I understand that the rational behind this is to come up with a reasonable compensation figure t o use as a starting point. Using the average of three years would likely iron out any aberrations caused by large increases or decreases in a particular year. I agree with the goal, but I see two major problems its application under the interim rules: 1. In the case of some workers, there have been major promotions and additional job responsibilities taken on that render the earlier years much less applicable. For example, if a young worker was an inexperienced employee in 1998 paid at a salary of say $45,000 per year. Yet, he spends the next three years learning job skills and attaining confidence of his employer and increases in responsibility and compensation and his salary moves to $60,000 in 1999, $80,000 in 2000 and $100,000 in 2001. How is the 1998 compensation figure relevant? Would this person every go back to his state of inexperience during his projected work life? Are the large increases in pay an aberration or does the $100,000 level constitute a base for which future increases will be added? It would seem to me that in a situation like this the 2001 compensation level should be given the most weight, yet under the interim rules it is not even considered. 2. Even if you do (wrongly) decide to use the three years 1998 through 2000 as a starting place, that figure gives a snapshot of an average compensation figure for the victim for mid-year 1999. Since death occurred in September of 2001 this figure should at least receive an adjustment to get it to September 2001. Using your figures this would be one and a half years at 6.6 percent for those under 30, 5.1 percent for those aged 31-50, and 4.2 percent for those over 50. To do otherwise would be to have a starting place that doesn't even reflect keeping up with inflation. Thank you for considering the above. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, March 19, 2002 10:44 PM "...WITH LIBERTY AND JUSTICE FOR ALL" Being an loyal American, a tax payer, a registered voter, a Christian, a homeowner, a career professional, a contributor to worthy causes, a loving son, brother and uncle and a human being, I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. The only difference between myself and the majority of American men is that I am gay American. The only reason why these benefits are in question is because we, as gay men and lesbian women, have no laws that acknowledge or validate our commitments as couples and loving human beings. We suffer the loss of a loved one just as strongly as a heterosexual man or woman. We are affected with the same financial and legal problems. Point being, we are the same. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our gay and lesbian heroes to inspire others. However, when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance. It seems that some American heroes are now more equal than others. In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made it clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. This is not acceptable to me as an American. Even fetuses and illegal aliens will be receiving benefits under this program. They have even promised to overlook Federal Law and not arrest or deport the families of illegal aliens. Nor will they punish American companies that hired these illegals in violation of Federal Labor Laws. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, - who died in the line of duty when the first tower fell, - who was of the plane that crashed into the (there are many more) - we are told the law is the law and no exceptions can be made. Then WHY are exceptions being made to fetuses who some people believe (and I'm not one of them) that they are not human beings until birth. WHY are exceptions being made to Illegal Aliens? They are not Americans. They have not paid taxes. They have not contributed to the American Dream. They HAVE abused the system for financial gain. Why should we allow them to 'again' obtain financial gain when gay men and lesbian women, who have paid their dues, are denied this privilege? And Yes, I do consider it to be a Privilege. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, March 12, 2002 12:28 AM 911 Fund I have just read information which indicates that the fund will pay compensation to straight illegal aliens but that gay families are having their back turned upon them by our government. This is morally wrong. Gay people do not want special rights just the same rights as heterosexuals. Gay families who lost a loved one deserve nothing less than their counterparts. I would hope the Bush administration and attorney general's office do the right thing and treat gay families and partners like everyone else. Please do not compound this tragedy by doing such a grave injustice. If this is allowed to stand, I can't tell you how disappointed I will be in my government for doing this. The ACLU urges the Attorney General to make the Fund available to same-sex partners of deceased victims. Unless the Attorney General takes that step, same-sex partners will have no choice but to have the courts apply the authorizing statue's choice of law rule to order relief under the laws of states that recognize the right of a same-sex partner to recover for the death of his or her partner. The purpose of the September 11th Fund is to provide victims of the September 11th terrorist attacks with the ability to recover relatively quick and certain compensation from the government in exchange for a waiver of claims they might otherwise have against the airlines or other entities that may have been negligent or otherwise culpable in the hours, days, or weeks leading up to the attacks. To encourage the maximum number of potential claimants to elect compensation through the Fund instead of through the courts, the Fund must be designed to ensure that all potential claimants who could recover in court could also recover through the Fund. One action the Department can take to encourage the maximum number of potential claimants to elect compensation through the Fund rather than through the courts is to ensure that the regulations implementing the Fund recognize same-sex partners of decedents or injured parties as potential beneficiaries of the Fund. Failure to do this could have far-reaching ripple effects: For every individual who cannot recover for his or her loss through the Fund, at least one more piece of litigation will likely result in the courts. Same-sex partnes, if excluded from the scope of the Fund, could pursue litigation based on the laws of many states, including states whose laws already do or are likely to recognize same-sex relationships. The Fund's authorizing legislation provides that anyone electing to seek compensation in court, as opposed to through the Fund, must bring suit in the United States District Court for the Southern District of New York. See Section 408(b)(3). However, the legislation also provides that the "substantive law for decision in any such suit shall be derived from the law, including choice of law principles, of the State in which the crash occured...." Section 408(b)(2) (emphasis added). While the crashes occurred in New York, Pennsylvania, and Virginia, the choice of law rules of those states could easily result in the application of other states' law to the disputes. For example, the law of Massachusetts or New Jersey could apply, since the planes took off from Boston and Newark as well as Dulles, The law of Washington state could apply, since some of the planes were manufactured and fitted with inadequate cockpit doors there. And the law of a variety of other states, including California, could apply, since machines such as the x-ray machines used to examine luggage or metal detectors used to screen people prior to boarding the planes were likely manufactured in many different locales. Thus the law of at least five states, but most likely that of many more states, may ultimately determine who can sue to recover for the losses occuring on September 11th. These states include New Jersey, whose law would allow a same-sex partner to recover for the death of his or her partner, and California, which has provided the same rights through case law and statute. In addition, if same-sex partners are excluded from recovery through the Fund, they will have no choice but to pursue what we believe will be powerful state and federal constitutional attacks on any state laws that would exclude them from recovery by failing to recognize their committed relationships with the deceased. For the foregoing reasons, the ACLU urges the Attorney General to redue the likelihood of what could be a new flood of litigation by ensuring that same-sex partners of victims of September 11th be eligible for recovery through the Fund. Monday, January 21, 2002 5:03 PM Suggestions Minimum Award and Non-Economic Losses No victim's family should receive zero from the Victim's Compensation Fund. A substantial minimum amount should be established for all applicants and this amount should be known up front before the decision is made whether to forgo third party litigation. The present arrangement defies logic and common courtesy. Commentators have indicated that the proposed amounts for non-economic losses are too low. Therefore I believe that the amounts proposed for non-economic losses be doubled to $500,000 for each decedent and $100,000 for each of the victims spouse and dependents. This aggregate amount would then constitute the minimum amount to be received by a participant in the Fund. For example the minimum amount for a widow with two children would be $800,000 ($500,000 for the decedent plus $300,000 for the wife and two children). There would be no deductions from this minimum amount for anything. Hopefully these changes will eliminate some of the current frustration with the Fund. Widows should not have to wear their wedding rings on chains around their necks to indicate that they will get "0" from the Fund. My proposal is simple and straight-forward. It is easy to determine up front what the minimum amount will be. Like regular awards from the Fund this minimum amount should also be free of Federal and State taxes. Other Comments The final rules should contain examples of the present value compuations of selected collateral assets. Particularly the time periods. If my suggesions about a minimum award as discussed above are not adopted then I suggest that the amount of collateral assets that are deducted be capped at $250,000. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
