His death was terror filled as he was seated in the First Class Cabin amid the hijackers and could see the North tower wreckage from his window seat. My sister, (S) is overwhelmed by the situation and so I feel compelled to record her thoughts expressed to me over the past weeks. 1. Every single family of victims should first and foremost be given Health Insurance for the survivors. S. feels this is something that is needed by all regardless of individual family need. Health is a great equalizer. 2. Every single individual who was murdered by this act of terrorism was valued by those he/she loved. Any compensation awarded through Government should not be based on future financial earnings potential, net worth etc.. In our democracy each individual has an equal voice/vote and is entitled to respect. Justice dictates that the CEO and the Dishwasher be treated the same. Therefore, the fund should be distributed equally for each victim's survivor. Individual need can and should be accessed by the many charitable funds set up expressly for this cause and handled with those funds. This is where disparities of need are best met.This is also where needs versus wants can be sorted out. I wanted to comment on, what I feel is a travesty, that your offices are about to make. You must include the partners of gays and lesbians of those who died on Sept 11th. To lose your partner, then be denied any compensation as heterosexuals around you do receive the resources to start over, in my honest opinion, is beyond cruel. It's inhuman. Do we gays not pay taxes? Did we gays not contribute to charities that helped both heterosexuals and gays, alike? Did we not die in those attacks, too? Are we not Americans, as well? I find it the darkest irony that religious fundamentalists took their lives, and through the efforts, in my honest opinion, of homegrown religious fundamentalists, they will be denied equality even in death. Nor do I wish to suggest we not honor those lost on that horrific day. I question, however, why the government (taxpayers) should take on the responsibility of providing for the financial well-being of the victims' families. Tuesday, March 19, 2002 1:45 PM PLEASE READ To whom it may concern: I'm not one who normally signs petitions, but I was very upset when I heard that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Those partners grieve and suffer loss no different than heterosexual partners. I would be willing to accept "the law is the law" if it were indeed the standard, thereby excluding illegal immigrants and others - but from what I read, they will receive compensation. Either be consistent with the letter of the law or don't. Please make every effort to give full benefits to the American partners of gay or lesbian couples. If a family presented a case that warranted departure from the presumed award, adjustments would be made to make sure some amount was disbursed. The Final rules should proclaim a "Minimum Amount AFTER collateral offsets" so families that say they will get nothing using the current formula will indeed get something tangible (and explicit). Why should people that used their money to plan for their future be penalized? I don't believe it is right to disqualify family members that are not minors. If I were those families I would sue the charities, the airlines, the INS, and you. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Sunday, March 17, 2002 7:10 PM In response to the rules of the September 11th Victim Compensation Fund I feel I must contact you and express my outrage and disgust over the discriminatory manner in which surviving relatives are being compensated. In recent interviews, the head of the September 11th Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11th) has made clear that the partners of gay and lesbian heroes of September 11th will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. Our government has purposefully singled out gay couples and families to receive unfair and unequal treatment. In the wake of September 11th, the deaths of thousands of innocent Americans, including their partners, family members and loved ones, this amounts to much more then a slap in the face. It is blatant and hateful discrimination. Even unborn children and illegal aliens will be receiving benefits under this program. The Department of Justice has even promised to overlook federal law and NOT arrest and deport the families of illegal aliens, nor will they punish American companies that knowingly hired illegal aliens in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, NY Fire Dept. who died in the line of duty when the first tower fell, who was of the plane that crashed into the , and many more - we are told the law is the law and no exceptions can be made. If September 11th has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11th was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or Gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just disowned its gay children. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. I call on you, and all Americans, to stand up for equal rights and treatment under the law and for basic human dignity. Discrimination is UNAMERICAN! To uphold rules and laws that specifically state one victim is less worthy of our government's respect and compassion because of their sexuality is an insult to all the victims of September 11th and a disgrace to our country, founded on the principles of equality and justice. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, January 07, 2002 11:07 AM Victims Compensation I just want to voice my opinion that what started out as a goodwill gesture has turned the families of the victims into a greedy bunch. While I feel that there should be some monetary help for interim use - I, as a tax payer, do not want to support these families for years to come. That is why we have other avenues such as "life insurance". I think we are setting a bad precedence when we value these lives over those of other "ordinary" American citizens and our active military. We will see ramifications from this that we as taxpayers will not be able to afford in the future. Sympathy for the victims is turning to disgust over their greed - this is not good. We need to stop this before it gets any worse. Give each family a like amount - regardless of family size or income - but do not make it an extravagant figure. While we truly believe that most of the compensation should go to his wife and children, however, as the law stands now, we have no rights as parents to receive compensation for our horrific pain and suffering.
