormous task is to provide people with a wide range of relevant experience in order to help resolve issues and problems.
In addition to the fact that the terrorist acts of September 11 have had a direct impact on the New York State Bar Association, it is important for me to point out that the Association is the larest voluntary state bar association in the country, with nearly 70,000 members engaged in every substantive and procedural area of law. Their expertise providers a formidable source of knowledge and information. I hope that there is an appropriate mechanism, such as paticipation in a working group, for us to assist in the development and operation of the Fund.

Victims Compensation
Dear Mr. Zwick:
I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering
the
"September 11 Victim Compensation Fund." I strongly urge the Department
to
draft regulations that ensure compensation is available to all victims
of the
attack, including the committed partners and the non-biological children
of
gay and lesbian victims.
It is unquestionable that the devastating grief and economic losses
suffered
by the families of gay and lesbian victims are no less than that of
other
families. Just as the terrorists drew no lines in choosing their
victims, our
country must draw no lines in compensating those who suffered the most
personal of losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom left
behind
loved ones. I urge the Department to honor these bonds by treating the
families of gay and lesbian victims as you would any other.

Deductions
It seems to me that by deducting all life insurance, you are penalizing
people whose spouses were responsible by having life insurance. The families
whose spouses did not end up rewarded, and that should not be the case. It
may not end up being fair or equitable, but the penalization is definitely
not fair.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

They are all heroes
To Whom It May Concern:
I find it unacceptable that the partners of gay and lesbian American heroes who died on September 11th will not be receiving the same financial benefits that are freely given to heterosexual victims. Perhaps if the restrictive laws of the United States allowed gays and lesbians to be married we would not have this issue. Until then, GLBT Americans are doing the best they can to live in loving partnerships, raise children, go to work and pay taxes---just like the majority of Americans. I thought discrimination was unlawful in America, but apparently not.

Compensation for gay and lesbian partners
I have just read with dismay the comments made by Mr. Kenneth Feinberg of the September 11 Fund denying compensation to gay and lesbian partners of victims of September 11. I urge Mr. Feinberg to reconsider and, in fact, to make history by reversing the pattern of discrimination against gay and lesbian partners. Because individual states discriminate is no reason for the September 11 Fund to follow suit; supporting bad policy is not okay. If anything the Fund should take this opportunity to let the American people know about its gay heros. To know that , a gay man, helped to bring down United Flight 93 and to spare our capitol a devasting attack is to know that the American people owe him our gratitude. That gratitude should be expressed in a policy of fairness in compensation. Please honor memory with a policy of inclusion that takes all victims partners, gay or straight, into account.

Justice for all

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

No Discrimination in Relief!

Dear Attorney General Ashcroft,
The deaths on September 11th were the result of an attack on America.
Please do not discriminate against the unmarried partners of September 11th
victims. All unmarried partners, gay or straight, young and old and their
dependents should be eligible for compensation.
I am sure that it cannot be disputed that gay people participated in large ways to this tragedy. I personally know one of the of the plane that hit the Pentagon, and live very close to , undeniably a hero. I know their partners feel the pain of the loss acutely. Lets not make them pay twice by rejecting the acknowledgment of their loss after suffering the actual loss.

Victim Compensation Fund
Kennth Feinberg has made clear that the spouses and partners of gay-Americans killed in the September 11th attack will not necessarily receive the same benefits as the spouses of heterosexual victims. Even fetuses and illegal aliens will be receiving benefits under the program. How can this administration stoop to such discrimination and bigotry as to overlook federal law for both illeal aliens and their employers yet require strict adherence to any state law when it comes to gay heroes and Americans? In other worlds, when it serves the administration well to discriminate. I am outraged and disgusted that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Are gay-Americans now less American?

Reasonable compensation
Sirs,
As a taxpaying citizen, I am deeply concerned regarding the amount of my tax
money being transferred to the families of the 9/11 victims, particularly
since their deaths were not the fault of the U.S. government.
Pay them a moderate death benefit? Okay. But make them millionaires?
Completely out of line.
One last question. Are the families of the CIA operative killed in
Afghanistan and the families of the military KIA's receiving the same amount
of money? If not, why?

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

very important issues.

The Fund is Unfair!
I am writing to formally protest the exclusion of Gay and Lesbians from
compensation.
Let's not forget people like      and so many others
whose names we do not know were gay and who were heroes. Senator McCain
even gave the Eulogy at     memorial and talked about his
contribution to saving the lives of so many other people.
If fetuses, illegal aliens and others can be compensated without
discrimination (even when being here in blatent violation of US Federal
law), then members of the Gay and Lesbian community, Americans all, should
not be excluded.
I was shocked when the Governor of Puerto Rico raised money "For Puerto
Rican Families" and tried to get Governor Pataki to use the money raised
here on the island for families of Puerto Rican descent only. Thank God,
Governor Pataki rejected her request and put the money into a fund that
included all. Now, it is time for the federal government to also reject
discrimination and include ALL American citizens, as well as the unborn and
those illegally here (and those who employed them illegally) in equality and
equity.
