Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. I went to the White House Reception for Family Members of Flight 93, and the Chief of Staff told us so in his opening remarks before the President's address to us. He spoke to us on behalf of the entire White House staff, who thanked us all individually as we left for the heroism of the passengers on that flight, which potentially saved their lives. I am dismayed by the interim rule for three reasons: (1) Obviously, I believe that the passengers on Flight 93 were special. They took a vote to save the lives of their countrymen. They deserve some recognition of their heroism. To date, they and their families have received a quite nice reception at the White House, but little else. (2) Beyond the special circumstances of Flight 93 as opposed to the passengers of the other flights, ALL passengers on ALL the flights of September 11th entered into a situation in which the airlines AND the government, by extension and agreements with the airlines vis-a-vis airport security, were responsible specifically for their safety. The passengers on all of the flights should be compensated at a higher rate than those who were on the ground because of the inevitability of their fate once they were on the planes in comparison to the chance presence of victims on the ground at the sites where the planes went down. The airlines and the government (again by extension) were specifically responsible for my daughter and the rest of the passengers on Flight 93 and the other planes. (Theoretically, the government is also responsible for the presence (and by extension the safety) of the staff personnel who were victims at the Pentagon.) (3) The interim rule proposes on the first page to avoid making calculations by income levels, etc., yet apparently on the following pages it outlines plans to do just exactly that. Such calculations do not address the loss to me and my daughter's mother of the POTENTIAL FOR JOY IN LIFE, watching our daughter complete her college course and enter into a productive life helping others as a child psychologist. My daughter's age and occupation as a student place her in a category which is addressed by "individual circumstances", without explaining what those individual circumstances are. I have described some of the indivual circumstances which I think affect the "calculation" of loss caused by the death of my daughter as a passenger, as a hero, and as a potential source of joy in life which has been taken from me as a result of the poor security systems in place at Newark Airport. I expect that the interim rule will have to be amended in order to more adquately address the individual circumstances I have described. I am reluctant to accept the current form of this document as a model for the final compensation system. I understand the difficulty of developing this rule, and I hope to be able to see an improved final version and to be able to accept it. I don't understand, other than as a way for the Bush bunch to continue their support for big business(airlines), by subterfuge using 9/11 victims, why anyone should be compensated for the death of relatives. No one else is, except for a small SS death benefit. While I feel for their personal pain (And sometimes pain is not always the case where there was discord in a family.) why should taxpayers give to those who in many cases ,as they give tearjerking interviews from beautiful homes and apts. in classy neighborhoods, have far less need than many who must pay those taxes from meager, just get by, if "I pay my taxes and do without meds" incomes. I know this is the case for me. Often these people are the same ones who prior to something happening to them , lived in a little protected bubble and constantly talked of a meritocracy - that others, no matter what their problems or tragedies, just needed to pull themselves up by their bootstraps and not depend on the government. They also ranted about personal responsibility. Didn't they show personal responsibility by having adequate insurance etc. to provide for their families in such an emergency as unexpected death. While I am grateful for public servants who put their lives on the line, they also knew of the risks of those kind of jobs. I know, because of those risks, they also have widows and children funds and insurance far beyond what the average citizen can afford as part of their benefits. I am not a grinch but I fail to see why the deaths of 9/11 victims are any different than those of any who lose their life unexpectedly. This happens every few minutes of every day. Where is the government for them? To rub salt in the wounds, the unseemly greed and entitlement is nauseating. Stop this farce immediately. If some airlines are necessary to keep the economy afloat loan them the money to keep going. Allow the families to sue. It seems if you die in a certain way in this country it is your entitlement. I have often wondered when I hear of huge settlements from the death of a family member, how the recipients feel spending the death cash on cars, houses, and vacations. Below are my comments in response to the Department of Justice website soliciting comments and opinions regarding the proposed regulations and processes for implementing the Victim Compensation Fund. ************************ My understanding is that victims of the September 11th tragedy are defined as families of those who perished as well as individuals who are now unemployed (or whose businesses sustained prolonged closures) as a result of the attacks. Without a doubt these people have suffered the most, and will continue to suffer for a significant period of time. However, there is a population of individuals who I do not believe qualify under the accepted definition of victims... but these are people whose lives have been turned upside down since September 11th. These "non-victims" live in the immediate vicinity of Ground Zero. I speak from personal experience. My apartment is directly across the street from "the site" (or the sight) of the collapsed towers. While my apartment sustained only minor damage, it is never-the-less contaminated with dust and debris which must be removed by a company specializing in handling Hazardous Materials. I was lucky. Many of my neighbors found that their apartments caught on fire when flaming debris was jettisoned across the street from the World Trade Center. For a variety of reasons, everyone in the neighborhood was prohibited from re-occupying their apartments for a period of time FBI and police designated the area a crime scene. Emergency and rescue workers commandeered buildings and streets. For a time, the area belonged to the authorities... and rightly so. In the past month or so, many buildings have been readied for re-occupation, but many in the neighborhood cannot yet return because particulate matter in the air (emanating from the still-buring fires) causes respiratory distress, nosebleeds, asthma, headaches, etc. While we have been assured by the EPA that the air poses no long-term health risks, residents are suffering from symptoms that make the area a short-term health nightmare. My particular building has not yet been re-opened. The eastern-facing facade of the building sustained severe damage and must be replaced before those of us on the east side of the building can re-occupy our apartments. In the meantime, our landlord is demanding that we have our belongings decontaminated, packed and removed from the premises. We have been told that we will not have access to our apartments for up to six more months. While some downtown residents were smart enough to purchase homeowners or renters insurance, many, many were uninsured. Every uninsured person has had significant out-of-pocket expenses: temporary housing, HazMat decontamination, the cost of HEPA air filters (recommended by the Department of Health, OSHA and the EPA), extraordinary meal charges, dry cleaning, etc., etc. A subset of the population have incurred (or will incur) additional expenditures: moving and storage costs, medical (and psycological) bills, charges to replace damaged property and the like. Although there are serious financial considerations for downtown residents, the emotional toll is hard to quantify. Many have been so traumatized that their professional performance and personal relationships have suffered. Our once tranquil neighborhood has suffered too. Transportation options are significantly reduced (and will be for years to come). Goods and services are greatly diminished (many stores have permanently abandoned the area because they relied heavily on the patronage of those who worked and visited the World Trade Center complex). Air quality is compromised (we've been told that our children should not exert themselves when playing outdoors.) Many have chosen to move to other parts of the City. Others have chosen to stay and rebuild the neighborhood. All have suffered. We are victims too. Saturday, March 16, 2002 5:24 PM Discrimination against the Gay Heroes of 9/11 As a tax paying American citizen I am writing to voice my absolute disbelief in learning that domestic partners of the Gay American Heroes of 9/11 are not going to receive anything from the victims compensation fund! It is simply unacceptable that you (our government) see fit to overlook the laws of our land when it comes to giving compensation to families of victims who were in our country illegally on 9/11 and yet find it totally acceptable to deny these same benefits to domestic partners of GAY AMERICAN HEROES who died in the attack on the World Trade Center and in the downed plane in Pennsylvania. I think it is about time that those in a position of decision making stop making decisions based on their own moral attitudes and values and start doing what is RIGHT and treat ALL AMERICANS with the same respect with which they expect to be treated! You rest assured that I will be sending similar emails to the White House, Members of Congress and anywhere else that I feel the voices of average, ordinary, tax paying citizens of this country need to be heard! I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. January, 2002 The Honorable John Ashcroft Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 Re: "September 11th Victims Compensation Fund of 2001" P.L.107-42 Dear Mr. Ashcroft, Please, allow me to introduce my daughter. , 34 years old in July and married 2 days short of 6 months, was a Catering Sales Manager at Windows on the World, located in Tower 1 on the 106th and 107th floors of the World Trade Center. She had worked many hard hours over many years to climb to the "peak" of her industry. She believed she was at the "top of the world", in the "greatest city" in the "greatest country" in the world. She was the ultimate New Yorker and the most loyal and proudest of Americans. Early in the aftermath of the heinous September 11th attacks upon the United State of America, Congress enacted the above referenced legislation to compensate the relatives of the victims of those brutal attacks. We firmly believe the interim rules issued on December 20th by the Special Master satisfy neither the letter nor the spirit of the enacted legislation. This legislation authorized payment for economic and non-economic loss. Economic loss was defined as "any pecuniary loss...including the loss of earnings... to the extent recovery for such loss is allowed under applicable State law." (Sec. 401(5)). Non-economic loss was defined to include among other things "physical and emotional pain, suffering ... mental anguish ... and loss of consortium." (Sec. 402(5)). The sole offsets to the payment for economic and non-economic loss were the "collateral sources" as specified in Sec 402(4). These offsets included "life insurance, pension funds ... and payments by Federal State or local governments related to the attacks of September 11th." These were clearly intended to be the only offsets. In his proposed rules, however, the Special Master has imposed outrageous offsets which are in no way authorized by the statute. Specifically, he imposes arbitrary income limits and restricts pain and suffering awards to $250,000 - no matter what the extent of the pain and suffering may have been. To this I take particular offense. How dare he, or any living soul trivialize the pain, the suffering and the anguish these murder victims, must have experienced.. It is a matter of record that there were many in both towers fighting for their lives for over an hour even while realizing that they had no means of escape and no hope of rescue. Indeed, a very, very long hour for them and for us as we watched and waited. I watched from my office window knowing that my daughter, my best friend was trapped. Times $250,00 over and over again and it will not do them justice. The practical effect of these caps is to drastically reduce the award from what the statute intended. Relatives of the victims who were in the financial services sector or in the public service sector police officers and firefighters will suffer a particularly adverse effect. This is not only contrary to the legislation but also entirely unfair. By what right does the Special Master penalize those victims for their ability and foresight to provide for their families after they were gone? For the virtue of working long and hard to care for their families and insure their families future, they are being denied a fair share of compensation. and all the other victims were killed precisely because of who they were, where they were and what they represented. All the victims of this terror personified American business and commerce. They wanted the best, they were willing to work for it and that is why they worked in the World Trade Center. They exemplified America, and that is why they were targets that day. Our enemies would settle for nothing less than America's best. Police and firefighters died during the most successful rescue operation in the history of the United States. They too were victims of a demon called Bin Laden Do not dishonor our loved ones by allowing their families to fall victim to bureaucracy. Mayor Giuliani in his farewell address stated that the nation has an obligation to those people who died. The families need to be protected and provided for as if they still lived on. We need to be able to hold our heads high as a tribute to their sacrifices and as proud Americans. No compromise should be broached on their behalf. The Victims Compensation Fund was created as part of a comprehensive legislative package with the saving of the airline industry in mind. It imposed restrictions on the rights of the victims' relatives to recover from the airlines in court. However, the Fund was established to protect the rights of the victims' relatives. The Special Master cannot and must not take it upon himself to restrict those rights. Additionally, at the time the legislation was enacted, the number of fatalities was thought to be between 6,000 and 10,000. Gratefully, the final number is showing to be less than 3,000. This will result in a significant reduction in the expected expenditures and makes the Special Master's false economics even less defensible. While the lowering of this tragic statistic is gratifying, it does not alter the fact that our daughters, sons, sisters, brothers, mothers or fathers are forever lost to us. WILL NEVER COME HOME. Do not make light of her memory and the memories of her fellow victims. We, the family of , hereby request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that each victim's case be addressed separately when computing the non-economic loss attributable to pain and suffering. Justice demands no less. 3,000 victims of American's bleakest hour demand no less. This importantly should include the partners and children of same sex unions. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, December 22, 2001 5:32 PM Protect Traditional Marriage Mr. Kenneth Zwick Office of Management Programs Department of Justice Washington, DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, December 21, 2001 6:04 AM Justice help all terrorist victims Dear Mr. Zwick: The very humane Fund for relatives of victims of the September 11 terrorist attacks must include all relatives of all the victims. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. They are interested in a political victory, not humane assistance. This Fund is intended for humane purposes; it is not a political statement, Mr. Zwick. Saturday, December 15, 2001 10:34 PM (no subject) To Whom It May Concern: I believe there should be no age cap on the earnings potential of the victims of this terrible tragedy. Why should they have a cap if the rest of us are looking at retirement now starting at age 70. There should be no deductions for any charity received by the victim's dependants. They are ENTITLED to their share REGARDLESS of any gifts they may have received. Life insurance was PAID for by the Victim and should not have any bearing on what the family has a right to. The right to appeal should not be denied to those who are suffering due to the tragic losses inflicted on them by this horrific event. These people died because they were Americans. Let's give their families the diginity to live their lives as Americans. They should not suffer any longer.
