Wednesday, November 07, 2001 10:34 PM the forgotten victims My understanding is that victims of the September 11th tragedy are defined as families of those who perished as well as individuals who are now unemployed and/or businesses that sustained prolonged closures) as a result of the attacks. However, there is a population of individuals and families who I believe do not qualify under the accepted definition of victims... but these are people whose lives have been turned upside down since September 11th. These "victims" live or lived in the immediate vicinity of Ground Zero, they are the residents of Battery Park City -I speak from personal experience. Our apartment was three blocks from "the site" of the collapsed World Trade Center- 400 Chambers Street. While our apartment did not sustain any damage, the building was contaminated with dust and debris which had to be removed by a company specializing in handling Hazardous Materials. I guess we were lucky [If you consider seeing what we saw, lucky] from our dining room window we watched people jumping and the tower collapsing and quickly closed the windows before evacuating with our daughter and pug. Many of my neighbors found that their apartments were covered with debris because they left their windows open. Everyone in the neighborhood was prohibited from occupying their apartments for a period of time, FBI and police designated the area a crime scene. Emergency and rescue workers commandeered buildings and streets and my daughter's school was turned into "The Command Center" which included a temporary morgue. For many weeks, the area belonged to the authorities. In the past two months or so, many buildings have been preparing for residents to occupy, but many in the neighborhood cannot return or refuse to return because of the air (toxins emanating from the still-burning fires) causes respiratory distress, nosebleeds, asthma, headaches, and the other health risks associated with this unprecedented event. While we have been assured by the EPA that the air poses no long-term health risks, the Daily News and other respected Newspapers and Engineers have disagreed. Residents, businessmen and women are suffering from symptoms that make the area a health nightmare. My particular building has been re-opened, Transportation is significantly reduced (and will be for many years). Services are greatly diminished [many stores have permanently abandoned the area because they of the lack of consumers in the area] Air quality is compromised [we've been told that our children should not exert themselves when playing outdoors.]. The area is uninhabitable, after a long hard look at the situation my family was forced to move uptown 3 miles. There are serious financial considerations for downtown residents, and businesses but the emotional toll is hard to quantify. My family has been so traumatized by the September 11th events and our relocation that it has affected my family business. We were out of work 18 days yet we had to continue to pay ourselves even though we were not producing any income. Running a small business in New York is extremely tough right now. We had reduced our operating expense significantly pre September 11, 2001 but now we are finding that our clients budgets have been cut and projects that we had been expecting are now put on hold with no future commencement dates. We have applied for an SBA loan and were accepted but it is pending one of the partners putting up their home as collateral. We have renters insurance and while my insurance company covered our living expenses and temporary housing for a few weeks they are not covering the expenses associated with the relocation of our home. We have incurred significant out-of-pocket expenses, $14,663.05, Moving, storage, loosing our security deposit, brokers fees and an increase in rent. Safe Horizons was the only agency that provided immediate financial relief [$1500.00] but our particular situation did not fit the qualifications from other Federal or state agencies like FEMA, the American Red Cross, Crime Victims Board and the Salvation Army. I find this absurd, with all of the money that has been donated to the victims of this tragedy why do the people who have been directly affected by this have to beg for financial assistance? Why does the American Red Cross give to some and not others? Like us, many have chosen to move to other parts of the City, some have left the city altogether, Others have chosen to stay and rebuild. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Zwick, Director Office of Management Programs, Civil Division U.S. Department of Justice Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 December 15, 2001 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Saturday, March 23, 2002 5:17 AM Dear Sir or Madam: Is it your intention to pay tax dollars to victims of all catastrophies? If so, where do you expect to get all the money from? The tax payer is expected to pay for everyone's evil deeds. If a bureaucrat or even a voted in politician does something wrong. We pay. (banks, etc.). If a foreign country or foreign people attack us; we pay for rebuilding, fixing, the evil act as well as everything and anything else. Hmm....do you see a problem with this;? If we want to stop this evil on any level, make the person (whomever) it be responsible and liable to suit. Our laws have been turned upside down and frankly, as a taxpayer I don't see why I am responsible. Or for that matter, any other law-abiding taxpayer. You know, it is a sad, no, a horrible loss for all those who lost loved ones on September 11 but you know any catastrophy is a horrible loss. In no way, is the airline or this country to blame and therefore, tax dollars have no place here. Wednesday, November 07, 2001 5:06 PM victim's fund We faced east directly across from the WTC. Our windows were blown in and our apartment was completely trashed. All of our furniture and appliances are destroyed. Our apt was deemed a crime scene and was padlocked. We aren't allowed a key and could only enter under supervision. How are we not victims. Is it because there is no photo op for politicians when they help the middle class. It's not a sexy news story. Just ordinary tax paying people who need help. Tuesday, March 12, 2002 10:52 AM victim compensation discrimination against homosexual partners Dear Mr. Feinberg: I am simply appalled by the decision of the 9/11 fund not to provide compensation to gay and lesbian partners. The gays and lesbians on the planes and in the buildings are no less dead than the heterosexuals. The suffering of their partners is no less real than the suffering of heterosexual partners. Sen. John McCain praised as a hero in his eulogy. Are we to assume that because he is gay is less of a hero than the others who rushed the cockpit? Although you may blame state laws for the discrimination, we all know that the truth is simpler -- hatred. The 9/11 fund has even chosen to disregard national laws and grant financial compensation to illegal immigrants. Certainly illegal aliens are equally deserving of financial compensation, but if you are willing to set aside national laws, why not offer compensation to gays and lesbians regardless of state laws. I'm disgusted by this decision on the part of the 9/11 fund.
