Although no amount of compensation can replace a lost loved one, we believe the final rules governing the Fund will be critical to fulfilling the intent of Congress to fairly and promptly compensate the September 11th victims and their families. Generally, the Interim Final Regulations follow this Congressional intent. There are three areas of the interim final however, that we believe should be improved to fairly consider the individual circumstances of each victim to determine just compensation - the compensation for non- economic losses, the calculation of economic losses, and the standards for hearings. Specifically, we are concerned that the Interim Final Regulations may impose an arbitrary dollar limit on non-economic damages by inappropriately basing such damages on other federal programs that limit payments to $250,000. The Fund's statute regarding non-economic damages is quite clear. It defines the following elements as compensable non-economic losses under the Fund: [L]osses for physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium (other than loss of domestic service), hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. The types of losses enumerated in this provision were chosen deliberately. Congress intended that each be fairly considered and that victims and their families be compensated for all elements that are applicable to them. Concerning economic damages, we urge the Department of Justice to ensure that the calculations of the presumed awards are based on accurate data for relevant populations. Any estimates of likely lost income used by the Department should replicate, as closely as possible, the likely career earnings tracks of the victims. Moreover, individuals and families should be given an opportunity to demonstrate that the Department's estimates do not accurately portray the likely earnings path of the victim on whose behalf they are filing a claim. If this demonstration is made, the economic damages should be adjusted accordingly. Finally, the Fund's hearings should include a meaningful opportunity to demonstrate that the presumed award does not adequately compensate the victims and families for the damages they have suffered. If this showing is made, the award should be adjusted to provide the appropriate compensation. The Interim Final Regulations call for modification of the presumed award only in "extraordinary circumstances." This exceedingly high burden of proof appears to unduly limit the ability of claimants to obtain appropriate adjustments. In addition, the Interim Final Regulations limit the duration of hearings to generally not more than two hours. We believe that a meaningful opportunity for a claimant to present information or evidence necessary to a full understanding of the claim should not include proof of "extraordinary circumstances" to receive fair compensation, and should not generally limit a hearing to an unreasonably short duration, such as two hours. By amending the final rules to improve these three areas, the Fund can be implemented in a way that meets the intent of Congress to provide fair, fast, and full compensation for the victims and their families that truly reflects the losses they suffered in the horrific events of September 11th and avoids lengthy legal actions. This is the best interests of all concerned, and we trust that you will revise the regulations to ensure that this Congressional intent is carried out. First, family is not always that which is defined by law. &nbsp&nbsp&nbsp&nbsp was born and raised in Scotland; he has no blood relatives in the United States. Since &nbsp&nbsp&nbsp&nbsp and I met he considered New York his home and I, his family. His life was taken before we could make this legal. Secondly, just because &nbsp&nbsp&nbsp&nbsp life was robbed before we were married does not mean we were any less dependent on each other. &nbsp&nbsp&nbsp&nbsp and I lived together and were in every sense married. Am I supposed to miss him less because we were not married? Does not having been married mean that living, eating, sleeping, and waking up alone does not hurt as much? Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, D.C. 20539 Dear Special Master Feinberg and Mr. Zwick: I write on behalf of the City of New York to comment upon the Interim Final Rule ('the Rule") promulgated on December 21, 2001 to carry out the Air Transportation Safety and System Stabilization Act ("the Act"). The City respectfully submits that the Interim Final Rule should be modified in a number of respects so that the regulatory scheme conforms more fully with the purposes and language of the legislation and to ensure that the victims of the September 11th attacks are fairly and adequately compensated. The City concurs in large part with the comments about the Rule made by New York Governor Pataki and New York State Attorney General Spitzer in their joint submission. Specifically, and without repeating their contentions at length, we fully agree that: - The Rule's treatment of economic and noneconomic losses is both unfair and inconsistent with the Act. There is no basis in the Act for limiting recovery of lost earnings. The Act requires that economic damages authorized by state law be awarded to a victim; New York law, which is applicable to most claims, provides for full recovery of economic loss, including lost earnings. Any effort to limit the recovery to something less than that amount simply finds no support in the Act or concepts of fundamental fairness. Similarly, while presumptive noneconomic awards will help ensure uniformity in the administration of claims, under the Act claimants who submit evidence of their actual damages should not have to demonstrate extraordinary circumstances in order to obtain a recovery in excess of the presumptive award. - The eligibility provisions of the Rule are also more restrictive than those set forth in the Act. Individuals who suffered physical harm as a result of the crashes should not be made ineligible simply because they did not seek medical attention within 24 hours of the attack or their rescue, or were not hospitalized or rendered disabled. Nor, if they were in fact physically harmed because of the crashes or ensuing collapse, should they be denied a recovery because they are unable to verify their injuries with contemporaneous medical records. These additional requirements in the Rule engraft conditions to recovery that are not found in the Act. The Rule should be modified so that, consistent with the Act, any persons who can show that they suffered physical harm because of the attacks are eligible for an award. - Upon sufficient proof of a relationship of economic dependence or independence, domestic partners and other family members lacking formal legal recognition should be considered eligible for an award. - The rule should prohibit disclosure of information or documents about an undocumented alien's immigration status to the Immigration and Naturalization Service. - Only those collateral sources provided as a matter of contractual or statutory right should be offset against an award, and, as under New York law, collateral sources should be offset against an award only to the extend that they correspond to the particular kind of loss that provides the basis for recovery. See Oden v. Chemung County Indus. Dev. Agency, 87 N.Y.2d 81 (1995). Finally, because the Act clearly provides that upon submission of a claim, the claimant waives the right to bring a lawsuit to recover damages resulting from the crashes (and because submission of a claim may jeopardize a claimant's eligibility for workers' compensation benefits or have other legal consequences), it is critical that the claim form devised by the Special Master clearly state the legal consequences, or possible legal consequences, or possible legal consequences, of submitting a claim. Friday, December 07, 2001 12:25 AM Victim Compensation Fund Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from.... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families.... There should be no compromise about that ever...." We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. It does not matter if you are a bond trader or a janitor, 20 years old or 80 years old no mathematical formula could ever equate to the loss of a loved one. To be fair and equitable each victim's family should be given the same amount of compensation. Your position in life should not determine your value to your family. It's not the size of your wallet but the size of your heart that should determine your standing in life as well as in death. It is highly unfair for any deductions of life insurance or pension payments to be made. What that would amount to is a penalty for preparedness.
