Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Wednesday, March 13, 2002 5:34 PM Presumed Loss Calculations Dear Sir: I am a certified public accountant who is involved in advising some of the families of the September 11th attacks. I have reviewed the final regulations with respect to the Victim Compensation Fund, issued by the Department of Justice on March 7, 2002. I have developed a model to determine economic loss based on the Department's recently issued, Explanation of Process for Computing Presumed Economic Loss. I would expect that using the explanation and the accompanying tables I should be able to replicate the calculation of the amounts reflected in the revised tables of Presumed Economic and Non-Economic Loss. As a test case, I tried to calculate the presumed loss of a married decedent with one dependent who was 30 years old and earned $100,000 at the time of death. Unfortunately, I have not been able to come close to the amounts in the Table. My calculation of combined economic and non-economic loss totals $3,992,028 compared to $3,007,608 as reflected in the table, representing a difference of $964,420. I have reviewed my calculations as well as the DOJ Explanation and the accompanying tables to no avail. This is very perplexing. Obviously, I have misinterpreted something somewhere, but I am at a loss as to where. I would ask that you please provide an example illustrating how the presumed economic losses were determined. My son ,a married firefighter with seven months on the FDNY, because his surviving spouse will receive a pension, life insurance benefits, federal line of duty public officers benefits, etc. will not be compensated for her loss. In fact,it would seem that she would owe the government money because of the aforementioned benefits which were a part of his employment agreement. So my son's life, in the governments eyes, is worth nothing, because he was thinking of his spouses future by taking out a life insurance policy etc. Should someone that purchases flight insurance before flying be penalized if the plane crashes and their survivor collects on his policy? December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We write to comment on the Interim Rules adopted, effective December 21, 2001. There are several aspects of the Interim Rules which we believe do not carry out the letter and intent of the Act (Title IV of Public Law 107-42), but we wish to focus on one particular aspect of the Interim Rules which we believe to be clearly contrary to the Act and unfair to out client and others similarly situated. Our client's husband who was killed at the World Trade Center by the highjacked airplane was a relatively young man, age 42, and earning $1.1 million a year as a stockbroker. In addition to his wife, he left four minor children ranging in age from 11 months to 14 years. The Interim Rules and the Special Master's comments indicate that, absent undefined "extraordinary circumstances" the economic loss award will be limited by capping annual incomes up to but not beyond the 98th percentile of individual income in the United States for the year 2000" (§104.43). The Table of Presumed Economic and Noneconomic Loss ("Table") indicates that the 98th percentile is $231,000 for the year 2000 and computes the highest economic loss based on an income of $225,000. There is no basis in the Act for limiting the economic loss awards by capping the annual compensation level at $225,000. The Act contains no limitation on the amount of annual income to be taken into account in determining the "pecuniary loss." In defining " economic loss," §402(5) of the Act refers to "pecuniary loss...including the loss of earnings or others benefits related to employment...to the extent recovery for such loss is allowed under applicable State law." The law of the State of New York, for instance, contains no limitation on earnings in determining the "pecuniary injuries" to the distributees of a wrongful death victim (EPTL §5- 4.3). Particularly in light of the offset for collateral source payments, such as life insurance (which is not an offset in a New York wrongful death action), it is unjust and contrary to the Act to limit the economic loss award by capping annual earnings at the $225,000 level. Surely, Congress did not intend to penalize and discriminate against a deceased victim's dependents because their husband and father was successful in his gainful employment. We request that $104.43 of the Interim Rules and related reference be modified to remove the limitation on annual incomes being considered up to but not beyond the 98th percentile and that the Table be modified accordingly. El padre de mi hija se había casado nuevamente, por lo que en el momento del atentado tenía otro representante personal. En la actualidad, no tengo idea de cuál es el tipo de acción que su nueva esposa va a tomar. Generalmente, me dejaba llevar por el listado de personas que habian reclamado hasta el momento para entonces así, poder tener conocimiento a qué tipo de acción mi hija hiba a ser parte y poder reclamar lo que en ley le pertenece; dado el caso de que solo es una reclamación por victima. Lamentablemente, se pide ahora un "password" para poder accesar a la lista, el cual yo no tengo. Mi comentario con relación a la ley es el siguiente: Según la Ley del Fondo de Compensación a las Victimas de septiembre 11 de 2001, se creó un reglamento anexo donde se establece lo siguiente:"... para que las compensaciones fueran rápidas, sin que las victimas tuvieran que lidiar con burocracia ni presiones innecesarias".Además, para que las victimas no tuvieran que entrar en litigios, donde gastarían mucho dinero. En otra parte el reglamento señala: "proporcionar una compensación justa y apropiada teniendo en cuenta las circunstancias particulares de los reclamantes". Resulta irónico que si en su exposición, la ley justifica su creación para evitar litigios angustiosos, largos y costosos, entonces solo permita el que se haga una sola reclamación por victima, si eventualmente los familiares de las victimas van a entrar en litigios para defender sus derechos. Vivimos en el siglo 21, donde las personas se divocian dejando hijos con un primer matrimonio y teniendo mas hijos con otros matrimonios. Todos esos hijos tienen o deben tener el mismo derecho ante la ley, sin tener que esperar por un representante personal a que se decida por que acción quiere tomar. En mi caso en particular, mi hija es la mayor de 3 hijas que tuvo la victima. La primera nieta y la hermana mayor, es ridículo que tenga que esperar por una persona llamada "representante personal" para reclamar lo que por derecho le corresponde. Mi sugerencia :"Permitir que todas las partes tengan el mismo derecho a reclamar, no solamente el representante personal, ya que ello implica que tienen que esperar a que el mismo se decida por cuál acción tomar, sino que la parte que desee acogerse a la compensación pueda hacerlo, aún si el representante personal quisiera demandar. Cualquiera que fuera el caso es lo mismo, porque si demandan, ya el gobierno impuso cierto limite para pagar y si se acogen a la compensación tambien. Tuesday, March 19, 2002 1:58 PM discrimination against gay and lesbian victims I am disturbed and upset that there is even a DEBATE about whether or not to fully and equally compensate the partners of gay and lesbian victims of the Septermber 11th attacks. The co-pilot of the pentagon flight, a NY fire dept. chaplain, one of the brave men who helped to down the Penn. flight: all died as true national heros. All were gay. Why is there even a DEBATE about whether or not to compensate their partners just as we compensate heterosexual partners? Probably hundreds of gay and lesbian people died on September 11th. Let's not embarass ourselves for all time by DEBATING about whether or not to care for our departed lesbian and gay brothers and sisters and their families. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
