My Fellow Americans, I am absolutely apalled by the notion that ILLEGAL aliens are being treated better by the American Government than some of our fellow citizens. Whether or not I, or you for that matter, agree with any given individual's life choices or sexual preference, I think we can all agree that if they are American citizens, they are afforded "equal protection under the law." This extends to protection from discrimination, especially from discrimination by their very own government. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Dear Mr. Feinberg: I wish to express my faith in your ability to distribute this Fund with the utmost fairness, and specifically to support the Interim Rule against the criticisms leveled by Rep. Peter King and certain victims relatives. It is morally right, even if the statute did not require it, to consider the individual needs of the survivors, in ways that may differ from the way that damages would be calculated in the tort litigation process. It is also right that there be uniform base-line awards for non-economic damage suffered by each victim, each surviving spouse and each surviving child. Most survivors certainly would not want to relive, through litigation, the last horrifying moments of the catastrophe, and in most cases the experience of individual victims in these last moments will be impossible to determine. To give more money in cases where victims or families are more eager to testify, or more effective in communicating the impact of the trauma, would lead to serious inequities. I disagree strongly with the objection by Rep. King to the concept of a "cap" on awards for the families of exceptionally-high-earning victims. Rep. King says compensation should be in proportion to earnings, without limit, because the victims "were the symbols of American capitalism, the symbols of American business," and were murdered because of this. I look at September 11 and its aftermath in a profoundly different way. This nightmare vividly brought home how death is the "great leveler." As the New York Times so eloquently demonstrated with its "Portraits of Grief," for every vice-president who died, a security guard died with him. For every bond trader who died, a cook died as well. And so forth. Each person, whatever his or her income or profession, had a life, a family, a personality, a human uniqueness that no compensation check can capture. The terrorists aimed at America. We are all Americans. Who lived and who died was a matter of luck, not wealth or status. It is this aspect of September 11 that caused New Yorkers, and Americans, to "rally round" as never before in my lifetime, and this aspect of September 11 must be honored, and respected, by your administration of the Fund. In the normal world of finance and economics, a person may be "entitled to" something based on purely economic factors. Nothing about Sept. 11 was normal, and the "normal" civil litigation rules cannot apply. Attempting to apply them would not be practical and would not be fair. I urge you to adhere to your statement, in the Interim Rule, that in the cases of the highest earners, awards in excess of the guideline figure will not be approved in situations where "multi-million dollar awards out of the public coffers are not necessary to provide [the survivors] with a strong economic foundation from which to rebuild their lives." The country has many pressing needs, in the wake of September 11. The Interim Rule appears to be a fair, thoughtful and sensible way of recognizing our collective needs as we meet the individual needs of the victims and survivors. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. January 28, 2002 Our group was established as a result of The terroristic attack on September 11, 2001, "Fiancees and Domestic Partners of 9/11" was created to emotionally support those of us who lost our loved ones in the tragedy of 9/11. Although we were not legally married, we were in committed relationships with our life partners. We suffer the same as those who were legally married. Our days and lives are now filled with loneliness and emptiness. There is a deep pain that is unbearable that we will live with forever. We are struggling hard to find any hope in the future. We had a beautiful life planned and had already established ourselves as "families". There are an estimated couple of hundred of fiancees and domestic partners. The Victims Compensation Fund, was funded with federal funds to compensate spouses and victim's families. Originally it was funded in thoughts that there were 7,000 families now it is 2,876 families. The legislation emphasizes the loss of companionship and consortium. In most cases, the fiance and or domestic partner was the person who was emotionally and financially dependent on the victim. It is not clear how Mr. Feinberg, the Special Master, will treat the fiancees and domestic partners of the victims of New York and New Jersey. We should be treated as equally as family members and spouses, since the intent of this legislation was to help all of us according to the Senators and Congresspersons with whom we have spoken. Mr. Feinberg took the fiduciary responsibility to act on behalf of the relatives of the victims and, as it stands, the rules fail to satisfy the letter and the spirit of the legislation. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1.Collateral sources: The victims relatives are being asked to give uninformed consent to a fund that has a significant possibility to provide little to no compensation. The deduction of insurance proceeds, pension funds, 401K proceeds and other collateral sources should be eliminated from the terms of the fund. To penalize a victim for acting with responsibility and compassion for their loved ones is unjust. 2. Consistency: The arbitrary income limits imposed be the Special Master are inconsistent. The victims were murdered precisely because of the jobs they held, and where they worked the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. 3. Non-economic rewards: Mr. Feinberg has arbitrarily restricted the award for pain and suffering. In the words of Rep. Peter King …every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world in a scene which will be repeated in the media for decades to come is a horror these families will never escape from…The Special Master cannot take it upon himself too restrict the rights of the families. Therefore, we request that the interim rules be amended to more appropriately compensate the victims families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: we have an obligation to the people who did die…Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families…There should be no compromise about that ever…. After the tragedy this nation faced in September, after the months of grieving, healing, and rebuilding, for your organization to deny compensation to the loved ones of gay victims of the September 11th attacks is cruel. It is heartless to tell a group of people that, though they lost loved ones that grizzly day, their loss is not equal to the loss of the other families. That because of who or how they loved, they are somehow lesser Americans. Lesser human beings. Because a state legally practices discrimination against a part of its populace, you will deny the partners of men and women who died that horrible day the same support you readily give traditional couples. Support you readily give to those who are not even legal citizens of this country! But deny our own people, because of their basic sexual orientation. Does that not seem wrong to you? Did you ask those who donated what their orientation was before you accepted their money? Or are they good enough to give to charity, just not to receive it. By all appearances, the tragedies of 9/11 united us, but it's a fragile facade. One father says he is not going to become a millionaire off his son's death but in the next sentence, the reporter tells the article that each family will likely get 1.6 million dollars. I too have lost a loved one. My youngest son was killed in a horrible accident but there is no obligation for anyone to pay me 1.6 million. I'm sure that those killed had insurance, etc., etc., so why do they feel they need even more to pay their bills? Are we to support them for the rest of their lives? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
