While H.R. 2926 provides immediate assistance to the industry, it also addresses Congress' urgent responsibility to ensure fairness, justice and compassion for the human victims of the horrific events of September 11, and for their families. Title IV of the Act establishes a September 11th Compensation Fund to be administered by a Special Master appointed by the Attorney General of the United States. We write to urge you to appoint that Special Master expeditiously but with due diligence. As you know, Section 407 of the measure requires that you, in consultation with the Special master, promulgate regulations to carry out the activities of the fund within 90 days of the bill's enactment. To that end, it is vital that a Special Master be appointed quickly. We feel strongly that the Special Master you choose must have the support and confidence of the Senate and the House and of the elected representatives of the victims in particular. Title IV vests an enormous amount of power and discretion in you and in the Special Master. The regulations you promulgate and the way you administer the fund will have enormous repercussions for the victims and their families. The Special Master you select must have extensive experience, extraordinary judgement and legal ability, broad respect within the legal community and bipartisan support in Congress. Accordingly, we respectfully request that you consult with us prior to select the Special Master and promulgating regulations. Our nation and congress have come together, heeding the president's call for unity in action and spirit in the wake of terrible events of September 11. Tuesday, November 06, 2001 3:16 AM comments Greetings, Like many of my fellow Americans my heart went out to the victims of the 9/11 tragedy - my wife and I donated generously in an attempt to assist the families affected by these horrible events. Suffice to say that we certainly expected the overwhelming percentage of what we gave to go *directly* to those personally impacted by the disaster - when I hear reports that the American Red Cross will be distributing less than 20% of the money it collected to the actual victims I am sickened and angered. All the hand waving and bureaucratic explanations in the world cannot shake my unswerving conviction that this outcome is simply, unequivocally wrong. You all are the "department of justice" well, where is the justice here? My wife and I are kind hearted but we are not wealthy - had we known what a fiasco this would all turn out to be we probably would have explored other alternatives. I never expected things to go the way they apparently have, it is a monumental injustice. The sad thing is - none of this actually makes life better for those families who have been ripped apart by this senseless violence ... if nothing else can be done, please publish a validated list of names and addresses and my wife and I will see what we can do to come up with something additional to help. The aid situation is truly a travesty but that should not deter our and steadfast determination to truly bring whatever relief we can muster to the victims of the Sep. 11 attacks. This importantly should include the partners and children of same sex unions. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." She was my life partner and the last time she parted from me she never returned. Our wedding was to take place shortly after the tragedy. My loss is the same as the loss that any spouse suffered. We had a very long term loving relationship and had planned to spend the rest of our lives together. States have different laws concerning domestic partners. In fact we both thought that we were in a common law marriage, since our relationship was for over 7 years together. In deciding who can collect from the Victims Compensation Fund, Mr. Feinberg, points to state law on this issue, although state laws vary on this subject. In some states, one can live together for just 6 months and be considered a common law spouse. When discussing other issues at his meetings, Mr Feinberg refers to federal guidelines. Most victims and public officials to which I have spoken to, feel that he should use a more relaxed standard due to the suffering of many fiancees and domestic partners in this tragedy. This fund was established by federal legislation in order to compensate the victims families and loved ones. The Dept of Justice seems to have the power to allow the funds to be distributed as intended......to compensate for the loss of our loved ones who died in that foreign attack against the strongest symbol of our nation. Tuesday, January 22, 2002 3:30 PM Victim Compensation Fund I have been watching and listening to the stories that have been presented on the news for the last several months. I am growing concerned about this Victim Compensation Fund. Please don't take me wrong. I believe that the events of September 11th was the most horrific thing that I hope and pray that I will ever see in my lifetime. However, I am continuing to hear stories about the survivors of the victims from September 11th and how they are not be fairly treated....they haven't received any money from the charities or from this fund...when is it coming...and so on... My question/concern is that this money that is going to be given to the survivors/victims of September 11th is EXTRA. Had any of these people been killed in a car accident, drowned boating while on vacation, or any other accident that claims the lives of innocent people everyday, the EXTRA fund/monies would not be given to them. One story that caught my attention was about a widower who had already been given approximately $20,000. She had spent this money in about a month's time. That is more than some people make in a year or even 2 years! Are their bills that astronomical? Was there no insurance? What would have happened if their loved one was killed in an everyday accident? How would they have survived then? Were the families of the Oklahoma City bombing treated in the same manner? Are families that lose everything and/or loved ones in hurricanes or floods or earthquakes treated the same? My thoughts and prayers go out to the many who lost loved ones on September 11th. We have shown since September 11th that we are one of the greatest countries in the world and that we are United.
