Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Comments on Interim Final Rules 9-11 Victims Compensation Fund
Hello
My name is      and I'm the sister of two of the murdered Victims of
the Sept 11th terrorist attacks on the World Trade Center. I currently live
     in Boca Raton. I lost my brother     
and      on Sept 11th. Both      and      worked at      on the      floor of Tower 2.      was 28 years old , unmarried
(engaged) with no children.      was married with 2 children.
My concerns regarding the interim final rules are basically two:
1. Knowing what the final award will be prior to official acceptance. If
claimant is required to waive their right to pursue legal action it would
seem only reasonable that the exact settlement to claimant is verified and
agreed to prior to acceptance. This would eliminate the possibility of any
misunderstandings.
2. Private insurance premiums paid by the Victims were paid to protect their
loved ones financially in the event of death. Their responsible behavior
should in no way be offset by this horrific terrorist act. If the concern of
the Federal Government is minimizing the use of American dollars then freeze
the assets of the 60 countries engaged in or supporting terrorist activities
and use those monies to compensate the impact to the treasury. Wrongful
death, i.e.. murder, should have no beneficial financial offset flowing to
anyone culpable on the back of the murdered victims.
Finally, by way of an editorial comment; I sincerely hope that no additional
weight is given to the numerous mass e-mailings going to this site on the
part of those groups with an obvious political agenda. In fact it is my hope
that they be discounted.
Specific Objections to the arbitrary interim final rule construction:
I am writing to express my serious concerns and objections to the Department
of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the
September 11th Victim Compensation Fund."
The airline bailout act gave the airlines $15 billion in cash and loan
guarantees and capped the airlines' liability for the September 11 crashes
at the limits of their insurance coverage. Because of this cap, the damage
caused by the crashes greatly exceeds the private fund available to
compensate victims and their families. Thus for the vast majority of victims
and families, the cap has the effect of eliminating the right that they
would otherwise have to sue the airlines. Congress set up the fund to ensure
that the airline bailout would not come at the expense of the victims'
families.
The act mandates full and fair compensation to victims and their families
for their actual economic and non-economic damages. DOJ has ignored this
mandate and instead has written arbitrary regulations that will result in
compensation levels far below the losses actual suffered by the victims and
their families. In fact, many families' total compensation from the fund and
all collateral sources combined will not even fully replace lost income. In
effect, these families will not receive any of the non-economic compensation
required by the statute. After collateral sources are deducted, as required
by the statute, some families would receive nothing from the fund under the
interim final regulations.
DOJ's formula allows for non-economic awards at only one-tenth the level
paid in comparable cases, even though Congress explicitly enumerated a
broader range of non-economic damages than could be recovered in any single
jurisdiction. DOJ's formula for non-economic damages is $250,000 for the
person killed and $50,000 for the spouse and each dependent. In a wide
variety of air crash and terrorism cases, however, judges, juries, and
mediators commonly have provided non-economic damage awards well into the
seven-figure range.
Independent economists have found serious flaws in DOJ's method of
calculating economic damages, including use of outdated and inapplicable
worklife and life-cycle earnings data. DOJ greatly underestimates promotions
and other increases in earnings for victims. It relies on civil service and
military retirement system actuarial data that track federal worker incomes
and pension requirements, not the higher-paying private sector career paths
followed by the vast majority of the victims.
The interim final regulations also arbitrarily cap a victim's income at
$231,000 a year. Combined with the faulty methodology described above, the
income cap would result in some families receiving compensation for less
than 25% of their actual economic losses.
Under DOJ's rules, a family's award may be increased above the "presumptive"
award only by a showing of "extraordinary circumstances" -- beyond those
suffered by other victims or victims' families. This high burden of proof
makes a charade of the right to a hearing provided by the statute.
DOJ should fulfill the act's intent by revising the rules to compensate
victims and their families for the types of damages specified by Congress,
at levels comparable to those provided in the tort system the fund was
designed to replace. While DOJ has shown flexibility on some aspects of the
rules, it is resisting the victims' and families' requests for significant
changes.
If the proposed regulations are not changed significantly, victims' widows
will have to sell their homes, deplete their children's college funds, and
give up their plans of being full-time parents while their children are
young. Many families, anticipating little relief from the fund, will decide
to sue the airlines and others, despite the handicap of the liability
limits. We do not believe these are the outcomes Congress intended.
Please contact Attorney General John D. Ashcroft and Special Master Kenneth
R. Feinberg and tell them of your concern that the interim final regulations
fail to conform to the language and intent of the act. With the regulations
soon to become final, I believe that only the swift and strong support of
Congress can avert unnecessary financial and emotional damage.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Could you please explain to me why some gay Americans are being left out? I
really would like to know! First, they are Americans! AMERICANS!! Should
they not be allowed the same benefits under this Fund BEFORE an illegal
alien? Those illegal aliens, if lost loved ones, deserve the compensation
just like everyone else. However, I would think an American Citizen, someone
who actually lives here LEGALLY, would get a nod and compensation long before
someone living here illegally. I sincerely doubt anyone is going to stop and
say, "Let's sue because some gay person got benefits and our state doesn't
allow that!" Do you know what kind of ill will and basic dislike that person
would receive? Not just from gay americans (There's that word again -
AMERICANS!!) also from other people who are heterosexual. For someone, to
actually attach a lawsuit again someone who suffered through the 9/11 with
their loved ones dying, would be horrendous! That person would probably be
received as a terrorist in his own country for something like that. All
those people died for no reason whatsoever, and they will always be
remembered. However, why should some of them be considered lesser of a
memorial than others? Surely it would not be of their sexual orientation?
Come on one would think this country, The Land of the Brave and the Free, is
not going to let someone go unnoticed! I don't know, maybe I'm just one of
those people that think everyone should be equal. If you stop and think
about it, people that say gay people want gay rights....What they are simply
asking for is basic human rights! Is that hard to believe? Right thats are
given to every person that live in this country, are given rights, however
some people are out there that wish to deny people that. We like to call
ourselves The United States, but how United are we? Maybe that should be a
question posed to every American (Funny, how that word keeps popping up -
AMERICANS!!) Maybe in a perfect world things will run smoothly, however,
until then we should be making the best out of it, not trying to divide the
country even further.

Sept. 11 Compensation Fund
Dear Sirs,
ALL victims FAMILIES should be compensated without regard to type of
family. I lost my wife ( and we did act as husband and wife, though we
were not married, for 20 years) at the Pentagon, she was aboard Flight
77and did not ask to die that day. We were going to celebrate our 20th
anniversary together on Sept 12th and her 44th birthday on Sept 17th. This
was a devastating event in my life. I lost the love of my life, my reason
for being. Should I and others like me be penalized because we choose not
to be married (and incur the marriage penalty in regards to income
tax). I was laid off in April 2001 and she was also my sole source of
income. There is no way to express to grief and pain I have suffered since
this event. My life has forever been altered and nothing will ever bring
my wife back to me. It also seems that the victims on board the flight
that crashed into the Pentagon have largely been forgotten. Lost among
those killed at the WTC. PLEASE treat EVERYONE fairly, the grief is the
same even if they were NOT married.
Additionally,awards under this fund should NOT be reduced by collateral
funds received. Families of victims should not be penalized for good
insurance planning or an advantageous benefit package offered by an
employer by having these types of funds reduce the compensation award from
the Federal Government. Remember, we have been paying insurance premiums
all these years. I don't believe it is fair to penalize us for planning to
be able to provide for our loved ones.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in a traumatic
predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and
the State of New York have already announced that they will not discriminate against gay and
lesbian families. The Department of Justice should do the same.

very important issues.

9/11 Victim Compensation
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Help all victims of terrorist attack
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.
This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as
great.
Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions. They are
interested in a political victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Comments on Victim Compensation Fund
My comments will be short and to the point: 1) The victims of 9/11 should
NOT be compensated by the government using our tax dollars. They should not
be allowed to sue the airlines, who were NOT responsible, for any amount of
money. In fact, none of those actually responsible for 9/11 are in a
position to sue, being either dead or otherwise unavailable. 2) The money
collected from donations amounted to an awful lot. Isn't THAT money supposed
to go to the victims? Time and energy would be better spent making sure that
money gets to where it was supposed to go. There are a lot of people out
there who donated money that they needed themselves and who wouldn't have
donated if they had known they would be paying twice. 3) What makes the
victims in New York any better than the other people that died that day? If
you are to compensate NY victims families, compensate ALL victims families.
The government is screwing this up and making really bad decisions in the
area of victim compensation. Please fix it, on behalf of the rest of the
citizens of this country.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
