Expediting relief is the key
As long as the federal government's guidelines for providing compensation for the 9/11 victims and their families are unclear or undecided, charities are frozen out and donors are discouraged. The victims and families are left waiting, compounding the tragedy. We need to move ahead quickly.
If the federal government is to play a meaningful role in providing relief for the victims, it must be the FIRST line of defense, as FEMA most commonly is during any other major disaster.
The federal government should seek out and compensate victims as quickly as possible. Then, if charities subsequently choose to provide additional benefits to victims as they see the need, it is none of the federal government's concern.
Consistent with being the first line of defense (after insurance and pensions), the government should commit to paying for all or for a generous and specific portion of a range of expenses that all victims and their families are likely to incur. And especially because so much time has already passed, the federal government must be very clear about what will and will not be compensated. For example, the government could publish a schedule for funeral expenses. If these have already been paid by a charity, then the charity should be reimbursed.
Develop a list of all losses and expenses to be compensated, and pay on all of them. Then let the charities fill in the holes.
I urge you not to wait even one more day to develop and publish these guidelines.
Congress acted expeditiously in passing legislation authorizing this compensation. The Executive Branch should not procrastinate any longer to alleviate the suffering. You should resolve to process claims and cut checks to every known victim and family before the end of the year, and act immediately to do whatever is necessary to make that happen.

Dear Mr. Zwick:
I am writing in response to the Department's November 5, 2001 request for public comments
regarding the Department's
forthcoming regulations for the implementing and administering the "September 11 Victim
Compensation Fund" established by the
Air Transportation Safety and System Stabilization Act ("the Act"). As that Act makes clear, the
purpose of the Fund is to
provide compensation to any persons who were physically injured in the September 11 terrorist
attacks as well as to the surviving "relatives" of those who died.
We strongly urge the Department to promulgate regulations ensuring that compensation is
available to all surviving family
members of those killed, including the committed partners and the non-biological children of gay
and lesbian victims. Just as
the terrorists drew no lines in killing people, our country must draw no lines in compensating
those who suffered the most
personal of losses from these horrific deaths. in promulgating its regulations, the Department
should look not to legal
formalities that may define relatives or families for purpose of other laws, but rather to the
realities of the lives of those who
were killed and those who loved and were dependent on them.
Indeed, it is clear from the Act that it is precisely the approach the Department must take in
administering the Fund. The Act
specifically identifies a number of "economic" and "non-economic" losses for which
compensation is to be awarded from the
Fund. These include burial costs, loss of earnings, physical and emotional pain, suffering, mental
anguish, and loss of society
and companionship. It is unquestionable that the survivors of those killed on September 11
suffered these types of losses
regardless of their sexual orientation or marital status or their formal legal relationship to the
deceased. Indeed, grief and
economic loss know no such boundaries. The emotional devastation and economic loss caused
by the death of one's partner
is not any less because that person was the same sex as the survivor. A child's anguishing loss of
a parent is not any less
because there was no biologic tie. Since the purpose of the Fund is to compensate survivors
precisely for the types of losses
suffered by family members of those killed, the Department's regulations should not and indeed
cannot properly exclude
anyone who was a family member in fact.
In the immediate aftermath of the September 11 tragedies, as various victim-relief funds were
being established, some on the
extreme radical right criticized relief agencies that had made clear that their intent to make funds
available to assist not only
surviving married spouses of the persons killed in the attacks but also the surviving partners of
gay men and lesbians who had
been killed. These cruel and reprehensible calls for the exclusion of gay and lesbian families
from the relief efforts have been
accompanied by claims that the effort to provide relief to all who have suffered is somehow a
push for a so-called "gay
agenda." However, the determination of who was actually victimized by the September 11
attacks, of those actually suffered
loss, of who actually is grieving, it is not about advancing some alleged political "agenda." What
is at issue here is a human
tragedy of unimaginable horror and dimension and about the fair and humane treatment of all
who have personally suffered
from the acts of the terrorists.
Many gay and lesbian Americans lost their lives on September 11. Many of them left behind
loved ones, including partners
and children whose lives were intertwined with theirs and who were dependent on them for
financial as well as emotional
support. A number of them are known to have engaged in heroic acts that day, and they have
been praised as national
heroes. It would be an insult not only to those heroes, but to all who died on that tragic day, for
the Department to draw
artificial lines defining loss and grief. In fact, it would be unconscionable. We urge that the
Department's regulations reflect
these concerns.

Inclusive Compensation Package
Dear Mr.Zwick:
I am writing to you to urge you to create an inclusive compensation package for the families of those who suffered in the attacks of September 11th. An inclusive package should include the families and life partners of gay and lesbian Americans. There were many gay and lesbian victims on September 11th, including , one of the heroes of the plane which crashed in Pa. America is for everyone, white and black, male and female, gay and straight. We are grieving tremendously and in so much pain from the loss of our
loved ones, and this is how he treats us. Does he realize that the
government is the one that messed up? If it wasn't for our idiotic
government and intelligence, this could have been prevented. IT'S
THERE FAULT. I BLAME THEM. DIDN'T THEY LEARN FROM THE 1993 BOMBING,
OR THE ATTACK ON THE COLE. Oh, all of a sudden, the gov't is waking
up. Too late, too many lives were killed this time. Don't you just
love our wonderful country?
     can keep his money. My father's life is worth much more
than what he's offering. Maybe the only way to get      to realize
this, is that if one of his children was killed in that building, by
being trapped on a floor filled with smoke, knowing that they were
going to die. How would that make him feel? I don't think
$1.6 million dollars, plus everything that's being deducted from that
figure, would make him too happy.
Please, please pass this on to him. I pray to God that he will pay
for this cold hearted decision and regret it everyday for the rest of
his miserable life!!!!!!!!!!

I am writing to ask for your support for the National Gay and Lesbian Task
Force's position regarding disbursement of monies from the September 11
Fund. I agree with the statements they made in their letter of November 21,
2001 emphasizing the need for the Department of Justice to "include among
relatives eligible for compensation those who lost their life partners or de
facto parents or children, regardless of sexual orientation and marital
status."
The horrific loss of loved ones to a random terrorist act should not be
compounded by our own government denying survivors whatever benefits may be
available simply because we fail to have laws to protect all of our
citizens.

Victims Compensation Fund Complaint
Mr. Feinberg,
My family and I lost my brother,      , in the terrorist attacks
on September 11th. I'm writing to you today in response to the limitations
you have set on the Victims Compensation Fund.
My sister-in-law and nephew,      wife and 4 1/2 month old son, will
receive little or no compensation under the current tables! This is
extremely unfair and changes need to be made to the current tables. There
should be no cap of yearly earning potential, and you should use up-to-date
New York statistics in order to calculate their lifetime earnings!
An increase needs to be made to the non-economic damages as well. The
current tables for the Fund is absolute insult to all of the families who
lost a loved one on September 11th. My brother, as well as the other
thousands of innocent people that were there, didn't deserve to die like
that. The least our government can do now is take care of the families.
You were all very quick to protect the airlines - what about these families?
The United States is always very quick to protect everyone else - how about
this time we protect our own people! Thousands of families have been left
without lifetime providers... it's time for the government to step up to the
plate and provide for them.
I cannot speak for the other innocent victims - but I can speak personally
for my brother... on September 11th our family lost a very kind, caring,
intelligent person and our lives will never be the same. My nephew was 10
days old when his father was taken away from him - and now he will never
have the chance to really know him except through stories from our family.
     would have been a wonderful father and my nephew will never be able to
experience that now. And when the day comes when he asks me "WHY?" - What
should I say? I ask myself that everyday. Do you know why?
You know      isn't just a name - he was a person and he was
     husband,      son,      brother and most importantly
     father!
Change the current tables - don't put these families through any more pain!

Dear Attorney General Ashcroft,
The deaths on September 11th were the result of an attack on America.
Please do not discriminate against the unmarried partners of September
11th victims. All unmarried partners, gay or straight, young and old and
their dependents should be eligible for compensation.

Equal Rights for Equal People!!!!!

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
Sept. 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the Sept. 11 attacks. Since
then, lesbian and gay surviving partners of those killed have had mixed
results in obtaining equal treatment at the local level in the distribution
of relief funds by private and state agencies. An inclusive policy on the
part of the federal government would help establish an important principle
for other such funds. In compensating victims, real justice will be served
only when all families - and all types of families - impacted by the human
rights tragedy of Sept. 11 are treated with dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you

Help same sex partners of terrorist victims
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.
This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones as do
other survivors, and their need for assistance is just as great.
Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions. They are interested in a political
victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should
do the same.

Dear Mr. Zwick,
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.
