As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." The "consumption factor" is an estimate of income that the victim would have personally consumed ordinarily during his or her work life. The consumption factors vary based on household size. Does this mean the victims household size at date of death, or the household size that is reasonably foreseeable? For instance, if the wife of a victim was pregnant at the time of the victims death and a child was born eight months later, I assume that this child would be included in the victims household size. To do otherwise would not take into consideration the fact that the victim would be spending money on this child that he therefore could not have spent on himself. The fact of the birth of this child lowers the amount that the victim could have personally consumed during his working life. The child must be recognized as being a part of the victims household even if he or she was not yet born on September 11. To not recognize that the victims future included this child would be unconscionable. Likewise, if a victim were engaged to be married it would be unfai to not respect the victims promise to wed. His future household would include a spouse and his "consumption factor" should reflect the fact that he would be spending money on his spouse and thus lowering the amount that he could have personally consumed during his working life. The fact that a person is engaged to be married can be verified by testimony as well as be evidence of contracts or correspondence with wedding service providers and guest lists and other paperwork that was prepared by the victim prior to death. To assume a victim that was engaged to be married would have a household size of "one" is dishonoring the victims clear intent and promise to wed. November 8, 2001 Re: Victims Compensation Fund While everyone realizes no amount of compensation can replace a loved one, we must also realize we do not live in a perfect world and bad things will happen along with the good things in life. On Sept. 11 we saw one of the worst things in life occur. Now what do we do? We have seen over the past several weeks since that terrible day how the great resources of this country-its people-react with the outpouring of love and unity along with billions of dollars for aid to the victims and their families but is this enough? NO! Now it is time for us to step forward with the aid of our government and our tax dollars with additional help where needed and thus the need for and the reason for this fund. Unfortunately, it is also a time when the greedy and the unscrupulous will step forward for their personal gain. One of the major task of the program administrators will be to see that this group is held in check. How do they do that -I do not know. How do you reach a fair and just compensation that would be "right" for everyone, you can't. I would just like to make the following comments and ask that God Bless you in this tremendous task. First, let's consider that all funds involved, funds already provided from various charitable gifts and the tax dollars which will create this fund, are coming from fellow citizens. I think each citizen would want as much of each dollar to go directly to the victims and/or their immediate family as possible. Thus, number one priority should be to keep the expense operating this fund to a very minimum. Being a government program, I realize this will be a different approach from the norm but I challenge you to please attempt same. A starting point would be to administer this program as a complete and final step re compensation. In order to accomplish this, I feel the Attorney General should request from Congress, and receive, permission to make the final offer and there would be no appeal of any type from anyone. This method would also keep the lawyers out of the picture and thus 100% of the compensation would go to the victims and at a much faster pace. Second, when trying to determine amount for each victim, again the funds from charitable gifts and tax dollars of this fund should be considered as these are the dollars made available from the citizens for this purpose. However, any life insurance (other than workers compensation), pensions, and other funds of this type should not be considered as these funds would come from each individuals efforts to provide security and protection for his family. Also, when trying to determine the amount, let's be realistic and not emotional as the purpose should be to make these families whole (financially) but not to use this tragedy to enrich them beyond where they could have expected to reach had the tragedy not occurred. Third, let's be sure to look after the children! Set up some type of educational fund that will be available for each child to continue their education beyond high school, be it college or a trade school. These funds should not be made available until the child enters the educational facility and then paid directly to the school so that the funds would be used for their intent and not misused. Finally, the difficult task of seeing that the families of all victims received aid from this fund in a fair manner will be very difficult. However, I feel confident that you will have the personnel available to accomplish same and thus help the families "look to the future" with as little hardship as possible. The above section of this letter was written in "rough draft" before I left my office yesterday afternoon. When I got home last night and was reading the newspaper, I read the attached article. I think it points out the major problem that you will face - lawyers afraid that this method will erode much of the position they have created over the years past. I even stopped to ask myself if maybe the "rights of the public" the "individual freedoms" and other areas that our justice system has created could also be partially to blame for this terrible act in that business are afraid to maintain tight security in some areas because that would infringe on individual rights and freedoms and thus put them in the position of being sued? This is getting into another area which I will not address at this time. In closing, I would say that I agree with the proponents ideas in the attached article by Mr. Glaberson. I can see a more fair system being created with the only ones being less compensated being the lawyers who are not victims in this tragedy so why should they reduce the financial aid to the true victims with their tremendous fees? Let us help the ones who need our help. We have taken a giant step forward with billions of dollars being made available - please get it to those in need as a result of this tragedy. Monday, March 11, 2002 10:54 AM Fair distribution of survivor benefits I am writing to express my outrage at the hypocritical statement of Kenneth Feinberg, the head of the September 11th Victim's Fund, on "Meet The Press" this weekend which stated that lesbian and gay survivors of victims of the September 11 attacks would be "left out of my program to the extent that their own state does not include them." Feinberg is willing to compensate the families of illegal aliens, effectively saying that simply because they are not US citizens does not mean that these people didn't lose a precious family member in this tragedy. But in the same breath, he excludes lesbian and gay US citizens from the same compassion. Lesbian and gay people are full citizens of this country and deserve to be treated as such. One of our own, &nbsp&nbsp&nbsp&nbsp , has been lionized as a hero for his role in the crash of the jet in western Pennsylvania. But if he had a domestic partner, someone whom he would have married had the US government recognized the sanctity of his relationship, I guess that man would have to be satisfied with press clippings and sound bites, while his heterosexual peers, even the illegal aliens among them, were being compensated financially for lost wages and pain.
