Tuesday, January 15, 2002 4:57 PM Interim Regulations Overall, I think the published Interim Regulations for the September 11th Victim Compensation Fund of 2001 establish a fair and efficient process for expediting reasonable compensation to most of the individuals and families harmed by this tragedy. I do see, however, one substantial defect in the regulations, which may well serve to undermine one of the statutory purposes: litigation avoidance. I comment upon that defect below. It appears from the interim regulations, and the accompanying loss tables, that compensation awards for "economic loss" are being capped at the level of the 98th percentile of income earners ($231,000). Placing such an artificial cap on the potential fund awards for this type of demonstrable loss leaves a huge gap in the fairness of this regulatory system. That gap, stated plainly, is wholly inadequate compensation for the families of the highest wage earners: for example, a bond trader at Cantor Fitzgerald who might have been earning an annual salary of $1 million. Why should fund compensation for the economic loss experienced by that bond trader's family be capped through reference to a $231,000 salary, rather than the trader's actual salary of $1 million? How can it possibly be fair for that bond trader's family to receive the same economic loss compensation from the fund as the family of another victim who might have been earning exactly $231,000 annually? Ironically, this irrational shortfall in economic loss compensation for all victims who were earning above $231,000 on 9/11 will potentially alienate the very individuals likely to have the contacts, resources and motivation to pursue the type of plaintiff's litigation against the airline industry that the fund seeks to avoid. Higher wage-earning victims, of course, will also lead to higher damages claims - and, ultimately, higher potential awards - against the airlines as well. Thus, the artificial cap on economic loss recoveries from the fund for the highest earning victims may well serve to drive the families of those victims to the very litigation that the fund seeks to abrogate in the first instance. Fortunately, there is a simple solution to this defect in the Interim Regulations: just remove the 98th percentile/$231,000 cap used under the fund's formulas to calculate economic loss in these upper end circumstances, and allow those same formulas to use each victim's actual earnings to calculate true - not deemed - economic loss. The formula for distribution leaves too many individuals with little or no compensation. My neighbor, a young widow with two grade school children, will receive nothing for the loss of her husband. I don't think that was the intended spirit of this legistation. The money should be distributed in a more equitable manner without regard to income from collateral sources. The victims' families have suffered enough. Please spare them the ordeal of litigation. Previous yearly earnings were lower because she had not acquired the licenses necessary to make trades on her own. In 2000 and 2001 she had passed several examinations and received a number of licenses. In 2001 by the month of September she was on target to achieve 125,000 dollars in earnings by the end of the year. Her learning potential in future years would have far exceeded the rate of increases shown in the interim rule. Also the proposed method of averaging earnings in the period of 1998-1999-2000 to obtain the base and then to apply the yearly raise formula severely under estimates her future compensation. She is penalized all the way around because of making lower salaries in 1998 and 1999 in a lower skilled job ,then her future compensation is calculated on this low averaged base which in her case would be about 75,000 dollars. Based on the tables she would receive 600,00-900,00 dollars less than what the real value would be if based on an averaged salary of 115,000 dollars which is really her true current wage. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, March 19, 2002 2:50 AM please do not exclude gay & lesbian partners from compensation Hello, I was recently sent an email advising me that though the 9/11 relief fund is set up to aid victims' spouses, unborn fetuses, and illegal aliens, the fund does not offer any aid to gay and lesbian partners of those who dies in the 9/11 atrocity. The rule of government was established by the people and for the people and any decision made by the government should invoke the sentiments of those words in relation to compensating the victims. Keeping that in mind I think it should be considered that the victims of war traditionally are those that have been affected directly, meaning that the act of war has direct impact on their lives. It is obvious to all that the most directly affected are those that lost family and friends and now endure the difficult process of acknowledging that their loved ones have been lost as a deliberate attack on the United States of America. This alone clearly makes an unprecedented distinction between natural disasters and an act of war as President Bush himself had clearly and publicly stated on several occasions following the events of September 11th. Eligibility should be more profoundly evaluated or extended to those families directly impacted by an act of war perpetrated against the United States including all of its citizenry. The obligation of the government is to ensure that the impact of any attack against its citizens be evaluated beyond the most obvious victims of this heinous act. I am specifically referring to those individuals and families within the immediate vicinity and community that have experienced great loss and face the challenges of an uncertain future and can establish the deep impact of the events of September 11th as it pertains to their lives and the lives of their families. Although these families have not experienced the loss of a loved one they have definitely experienced a long lasting loss that most Americans will never see as they watch the events on television. My family and I are one of those many families. On that morning, just as any morning my wife and I who had spent all of our earnings to build a home and a business were looking out the south window facing Park Place, approximately two city blocks from the World Trade Center as the first plane crashed. We watched in horror as the second plane crashed into the south tower. We were in an immediate state of shock. The proximity of the towers posed a real threat to our lives and we are thankful that our son was at school at the time. We watched in agony as we saw many falling to their deaths and realizing that it was not just a building but that we were actually watching people deliberately put to death. This horrific memory will undoubtedly stay with us for the rest of our lives. The images on television could not possibly encompass the horror nor the emotional and psychological impact of any witness who lived in the immediate area of ground zero. Soon after, we were evacuated and as we left our home and work we witnessed the collapse of building seven. My family and I have experienced the full extent of war and have just barely begun to experience symptoms of post traumatic syndrome. We were not able to get back to our residence until October 28th, 2001 and as we re-entered our home we suddenly realized that our home was no longer a home. We think of home as a place of security and an extension of the lives individuals decide to build and create. Our home was an extension of the love of family and friends and that simple value was taken from us forever. On December 15th, just three months after the attack we said goodbye to that home and workplace for the last time. The effort in building a home and business and restarting or as volunteers from American Red Cross stated so eloquently, "This is now... the first day of your lives" is a statement that rings true for us and many families that have begun this arduous journey and the acceptance that our lives and the lives of our loved ones has changed forever. We have exhausted our savings and are at the brink of economic ruin, not to mention the emotional toll it has taken. My wife refused to return to the residence and sleep for both of us is an uneasy and distant memory. Every waking moment of our lives since September 11th has challenged us beyond the superficial physical wounds of war. It has scarred and assaulted our very core essence of being. Every night after being allowed to re-enter our living and work place we were confronted with the destruction of so many lives walking down Church Street towards our home on &nbsp&nbsp&nbsp&nbsp&nbsp. Every night after an exhausting day of filling out forms and proving that we were directly impacted to various charities... I would walk down the street as the work lights lit up the rubble and dust and we are immediately transported to the widespread destruction on the morning of September 11th. We are constantly trying to piece together our lives that have been torn apart by the far reaching destruction in our neighborhood. As we opened our windows facing Park Place the smell of contaminants and smoke filtered through to remind us that we are the silent victims of September 11th. It is hard to imagine the turmoil a family experiences as residents of ground zero. What that entails is that we are starting our lives from zero. Countless numbers of families have moved. Every day we see movers evacuating families who all have one thing in common. WE ARE ALL BOUND TO GROUND ZERO IN AS MUCH AS IT HAS DEEPLY IMPACTED OUR LIVES AND CHANGED US FOREVER. WE ARE THE FAMILIES THAT HAVE PHYSICALLY SURVIVED GROUND ZERO AND MUST NOW START ALL OVER AGAIN. WE ARE NOT COMFORTABLE WITH THE TERM VICTIMS but yet we have been directly assaulted and our experience of war is one that requires compensation. I would argue with anyone that the obligation of the government in response to this act of war is to extend the generosity of the American people to those families of ground zero that live within the immediate area. Our government is in a position to acknowledge the obvious victims that will experience the loss of a loved one for a lifetime but to include those that have lost everything they have built and created and no longer exists as a direct result of the attacks. President Bush often speaks of the compassion of the American people and I believe as an American that compassion should be extended to those within the immediate are of the World Trade Center vicinity. We are also rebuilding our lives which will take years to rebuild and our inclusion in the compensation fund will acknowledge the intended compassion of all Americans who want to help those families directly impacted. Let us not draw a line that separates the direct impact of those that have lost and those that need to rebuild. We are all directly bound to the events of September 11th. For those who have written about feeding the greed and who don't think compensation is a just means by the government to distribute funds are those that can speak from a distance and those that do not have the experience of war in their neighborhood. They speak of legalities and they speak of right or wrong as it pertains to the lives of thousands that live in the vicinity of ground zero... or they visit and leave behind what many families have to confront every day. These are comfort zones that we are not afforded at Ground Zero. It is not a question of greed or government handouts or taking advantage of the American people. We are the American people and we are united in rebuilding our lives and in order to accomplish that we at Ground Zero who have lost our homes and businesses and as Ground Zero slowly becomes a ghost town because it is no longer a viable live or work area the impact of war on our neighborhood is obvious to all. The compensation fund as directed by Congress should encompass this group of individuals and families as a sign of hope for a second beginning for survivors and witnesses of a direct act of war. We are the witnesses, we are survivors, we are the families of ground zero that will remind future generations of Americans of what we saw that day and how it changed us forever. We are bound by our direct experience and not by television. We represent the rebuilding of downtown and the future of New York City. When my son asked me... "Dad, what are we going to do now?" My eyes filled with tears as I told him... "Never forget son... we will never forget our experience". We ask that you include eligibility to those families and individuals within the immediate vicinity of Ground Zero so that we may be allowed to heal our deep wounds and help us rebuild our shattered lives. Dear Sir/ Madam As an Australian who has contributed to this fund in solidarity with the grief and distress experienced by all with regard to the events of September 11th, I am absolutely appalled to read the information passed to me below. It would appear to me to be a barbaric act of discrimination, unforgivable and unjustifiable. I implore that you reconsider this stance and recognise the heroism in equal terms to all beneficiaries of the fund. This creates a very bad impression of the American people and reflects badly on the fund - and this attitude will be taken in to account when future support is asked for by the American people, support that to date has been unconditional. Zwick, Director Office of Management Programs Civil Division U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue Washington, D.C. 20530 Dear Mr. Zwick, I think the idea of the September 11th Victim Compensation Fund of 2001 (Fund) for the victims and victims' families (collectively referred to as "the victims") of the September 11th tragedies is wonderful. While it will clearly provide benefit to our troubled airline industry in terms of minimizing litigation, it also has the potential to provide much needed financial assistance to the victims in what I hope will be a simple and fair process. While monitoring the events over the past six weeks as they pertain to this Fund as well as to some of the charitable funds which were created to assist the victims, I find some of my greatest fears becoming reality -- first the debacle over the Red Cross funds and now the politicization of the Fund. Realizing the impact the Fund will have on the lives of the victims and the emotional nature of why the Fund is necessary, I can not say that I am surprised by this turn of events. While no answer will please everyone, I urge you to consider the following when deciding how distributions from the Fund should be made to the victims: Provide a simple, understandable formula to determine the benefits which will be distributed to each victim. The formula should consist of two basic components: 1) one for the loss of life or serious injury of a person, and 2) for lost income. I think it is essential that both these components be considered and recognized. Our value system demands that we recognize equally the loss of a loved one -- to say one person's life is more valuable to his/her loved ones than another persons' clearly goes against our society's belief system. In recognition of this, each victim should receive a standard amount acknowledging their loss. This component is necessary in order for the Fund's distributions to be accepted by the American public. However, like it or not, the victim's loss of income should not be ignored. While the first component represents the emotional loss, this component represents the economic loss and must be recognized. This portion will be in most cases a larger amount because it needs to reflect the earnings capacity of the victim and take into consideration the victims' ages, average retirement age for their industry/ position, his or her current and future salaries, bonuses, benefits, etc. This component is necessary in order for it to be accepted by the victims, which will ultimately determine whether it will minimize the quantity and size of lawsuits to be filed against the various possible defendents. Do not reduce the amount of any distribution by charitable contributions received. It is my understanding that the distributions being made by the various charities are for short term relief and are being based on need. The purpose of the Fund should be for long-term financial security and losses incurred. The two should not be confused. Nor should it be forgotten that if the victims were to proceed with litigation, awards would not be based on "need," but rather economic damages plus pain and suffering. Do not reduce the amount of any distribution by insurance payments received. Insurance premiums are paid with after tax dollars and are usually based on each individual's salary so that most individuals receive a similar benefit/cost structure. Additionally, life insurance is optional. Those who paid for these policies should not be penalized because they were willing to forgo short-term income in order to protect their loved one's long-term financial future. Do not reduce a survivor's right to appeal through use of an approved or designated mediator. Each claimant should retain the right to abandon the process until such time that a settlement is reached. This right is typical in most litigation. Do not tax the distributions. What is the point of taking taxpayers' money, distributing it to those who have suffered losses and then taxing the awards and returning the money to the treasury? Keep it simple. Keep it one step. Determine and execute swiftly. This is a very trying time, both financially and emotionally. The longer this process takes, the more politicized and complicated the process will become. Do what is fair and what is right . . . and do it quickly. This is a great opportunity to show our nation and the world who we are. Do not let this great idea become marred in red tape and politics. Honor the victims by doing what is right, while also preserving our airline industry. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions.
