Sunday, January 20, 2002 1:37 AM Comments on Interim Rules Attachment 1: I am writing to provide my dissatisfaction and dismay at the regulations, which are presently outlined in the Interim Rules of the Victims Compensation Fund. I lost my husband in the World Trade Center less than 4 months ago. I am still in mourning - as are my 2 college age sons. Right now I should be devoting my time and energy trying to bring my life, and that of my two sons, back to whatever normalcy September 11 can allow us. Instead, I am forced to devote all my spare time to the meetings, research and review of the regulations imposed upon us - by yourself, the Department of Justice and Washington, so as to provide comments according to your time schedule.. In point of fact, none of us will ever experience normalcy. Our lives are changed forever. I am well aware that, on any given day, a part of my husband may be found, which would bring me back to the mourning and horror of September 11. My childrens lives will be haunted forever by watching the towers burn on the morning of September 11 knowing it was their father who was dying on that TV, and then watching the TV replay it over and over again. I will always relive the horror of that day, while I stood at a window which faced the tower and watched as the second plane hit the tower, then spoke to my husband, and then just stood there in horror and watched as the towers fell. My children will graduate from college shortly, and their father will not be there, with tears of pride in his eyes. Their father will not walk them down the aisle when they eventually marry. Their yet unborn children will never know their grandfather, but will, instead, study how he died in history class. The amount of 50,000 does not even come close to compensating them. Their lives, emotions and futures are changed forever. My husband taught his children to work hard, study hard and you will be successful. Yet it was because of those values and my husbands love and devotion to , and his desire to always put in extra hours, and come in early and work late that my husband, and all of his friends who shared the same values were targeted and died. Your charts do not reflect those work ethics at all. They do not reflect the workers in the computer and financial industries, whose careers were their lifeblood. Knowing my husband, the only way hed retire was if someone was to suddenly change the locks on the doors. He worked for for 18 years, and would never have retired at your average age of 62. His job and his children were his passion. Now my children are left wondering whether this work ethic is one they wish to follow. Then they read the regulations, and they question it even further. They see the charts and wonder why their father earns less because they, the children, are older. This I cannot answer. They read the section on collateral offsets, and question as to why the regulations view financial planning as a detriment. This I cannot answer. Maybe you can. These are the lessons my children are learning from September 11 and the compensation fund You are correct in saying that you cannot place a price on the pain and suffering which we will all experience, but you did and that value was a disgrace. If my husband fell down a few stairs and lived, he would get more than $250,000 and our family life would be whole. Speaking for myself, I find it a disservice to the families that your office has informed the general public that the average victims family will receive 1.6 million dollars. This announcement, instead of helping the families has hurt us. How can anyone know the average when nobody knows the final number of victims, or their age, their salaries, and especially their collateral offsets. Yet, you would like us to believe that number, so we could sign away whatever rights we have, blindly. In point of fact, the current regulations would leave most of us with nothing, including me and my children, and yet the airline industry would be protected. I do not believe that this is what the Congress and Senate intended, when they drafted this fund. The economic charts should be changed to accurately reflect the work life and habits of the New York private sector and they should be based upon current data. The retirement age should accurately reflect the retirement age. At the minimum, it should match the retirement age, which is supported by Social Security. The salary used for computation should not necessarily be an average of 1998-2000. It should depend upon the individual case. Since my husband worked 18 years for the same company the average does nothing but ignore his current salary. The offsetting of the settlement by the consumption factor, which results in families where the children are older, getting less makes absolutely no sense. If anything, we would be saving our money, not consuming more. Just because the children are older does not mean that we suddenly change our lifestyles, we still are working the same jobs, and paying the same bills. The collateral offsets, although I am aware that this was imposed by the Senate and the Congress, are wrong. However, nowhere, in any of the regulations did it ever state that Workmans Compensation and Social Security should be treated as collateral offset. Instead Workmans Compensation, matched 401K funds, pension funds and company-sponsored group insurance policies should be treated as part of the companys contributions to your earnings. They are the hidden expenses, which a company spends per employee. Some of them are mandated by government regulations, and some are part of the overall package, which a company provides to the employees for their compensation. They should not be treated as collateral offset. In the case of Social Security, since my husband paid Social Security taxes for thirty years, why would the benefits of those taxes be deducted without offsetting them by the payments, which he made? Similarly, insurance premiums should be allowed to offset any insurance policies, which are being subtracted out. 401K funds, which were retirement saving vehicles should not be subtracted. That was our money, and does not belong to the government, similar to any other savings account. The fund should be consistent. It should not cap anyones earnings, and similarly, it should not allow anyone to receive nothing. Instead there must be a minimum, and the minimum should be announced before anyone enters into the fund. Non-Economic loss amounts do not come close to compensating us for either the horror of losing our loved one, nor do they compensate us for taking away our rights to sue. My husband, as well as many of the others in his company, was in the building for the first bombing. The terror that they must have undergone on September 11, when they realized the roof door was locked, which was their way out last time, we cannot comprehend. Then to have a full hour and a half, knowing that they were going to die, (as they told many of us on the phone), while watching building 2 collapse in front of them, that is a terror that neither you nor I can imagine, but it is a terror which we, as the families, relive over and over again. The rules should be clearly stated, and the amounts for each familys situations must be clearly known before we give up our rights. Tuesday, November 06, 2001 4:32 PM Proposed Regs I have read the Act and believe that there are numerous administrative problems as it is now written. These problems do not include the far more potentially serious situations that may develop if indeed there are further acts of terrorism. How will potential future victims be compensated? As to the current problems; as an administrative trust officer I know all too clearly the potential for not getting all the truth in an attempt to receive "discretionary" funds. By putting any time constraints on any investigative attempts is inviting a real attempt at fraud. While there should be some relief given to victims and their families for immediate needs, there needs to be a longer period for determining final payment amounts. Additionally, these final awards should not be determined by a single individual, but instead should be determined by a committee of individuals not to exceed five. Any larger group is also inviting a non-efficient working atmosphere. I also believe that the government needs to consider what awards (if any) individuals will receive from charitable sources. This information will also take considerable time to collect, particularly when you consider that these charitable groups themselves are largely ill equipped to remit funds currently. In the alternative, the government should have a program in place to advise the charitable entities of any funds which have been (or will be) paid to an individual/survivor/estate. I would suggest that a possible remedy would be to register funds paid to any claimant (subject to a maximum amount to be determined) prior to a determination of a final amount. These funds would effectively be treated as interest free loans prior to a final payment. Any funds extended which subsequently were found to be inappropriate, would be subject to repayment (and if necessary wage garnishment, etc.). There also needs to be established just who the proper beneficiary is. A child who lost a parent should quite possibly have funds paid to a third party who cannot spend any funds inapproprately. A payment directly to a surviving parent/guardian unfortunately does not guarantee that the future financial needs (college, etc.) of an orphaned child will be met. The purpose of this writing, therefor, is to suggest that only an "immediate critical needs payment vehicle" be established at the current time. This vehicle also needs to be in the form of a loan until the final restitution circumstances are determined. There also needs to be established a clear set of guidelines for payment, maximum payment amount(s), appropriate beneficiaries/administrators (non-governmental personnel and regulations - the private sector can handle these duties), and co-ordinated programs with the private/charitable organizations among I suspect many others. I believe that this temporary vehicle satisfies the intent of the Act, while allowing development of long-term efficient guidelines. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. The interim rule seemed to preclude that class. It is most unfair that a particular class of people should have their pain and loss ignored. Wednesday, January 09, 2002 5:41 PM Federal Compensation Package The families of the victims deserve to be generously compensated. These people died because their government failed them by not keeping track of those that enter this country and stay longer than their visas are for, or on student visas but never attended school. The airport security failed them because they allowed four planes to be hijacked on September 11th. Also, red flags should have gone up when one way tickets were purchased with cash at the most expensive ticket prices. The World Trade Center is at fault because people on the top floors weren't killed instantly but had no way out. These people did not choose to be in the military when war is always a possibility. These people went off to work and never came home. This wasn't an accident. This could have been prevented if the airports had better security. People sue for all reasons, even when they spill a hot cup of tea on themself because the water is too hot. Someone should be held accountable for all the lives that were lost and for the families who are still living but living with a hole in their hearts. Their loved ones can never be replace but they should receive the amount of money they would have gotten if their loved one were still working. And what about the children who have lost a parent, companionship for a spouse, the elderly parents that have lost their only child. These people deserve more than they are going to get. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved ones future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congresss goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harms way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on the collateral source rule has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceaseds job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
