I am asking under the equal rights amendment of the United States Constitution that ALL people who lost loved ones in 911--especially gay people who are US Citizens in a committed relationship of 6 months or more be given benefits for the loss of their partners just as heterosexuals who lost their wives or husbands. Bigotry should have no role in the distribution of these funds. Ashcroft Attorney General of the United States United States Department of Justice 950 Constitution Avenue, NW Washington, DC 20530 Re: Victim Compensation Fund in the Air Transportation Safety and System Stabilization Act Dear Mr. Attorney General: As you know, on September 21, 2001 Congress passed H.R. 2926, the Air Transportation Safety and System Stabilization Act (now Public Law 107-42). This measure will provide a much needed tool for help and healing for the families affected by the terrorist-inflicted tragedies. The Victim Compensation fund created within Title IV of that Act was created for just that purpose. As I am sure you are aware, this fund is a major undertaking not only because of the multitude of victims for whom it is intended to provide relief and tremendous cost to the American taxpayer, but also because these victims very likely will receive relief that they would not recover if they choose to go to court as per the normal course. This is because the fund was created to compensate without requiring proof of fault or liability - which relieves the victims of the normal legal burden they will have difficulty overcoming in court with regard to this particular tragedy. There are victims of other tragedies for whom we were not able to provide such a means of "no fault" relief. For these reasons, the class of individuals entitled to recover from the fund was expressly limited only to those that suffered physical injury or were killed as a direct result of the terrorist incidents of September 11, 2001. See P.L. 10472 Title IV, section 405(c)(2)(ii). Moreover, the damages forwhich they are eligible to be compensated must be the direct result of the qualifying physical injury. Individuals other than those victims explicitly covered under Title IV, including family members of the defined class of victims, may have colorable legal causes of action in their own right. Under the clear language of the statute, those individuals are not part of the class entitled to receive "no fault" relief under the fund - however, they are not precluded from pursuing their claims in court. That should be made clear to the American public - by limiting the class entitled to relief under the fund, we did not preclude those outside the class from their day in court. Similarly, those who are within the defined class intended to be compensated are also free to choose to go to court rather than access the fund if they feel unduly restricted by the parameters of the claim process. Moreover, the intent in including a provision in the legislation that funds received from collateral sources be deducted from any award was not to unfairly penalize those who receive compensation to which they are entitled through insurance or otherwise. It was, however, to ensure that there is no duplication of compensation, regardless of the source. This is important to the administration of this unusual fund in order to ensure that there are adequate funds to be distributed to those in need. We must remember that the resources of the American taxpayer are not unlimited and truly they have responded very generously to these horrible events. It would be wrong to take undue advantage of their generosity by an increasing their burden exponentially beyond the defined parameters of the fund. As we all know, the fund was not created to give a windfall to these tragic victims, but rather to assist them in their time of need to get through the loss suffered at the hands of these terrorists. It goes without saying that this fund was not intended to be a boon certain classes of people who may opportunistically assist or represent the victims. And as noted above, due to the intervening criminal act of terrorists, this likely will be relief that these tragic victims may not receive as effectively or expeditiously through the normal legal process since in court their lawyers will be required to establish liability of entities other than the terrorists. Common sense parameters for the fund were necessary, clearly expressed in the language of the statute and need to be enforced. I urge you to adhere to the language and spirit of the statute and not be misguided by those that seek to expand the parameters of the fund's compensation, whether or not the effort is well intentioned. If you do not, we risk the possibility that many of those intended will not receive adequate, needed relief in a timely manner. It is clear that you face a herculean task of creating and administering this unusual fund and I have every confidence in your ability to do so. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." This horrible tragedy was unprecedented and affected people from all walks of American society. All the affected deserve our help. Your administration has recognized that a compassionate and effective response will entail making certain exceptions to general U.S. policy on eligibility for public benefits, such as making compensation available to undocumented aliens (and protecting their employers from prosecution should such individuals come forward). The husband a young 39 year old big breadwinning bond broker died in the WTC Sept. 11 tradgedy. He was only married for 1 year .(13 months.)No children.He left his wife a stock account and 2 real estate properties. He had $900,000 in life insurance which he named his 3 siblings and his Mom as the beneficiaries. The victim's wife received a smaller $100,000 policy. The policy's were purchased years ago.My understanding is that only the wife can make a claim under the victim's compensation fund for economic and non-economic losses. I assume the mother and siblings can not make a claim.Will the $900,000 in insurance proceeds penalize the widow's claim to the victim's compensation fund. She did not receive these insurance proceeds. They were divided among the 3 siblings and mom.This issue is dividing several families away from us as well. The assumption is that it should not penalize the widow because she did not benefit or participate in the $900,000 policy.Also, because the recieving beneficiaries are not in a position to make a claim against the fund because they are not the widow. It is hoped by all parties, that the Fund clearly spells out how this will be treated. I appreciate your review of this matter. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As the wife of a man whose office (WTC, floor, Suite ) was destroyed on September 11th, although he was not there and those who were in the office luckily escaped, I write to urge that the Fund providing compensation to individuals who were injured, or to relatives of those who were killed, as a result of the events of September 11th be given to partners and defacto children of common law marriages and lesbian/gay partnerships as well as to the "legally" married. We are acutely aware that in New York City and in the WTC towers there were a LARGE number of "non-traditional families represented, including partnerships, both gay and lesbian, of over 15 , even 30 years duration. These people are devastated, as is everyone else, and they have even fewer social supports than many of the rest of us to fall back on. Please include them in your financial assistance and counseling help EQUALLY with others of more traditional family persuasion. It is not hard to determine if a partnership is enduring. All of these people have social friends and possibly churches or other groups who can come forward to testify (or not) as to the nature and length of the partener ship. I do not feel it is the governments place to try to make everyone feel better about their plight. What make s the survivors any different from those who lose a loved one on the way to work any other day by any other means? What sort of precedent will this set? If the effort is one to stop law suites against the airlines of FAA, it ought to be told to the victims the result of said lawsuits. The result would be either fewer airlines willing to fly, or airlines requiring VERY stringent security measures before entering an airport. How would they react to everyone being subjected to a strip search in order to get on an airplane? Would that not be a reasonable response by the airlines still willing to fly? If not, they'll just tell the victims to get wherever they want by other means, and what would they say. In any case, I want it known that I object to my tax dollars being used to compensate people that did not plan ahead. We ALL should have adequate life insurance, accident insurance, mortgage protection etc. For those of us who DO plan ahead for our families, bravo. For those who do not, shame on you.
