As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My son's school (PS 89), my work (WFC 2), and our home were all in Battery Park City. We all survived the attack, but our lives will never be the same because of this event which will haunt us forever. I want the Victim's Compensation Fund to realize and prepare for the fact that damages suffered might not readily be apparent so soon after the attack. We have suffered from many short-term inconveniences that I will not list. I am more concerned about the long-term physical and psychological problems we face. My two sons spent the night of September 11th in the lobby of a downtown hotel. I am extremely worried about the exposure they got to harmful substances in the air. They got additional exposure when the mayor of New York city had us move back home on 09/23/01, a date many now consider to have been to early. As a parent, I will have to worry about this each day of my life. It is too early to tell how my children will remember this event. I would like you to consider that they are among the very few children to have witnessed this disaster and that their childhood memories will be of a place that was destroyed in a highly publicized way. My son and his classmates were evacuated from elementary school as the buildings with parents in them fell behind them. I did not find my son until 4pm that afternoon. No one knows the ramifications of living with this reality, and I want to make sure that the kids of PS 89 are remembered and given some consideration. Because we fled the area after learning about air quality issues, my son is in his second first grade class this year. His is with his brother and mother in California while I stay in a motel in New Jersey close to a temporary work building. When I locate a new home, he will have to change classes yet again. As I suspect that many of the claimants do not have experience handling large sums of money, the Fund should help prepare them to make the important financial and legal decisions that will come with the awards. Many of the bond brokers, investment managers, and insurance executives killed at the World Trade Center earned large salaries and six- or seven-figure annual bonuses. And although the deceased may have controlled the family finances, his or her spouse will usually have some familiarity with investing and estate planning, as well as relationships with financial advisors, accountants, and/or lawyers. While a certain number of these affluent families may still be taken advantage of or commit their own financial mistakes, most will incorporate the Fund's award into their pre-existing investment accounts and estate plan. Many more claimants, however, have never handled sums close to even the minimum award. While still mourning their spouses and comforting their children the claimants of firemen, secretaries, clerks, and dishwashers will have to decide what to do with at least $300,000 or $500,000 from all sources (I assume that at least some of the payments will be in a lump sum). The current volatility in financial markets, partly a result of the events of September 11, makes this job even more difficult. Many, especially those with young children, will also need legal advice on trusts and estate planning. Without good financial and legal help, it is unfortunate but inevitable that in these circumstances many of these claimants will make decisions that will harm their families' financial future. More than a few will fall prey to outright fraud. Many more will dissipate funds through speculation directed by themselves, a well-meaning relative, or a commission-seeking broker. Others may invest too much in a risky family business. Some may flee from risk altogether, keeping their funds in bank deposits that offer safety of principal but also inadequate returns for their families' long-term needs. Most of those who avoid these pitfalls will still pay traditional brokers and actively managed mutual funds far too much in fees while their investments do less well than market indexes. I do not mean to be condescending with these predictions, only realistic, for both academic research and the business section of the newspaper provide ample evidence that even those considered sophisticated investors rarely beat market indexes and sometimes are taken advantage of by even the most respected securities firms. To improve the odds of better outcomes for the Fund's beneficiaries I suggest that you organize two educational seminars, one on investments and one on estate planning. Though the less affluent claimants would need them more, they should be made available to all. Introductory pamphlets could be distributed before the seminars and materials for further study handed out afterward. While there are many people who could conduct a good investment seminar, I will suggest some candidates: , founder and former chairman of the Vanguard Mutual Fund Group (the most honest and lowest-cost mutual fund company; its web site offers excellent free educational materials). , Professor at the University of Pennsylvania's Wharton School and author of books on investing. , author of a personal finance column in the Wall Street Journal. While I do not know any of them, I think they all would be happy to help the Fund, whether by talking to the beneficiaries themselves or by recommending good substitutes. Alternatively, you could contact the finance department of a few leading business schools for suggestions. Any competent trusts and estates department of a law firm could prepare the legal seminar, perhaps using Nolo press's excellent self-help materials as an introduction. Two meetings are not going to make the beneficiaries financial or legal experts, but they could familiarize them with the essential concepts of investments and estate planning-the relationships between investment risk and return and real and nominal returns, the benefits of diversification, and estate-tax exemptions, to name a few. Without some exposure to these ideas, they will be more vulnerable to unscrupulous or incompetent "experts" and less able to benefit from the advice of honest professionals. The beneficiaries will also need individualized advice. While the federal government probably cannot recommend specific securities firms or law firms it might solicit investment and estate-planning proposals for several hypothetical beneficiaries-say three levels of affluence, with or without minor children. The responses, except those from firms with poor regulatory records, could be combined in a booklet and distributed to beneficiaries. Many of these financial and legal firms would be willing to provide free planning services to the victims' families. Even with these precautions, some of the claimants' will lack the education or maturity to husband their awards. Perhaps for these beneficiaries the Fund could offer a variable annuity as an alternative to a lump sum payment. The Fund could solicit proposals from insurers with high credit ratings and present the results to the beneficiaries. Again, it seems likely that the insurers would offer their most-favorable terms to the Funds' beneficiaries. If Feinberg or the DOJ do not recognize that the deceased was part of a domestic partnership, then his monetary "value" is significantly reduced. Under Feinberg's "rules", a gay man will be considered single regardless of whether he was in a long term relationship or not. According to the compensation tables for the fund, The dollar amount awarded to the victims beneficiaries is less when single than when married. The reason given for this is because virtually all of a single person's income is used on himself (personal spending), whereas most of a married person's income is used to support his spouse. This "personal" spending is deducted from his income and only what's left is considered lost income. As an example, for an income of $10,000 a single man's personal income is $7600, while a married man's is $3000 (This ratio get worse as the income increases). Therfore the yearly value of lost wages is $2400 for a single man, and $7000 for a married man. So even if an individual state recognizes a domestic partner, the amount of compensation he receives is significantly reduced. My understanding of this congressional Act was to provide releif for ALL victims and their families. Congress made no restrictions on how Feinberg was to choose eligble victims and representatives, and to determine the compensation. Mr Fienberg has the power to make any assignments he wants. The goal of the Act is to help dependants of those lost on 9/11 survive financially, not to be a windfall for some distant relative. Mr Fienberg is treating this money as if it is part of the deceased's estate, and thus applying estate laws for dispusement. Instead he needs to treat this as releif for survivors as congress intended. Why is this amount tied to some arbitrary amount of life insurance that the federal government provides to members of the military and public safety officers? This makes no sense. Take for example the situation of a member of the US military who died in the terrorist attacks on the Pentagon. Under the interim rules his family would be entitled to presumed non-economic damages of $250,000. The statute then requires them to deduct the $250,000 life insurance that he received leaving him with ZERO for non-economic damages. Is this what Congress intended to happen? I dont think so. The Statute passed by Congress and signed by the President defined non-economic losses in twelve categories, including losses for: - physical and emotional pain, - suffering, - inconvenience, - physical impairment, - mental anguish, - disfigurement, - loss of enjoyment of life, - loss of society and companionship, - loss of consortium (other than loss of domestic service), - hedonic damages, - injury to reputation, - and all other non-pecuniary losses of any kind or nature. The rules dont even make an attempt to comply with the very plain language of the statute. The other thing that is very unfair about this process is that the Department of Justice publicly stated that the estimated recovery of each victim would be $1.6 million. That amount is grossly overstated as it doesnt consider the deductions for life insurance, social security, workers compensation, pension plans, etc. When the Department of Justice issues the revised rules it would be much more accurate an useful to the public to give an estimate of the net amount that is likely to be received by each victim after all of these deductions. I think that you may be surprised at how much the average victim will be required to deduct from the gross amount. Perhaps the Justice Department could contact the employers who had employees murdered on September 11 and see how much group life insurance was in place. Generally group life insurance provided by an employer pays double when an employee dies while at work. A reasonable assumption can be made for how much life insurance a person would generally purchases on his own and how much social security, workers compensation, pension, and other collateral payments most be deducted. Im confident that you would find that the average victim would retain only a small fraction of the gross award. The victims of September 11 did not ask for this law. It was forced upon them. In addition to providing compensation, that appears now to be illusory, it limits the liability of airlines to the amount of its insurance policies. In most airplane crashes, that insurance policy is in place to cover the claims of the passengers on the plane, perhaps a couple hundred people. In this case there are 3,000 victims who died and probably at least that many who suffered injuries. The amount of insurance in place would not come close to providing an adequate remedy to the victims. Yet, the federal government absolved the airlines of any further liability for their negligence. To limit the amount of the payments to victims in an arbitrary way while making sure they cannot recover sufficient damages from the airlines is unconscionable. It appears that the Department of Justice is determined to make the victim groups file suit over the fact that the regulations totally ignore the plain language of the statute. Why make these victims and the rest of America go through this? Please revise the regulations so that they follow the plain language and intent of the statute. Friday, January 18, 2002 5:35 PM Comments The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid incomparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable work life and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims.
