Wednesday, January 23, 2002 12:03 AM Sept. 11 Federal Victims' Compensation Fund I don't agree with the granting of federal tax dollars in this case. All of the money that has been collected by various organizations for the victims of the Sept 11 terrorist attacks and their families has not been distributed. The DOJ might be able to help fix the problems with the distribution of what's already been collected, rather than creating another quasi-agency. I'm sorry that, collectively, we so often turn to litigation that Congress saw the need, or was persuaded by interested parties, to pass legislation for the sole purpose of preventing future litigation in the aftermath of such tragic events. Yet, realistically, I can understand the desire to limit future, costly litigation. Maybe the legislators saw this course of action as better management of tax dollars than just waiting for the lawsuits to be filed and paying more later. They and the interests lobbying them are apparently very concerned about future litigation, although I thought this type of event (act of terrorism) would be considered a "force majeure" event. My initial reaction to the news of the federal fund was one of disagreement because all of the money collected for the purpose of helping the victims had not been distributed. Will the tax dollars used as fund distributions be reimbursed by those parties that benefit from fewer future lawsuits stemming from the Sept 11 terrorists attacks? Were federal funds distributed to victims of other previous terrorist attacks on US embassies, US military installations, etc.? Although I would prefer no federal government intervention, except to get the charities to fairly distribute the money they supposedly collected for these victims and families, I think a low-interest federal loan would have been preferrable to an outright grant. Yet, a loan program may not have served the purpose of the federal fund, which was to provide a disincentive for filing future lawsuits. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, January 27, 2002 12:27 AM Victims Fund Mr Zwick; I am against any form of Federal Compensation for the Victims' Families. This will set an enormously bad and potentially very costly precedent. Will we be compensating the families of those who died in Oklahoma City as well? What about future tragedies unrealted to terrorism? Will families of victims who are killed in airline disasters be compensated by the Government? What about soldiers killed in battle? From now on we are going to have to lay down rules on which accidents or terrorist incidents qualify for federal bail-outs. This is ridiculous. The federal government has absolutely no obligation to compensate these victims whatsoever. In fact, although not politically correct, I contend that it is the victims themselves that are responsible for their own families well-being, it's called life insurance. We should have enough life insurance to reasonably cover our families' expenses for at least two years after our deaths. If a victims spouse didn't have adequate life insurance or plans for their family, why should the federal government (i.e the taxpayers) step in to bail them out? This is a matter for private charities. Americans from every corner of the nation responded by sending hundreds of millions of dollars to these victims families', where is that money and why isn't it getting to those who need it? Instead of Uncle Sam forking over tax dollars, you should be investigating some of these so-called charities (Like the Red Cross for example) who are sitting on all that cash (500 million dollars by some estimates) instead of disbursing it as was promised. This truly was a horrific crime and everyone is sypathetic to their plight, that's why we all sent those hundreds of millions of dollars in support. Find out where that charitable money is and make sure it get's to the right families quickly. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, December 18, 2001 4:39 PM Equal Access for Survivors December 18, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, prohibit arbitrary discrimination. The US government is obligated to respect these rights. As you consider rules for administering the relief fund, I ask that you will apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits ?on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need.? Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families ? and all types of families ? impacted by the human rights tragedy of September 11 are treated with dignity and equality. "I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Thursday, January 17, 2002 6:12 PM I think this is so unfair that from the gov't fund there will be "collateral sources" deducted as my husband was a very dedicated worker and he has paid for his 401k plan and insurance policies for many years.......and this is what little money I will have to live with for the rest of my life....in another 5 years or perhaps before no one will remember "us" who stayed behind and what do I do in another year when I will no longer have medical insurances, dental or for my glasses.....and the union tells me that it will cost me and ...who will pay for that? I am aware that 18 Congressmen have recently written a letter to you asking that you include unborn babies who died in the 9-11 attack as "victims" whose surviving family members are eligible for help under the September 11th Victim Compensation Fund of 2001" that is part of Public Law 107-42. You're already familiar with the story of who died with her unborn child on United Flight 93. 's husband suffered not just the loss of his wife, but of their first child during that terrible crash. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions.
