As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. As I understand the program, you are further punishing my deceased husband because he was a good provider and a responsible father by making sure he had life insurance so that his family would be taken care of. Life insurance, pension funds and death benefit programs, which all people have an option to purchase and work hard to pay for, should not be included in "collateral sources" within the victims compensation fund. People make sacrifices to contribute to these additional benefits either through employee programs or personal plans and they should not be penalized by our government for their sacrifices and their desire to do what is best for their families. Who in our government or our society has the wisdom and/or the audacity to determine that the value of my husband's life is less than any other person present at the World Trade Center on that awful Tuesday morning, which has changed my family's life forever, simply because he took action to properly care for us? Who will explain to my young children as they grow up without him, that for all the flag-waving and use of the term hero, the American government and its citizens believed their father's life was worth less that that of another person because he took care of them? I have already been disappointed by the lack of assistance received from the various organizations which have raised millions on behalf of the World Trade Center victims and their families. I hope that I will not also be disappointed by the response of my government and its citizens to help ALL the victims of the World Trade Center attack EQUALLY, as each of these people died equally, for and because of their country. My suggestions -- do not include life insurance, pension funds and death benefit programs as collateral sources. Treat each victim equally -- as each has died equally. Zwick, Director Office of Management Programs Re: Sept 11 Victim Compensation Fund Discriminates Against Gays and their Families I was quite enraged to learn that Kenneth Feinberg has stated that gay partners of the victims of Sept 11 will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. Sept 11 ushered in a new era of American compassion. "We are all New Yorkers," was a common sentiment. The sense of the united "American family" emerged. Some gay people were not simply victims of the Sept 11 events but were heroes; some such heroes were honored by members of the US Congress for their courageous deeds to, for instance, divert Flight 93 from crashing into the United States Capitol. Now six months later such Americans are officially being declared a lesser kind of hero because they were gay. DISCRIMINATION IS UN-AMERICAN. It is love that makes a family and respect which makes a democracy. Tuesday, January 08, 2002 12:29 AM The value of a Soldier's life Editor: With the events of 11-September, we often heard that the Emergency Service Personnel (Police, Fire, EMS, etc.) are the Domestic Infantry of the United States. This past week , a member of the U.S. Military, was killed in action in Afghanistan as an infantryman in the international war on terror. I wonder if the Victim?s Compensation Fund and the other charitable organizations set up in the aftermath of September 11th will value his ultimate sacrifice with the same economic value as that of the other victims of September 11th. Or, will his survivors be given the standard military lump sum payment of $25,000 with burial expenses, perpetual grave care at Arlington and a flag to take home? To discount the value of his life, or that of any member of the US Military, by saying ?he/she knew it was a dangerous job? fails to understand that every member the Emergency Services (FDNY, NYPD, etc) also knows that they are paid to go in harms way. The loss of both lives should be valued equally. Therefore, the Victims Compensation Fund should distribute any and all economic aid to the survivors of those killed in the line of military duty with equality just as they would to a civilian Pentagon or NY Fire Department victim. This means that the children of any member of the military killed in action should get college tuition paid for, be eligible for the lump sum payments made as well as have a tax-free pension for life as is already available to the survivors of fire and police victims. This would be fair under the Victims Compensation Fund and also honor the spirit in which everyone contributed to the charities of 11-September. Finally, let us hope that as we fight this war on terror we keep those offering the ultimate sacrifice, like , to a minimum. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Monday, March 18, 2002 3:29 PM compensation discrimination To whom it may concern; I was very distressed and angered to hear that the government is planning to blatantly discriminate against the families of gay and lesbian victims of the 9/11 tragedy via the compensation fund. It is a grave injustice that needs to be addressed. A family is not necessarily determined by blood or by marriage, but rather by who stands by you, nurtures and supports you, throughout your life. Is the suffering of a gay or lesbian person following the loss of a life partner somehow less because they lacked a contract with their state declaring the official status of their relationship? Considering that they are unable to legally obtain that document due to more misinformed discrimination, this seems a very flimsy premise on which to carry out further discrimination. Gay and lesbian people pay taxes just like everyone else, so money derived from tax funds includes contributions from lesbians and gays. If gays and lesbians are unable to benefit from the same fund, they should be able to designate their taxes to benefit other organizations that would more equitably distribute the funds. Please consider the precedent this is setting: you are saying that gay and lesbian citizens do not deserve the same rights as everyone else. This is absolutely unacceptable to me and flies in the face of what this country is supposed to represent. This is a policy more in line with the Taliban than a progressive nation.
