I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
I think it is appaling that some people would use these attacks to further
their own agenda of hate and suggest that some victims, including children,
not be compensated.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

In late September, President Bush and Congress did a wonderful thing and
authorized the creation of the "September 11 Victim Compensation Fund" to
provide assistance to the surviving victims of the attacks and the
"relatives" of those who died.
I was recently made aware that the Department of Justice is in the process
of writing the regulations that will govern implementation of the Fund and
has invited public comments to guide this process.
Unfortunately, it seems, there are factions who are mounting a campaign to
request that the surviving partners and children of gay and lesbian
victims be excluded from the benefits of the Fund. I find these views to
be unpatriotic, cruel and reprehensible. How could anyone believe that
the emotional, financial and psychological pain of the September 11th
attacks and the loss of loved ones should be addressed based only on life
style choices? Clearly, such a determination would have to be considered
a blatant exercise in discrimination.
As The Justice Department considers the regulations governing the
"September 11 Victim Compensation Fund" I urge you to ensure that
compensation is available to all surviving families of those killed,
including the committed partners and non-biological children of gay and
lesbian victims.

After reading through the Presumed Economic and Non-Economic Loss Tables, I
have to say I am truly distraught. The rule is unfair in that it penalized
those families whose husbands planned well and had life insurance policies
and rewards those that did not. Whereas I have a husband who earned on
average $500,000 plus per year over the past several years and who purchased
life insurance for the family, I am (1) not being counted at his real salary
(due to the cap) and (2) would find myself based on the calculations in
negative numbers. I don't see the fairness in this when I have two young
children that are 4 and 5 that I will need to care for the next 17 to 18
years before they are out of college and can care for themselves. Our family
is accustomed to one style of living, why should that be compromised because
of a formula that is being used to calculate benefits?
I truly hope that a better calculation is formulated that is FAIR to all
families. Not one that provides benefits to some and NO benefit to others.

On behalf of our client,      , this letter is
being submitted to offer our comments on the proposed regulations
governing the Victim Compensation Fund of 2001.
     was a passenger on American
Airlines flight 77 which crashed into the pentagon on September 11.
At the time of his death,      was 54 years old and was a civilian
employee for the Department of Navy. He was a physicist.
     was a wonderful husband to      and father to their
daughter,      , who is a high school senior, and to his
step-son,      . Their family was very close, and      was so
looking forward to seeing      go off to college next year.
College was something for which      had worked and saved for many
years and he was determined to insure that      could go to any
institution that she might choose. In this endeavor,      had a
college savings plan set up at work so that a certain amount was
deducted from his salary with each paycheck. This was but one way
he prepared to pay for     's college.
     was the family's principle wage-earner, although
    's long time employee of the Prince George's County Maryland
public school system. As such his earnings were critical to the
family's financial well-being. More importantly, however, is the
deep and painful grief that they all fell over the loss of father,
husband, care-giver, companion and friend.
Because      was a federal employee, and was working at
the time of his death, the      family is perhaps, in a better
financial position than other victims of this tragedy. By virtue
of the fact that      was flying on government business, they are
the beneficiaries of a flight insurance policy. In addition, in
lieu of     's death and pension benefits which were earned and
waived,      is now receiving one-half of     's last annual
salary, in monthly installments, as a worker's compensation death
benefit. These benefits will continue for the rest of     's life.
According to the proposed regulations, the Special Master
will consider     's pre-tax earnings for 1998-2000. Presuming
that the Master uses the average of these figures (rather than the
final year's figure which is more accurate for a government
employee),     's annual earnings would be approximately $101,066.
Again assuming that      would work until age 62 (8 more years),
with the presumed increase of 4.2% per year,     's gross future
earnings would be approximately $937,905. This figure must then be
reduced to present day value at the interest rate of 5.13% (a rate
greater than the presumed inflation rate) and a "consumption
factor" which is not specified in the regulations. Even if we
assume this combined reduction at a very conservative gross figure
of 15%, the future earnings of      is approximately $797,219. To
this figure should be added the Non-Economic Loss of $350,000,
which "compensates"      and      , resulting in a combined loss
award of approximately $1,047,219.
Section 104.47 requires the Master to reduce this figure
by the amounts received from defined collateral sources. Assuming
that the worker's compensation payments are included as a
collateral source, then neither      nor      will receive any
payment from the fund. In short, all benefits, including the
compensation for their emotional pain and grief, will be
eliminated.
It is probably an impossible job to create a fair system
of compensation out of these tragic events. Nevertheless, this
legislation was brought about to accomplish two objectives. The
first was to reach out to the families of the victims and try to
fairly compensate them for their losses. The second was to protect
the airline industry from potentially crippling litigation. As you
know, should any victim initiate suit against the airline, none of
the collateral sources contemplated by these regulations would be
deducted from a recovery.
Based upon our rough calculations,      is currently left
with three choices: 1) participate in the fund, waive her rights
against the airline, and receive no payment; 2) undergo the anguish
and uncertainty of a lawsuit against American Airlines which may
take years to resolve; 3) do nothing at all. None of these
choices achieves the stated Congressional purpose " to provide
compensation to any individual who was physically injured or killed
as a result of the terrorist-related aircraft crashes of September
11, 2001."
We respectfully suggest that the regulations be amended
in one or both of the following ways:
1. Define the collateral sources in such a way as to
exclude benefits previously earned by the victim. In     
case, he chose to be a government employee because the
work was important. In so doing, he gave up opportunities to do
important work and to make far more money in the private sector.
By choosing a government job, he, like so many of his peers,
elected to make less money while better insuring family security by
availing himself of the substantial pension and death benefits that
are available. As these benefits are already earned, the current
regulations serve as a form of penalty by deducting them from the
potential recovery. Earned benefits are the equivalent of savings
and should not be used as a deduction from any compensation from
the fund.
2. Deduct the collateral source money from Economic
Loss calculation only. Even if a victim's family is fortunate
enough to have collateral compensation to cover a wage earner's
loss, the pain, grief and emotional suffering is no less. The
amount dedicated for Non-Economic Loss should not be reduced by any
payment, thereby providing a guaranteed amount for all victims as
well as fair consideration for waiving their legal rights against
the airlines.

find a way to reform the regulations so that they may provide real
comfort to all victims.

info. I have received on lack of payments of donations to gay victims
I have received certain information that would lead me to believe that
compensation to the victims of 9/11 will exclude members of the gay and
lesbian community. As a heterosexual in this global community of ours it is
my opinion that any committed relationship of (as in the heterosexual
community per government and accepted practices) over 7 years is a common law
husband or wife. I believe the same should apply to all victims in this
case.
Didn't the aftermath of this tragedy teach us that above all else, we are
truly ONE? NO DISCRIMINATION!!!!!! A gay man or woman may have saved
countless lives, died selflessly or been an equal victim of circumstance -
they are no less valuable, their lives no less valid than some heterosexual
or immigrant without a green card. \n

To Whom It May Concern,
We represent over 100 families on Staten Island that have lost someone in t World Trade Center Disaster. In an attempt to determine what the estimated proceeds of the plan would be for particular people we have asked for a Worksheet to help calculate the numbers. We have been informed that no such worksheet exists. Attempts to leave messages have been unsuccessful since the voice mailbox is always full. I cannot believe that you are expecting these people to make a decision when they cannot even determine the entitlement. I have expressed this concern to both Congressman Fossella's office as well as the Attorney General. I would look to see this work sheet provided prior to next weeks meeting.

Equal Access to Relief

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Sept. 11 victim compensation
Dear People:
I urge the Department of Justice to institute guidelines for the
compensation of September 11 victims that will provide for equal
treatment of same-sex domestic partners and legally married partners.
Same-sex domestic partners in committed relationships should not be
penalized once again because our legal system does not allow them to
be married. This opinion is shared by a majority of Americans, who
wish to see the families of all victims of this tragedy given equal
opportunity for the support they need.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

VICTIMS' COMPENSATION FUND
I have heard that gay and lesbian partners of victims of 9/11 will not be
compensated as partners and children of other victims will be. If this is true
it is outrageous. Being American encompasses everyone in this country not a
select few. 9/11 affected everyone and as such all those directly affected
thru the loss of a loved one should qualify for compensation from this fund.

Victim compensation
US Dept of Justice,
I don't believe that taxpayer money should be used to compensation the families of the events of 11 September. If these families are compensated what about a family that lost a family member killed by a drunken driver on County Road K in Pierce County Wisconsin on 11 September? Family tragedy is family tragedy why would some families be compensated with tax payer money and others would not? Is being killed by a Religious nut from the Middle East different then being killed in a hundred other ways? I many cases the families will be well taken care of by personnel/employer insurance. The hype of this tragic event should not be a reason to spend tax dollars on compassion that is not offered to other families suffering the lose of their loved ones.
