As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Wednesday, January 23, 2002 2:34 PM Twelve of my friends and former colleagues were lost at the World Trade Center. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." As things stand now, the airlines essentially get bailed out at the expense of the human victims of the tragedy. The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private funds available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the Victim Compensation Fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ seems to have ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. Importantly, the interim final regulations appear to arbitrarily ignore a victim's income to the extent that it exceeds $231,000 a year. The income cap would result in some families receiving compensation for less than 25% of their actual economic losses, despite the Act calling for consideration of ?the extent of the harm to the claimant, including any economic and noneconomic losses.? The cap would produce truly bizarre results that are surely not the intent of the Congress: a 40-year old earning a seven-figure income would be awarded substantially LESS money than a 30-year old earning $230,000 ? despite the fact that the 40-year old would have greatly out-earned the 30-year old over the course of the respective remaining working lives. (This results from the 40-year old?s income being capped at $231,000 for the purposes of the award, but having 10 fewer years of assumed remaining working life.) Again, Congress wanted to provide compensation for actual economic loss?there is simply no mention, or even hint, of a income-based cap in the Act. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. How can we choose to offer funds to those who are here in this country illegally & breaking our laws when we can't even honor our own country men & women? If September 11 has taught us anything, it's that our patriotism and love of country transcended our differences and united us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. He leaves behind a wife, 2 children under 3 yrs of age, his parents, brother and sister. Our comments are outlined below: - deductions of life insurance, SS benefits and pension. -- SHOULD NOT BE - The 250K non-economic component -- TOO LOW - ensuring the welfare of the children -- MUST BE DONE by making sure that a trust is set up for the children of the victims, and part of the total compensation should go DIRECTLY to the children so that no one can touch it EXCEPT for the children when they become an adult. - taking care of immediate family members who are not next of kin, particularly parents -- MUST BE DONE. The numbers that are being offered in this plan is like putting 2 carrots on a stick, and when the deduction is taken into effect, the only thing remaining is the string and the stick. The plan has to be to remove deductions, increase the 250K non-economic component, ensure the welfare of the children and spouses left behind to struggle for themselves, and take care of other immediate family members who are dealing with the pain and suffering in the loss of their child. Tuesday, November 27, 2001 6:34 PM General support First of all I would like to thank the DOJ for encouraging the use of email as a way to submit public comments on the issue of victim compensation after the tragic Sept. 11 attack. I am writing to urge your department to write the regulations to carry out the intent and spirit of the law by compensating all of those who suffered both grievous emotional loss from these murders, and significant financial loss as well. I believe that the federal government should provide such compensation as is appropriate to all of those who had a close relationship with the murdered victim and whose own financial position will be seriously adversely affected by the death. Relevant indicators of such a relationship include a shared residence, shared bank accounts for other financial instruments, joint membership in a health plan, a significant sharing of living expenses, etc. Obviously a wide range of different personal relationships will be covered by this, and we believe that this coverage is wholly appropriate in this instance. All of the lives lost on September 11 were precious . . . no matter what their status in life, all are equal in death. . . On a personal note: As a New Yorker, and a citizen of the United States of America, I am appalled by this. I am directly affected by this tragedy, having lost a family member and at work. I work in One Liberty Plaza, on the west side of the building and have to look everyday at what once was the World Trade Center. Not a day goes by when I dont feel the loss . . . of family, friends, all New Yorkers and a way of life. It saddens me to think that the generosity of a nation has restrictions on it and families of those lost should not be penalized for it or for making a decent living while they were alive. Everyone lost should be treated equally! In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King, "Every death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families. There should be no compromise about that ever." Saturday, November 24, 2001 11:08 PM response to notice for Public Comment November 23, 2001 Widowed as a result of the 9/11 attacks This letter is in response to "Justice Dept. Invites Public Comment" notice but it is also written as a response to the many other letters I have read on this site. It seems to me that very few of the respondents have been directly affected in any way by this and more often than not the comments have been both hurtful and disheartening. To read responses that speak about how this should not be a "lottery windfall" or "who is to say they will not get all the money and then remarry" is heartless and cruel. And other responses are down right incorrect in terms of how much there is available out there from the charities - at least at this point although I have gotten some much needed assistance, but there is by no means an over abundance. There are issues at hand about our family's and other families futures and many that I speak with are worried. Not only have I and others not gotten as much money as others out there seem to imagine there is, but the red tape to get anything is enormously complicated. I personally will be cut off of health insurance for me and my family after the birth of this (our third) child and I will need to find and incurr the expense of health insurance. In addition, my husband and I were shopping for a used mini van as we can not fit three car seats into the car we now use, but I do not know about fixing cars (my husband did) and I will not take on a used car. So now I will buy a new one for more money then we had anticpated spending. For those things my husband did around the house, such as the lawn work and fixing things and fixing-up most anything that needed to be attended to, I now have to hire others and pay for their services. My child care situation needs to be looked at. With two 2 and 1/2 year old twins and an infant soon to be born, I feel that I will need help in the house whether I stay home or not and if I go back to work (I am on a one year absence at this time since 9/11) I will certainly need a live in. To get a live in I need to renovate the basement so that this person has a room to stay in. And by the way, I work part time and was not eligible for health insurance nor did I make a substantial income; It was enough to pay for the child care, food bills, and special occasasion gifts. I didn't ask for this and I am terrified about these expenses, I have been at this point afraid to spend money except for what is absolutely necessary for bills. I should not have to worry about any of this now or ever. My living expenses have already increased and the principle breadwinner in the family is gone. I and all other victims should be compensated enough so that we do not have to worry, so that we can give our children the life that we had intended to give them, and so that we can save for our children's futures. There is no end to my sadness, no stopping of my heart from ripping apart. I look at our twin boys, 2 years old, and although they are my greatest source of comfort they also now fill me with a sadness that should not be there when you watch your children. As I look at them and smile I am also reminded how every minute their father is not here with them, with us. My husband adored our family life and he should be here to watch them grow, to roughhouse with his boys, to give them baths, and put them to bed. Their father should be here to share in their laughter and in their llives. I am now almost six months pregnant with our third son and this too has become what it should not be - instead of excitment for this baby I am saddened that this child will never know his father, that there will never be a picture of holding this baby. At least our twins have that. But this baby is due to arrive on March 19, only two days before birthday, and if by sheer will power I can hold on until the 21st, at least I will be able to tell him that his daddy gave him his birthday. How can anyone put a price onto this loss? All of our losses? Money cannot make us whole, it cannot repair any of the families who are suffering and will continue to suffer always. Thus far the support and the generousity of the Amercian people has been overwhelming. We are all grateful and certainly the monies are and have been needed. But, there is responsibility for this and that is a different issue entirely. I am not alone in feeling that our government let us down. The INS, CIA, and FBI are hugely responsible for this event. The warnings about terrorist acts to come that were not heeded, allowing these men into our country (several of their visas had expired and two of the men were on a list of known terrorists) to commit this act -worse yet to be trained here to murder thousands, lists of known terrorists not being shared with the airlines. One screw up after another all leading to our people murdered. All leading to my husband's murder! Then the airlines having incompetent security, our military not able to reach the plane that struck the second building, people being told that WTC 2 was secure and not to evacuate - people were in fact sent back up after reaching the ground floor, sent back up into a 110 story building that had inadequate fire exits, stair cases, and sprinkler systems. I and many others can go on and on about the incompetence and inadequacies in just about every aspect having to do with this disaster and it is for that reason that we are owed this BLOOD MONEY. Money that should be given to the victims without reducing anything due to life insurance payouts (that we paid for), charitable donations (which was due to an outpouring of support from the public), or any "death benefits" such as social security or workman's compensation. How dare you bail out the airlines and not give what is owed in damages that are insurmontable to families who lost everything truly wonderful and precious that they had. Nor should the government forget about those who survivied and suffered injuries or those who are truly suffering because of loss of their jobs. There is nothing in the world that can repair this. There is nothing in the world that I want except to turn back time and make this all go away. But no one can do that. I used to play with my children, sing to them and now I can't find the energy or the joy to do those things with them. Who can pay them for that? Who can give enough money so that when my son gets on the phone pretending to talk to his daddy who is perpetually "at work", to whom he says repeatedly "daddy come home", that the pain of this can go away? But I assure you, there is an angry, hurt public out there and we will not let this go easily. There are parties responsible and if I and many others are not satisfied with the response of our government, we will sue as we should have a right to. And please, for those of you who have commented saying that this is not a lottery, the victims should not get rich off of this, etc. - may I please assure you that we would like nothing more than to have our lives back the way it was. If my husband or any other victim died because of the incompetence of a doctor or because a car manufacturer never reported the tires they put onto to their cars were not safe - we would be able to sue for compensation and punitive damages. The government, who has already shown gross incompetence, does not want us to sue and that is the reason the government compensation needs to address our needs and our grief in the appropriate way. What has been done to find and assist the business owners now floundering and dying. Standard fare SBA loans with interest, paperwork like an audit and your home as collateral. Bridge loans with interest, that once taken, first payment is due within 30 days. WTC tenants lost their entire location and contents and probably clients. WTC neighbors lost income for weeks. Loans? Gap money to cover lost sales, to supplement personal living expense, to offer emotional support that the government will not allow the initial damage to continue killing more businesses, and will be there to help keep the knocked down small business people standing. Direct, no-strings, grant money, disbursable simply by having a hot-zone small business owner providing a sheet of verifiable info. to one organization. Approval and check with 7 days. Ability to come back if need be. There is cleanup, and dealing with the issues involved with those tragically killed and injured. And there is business to save. 1000s of small business is affected aversely on a daily basis. A beautiful and potent neighborhood to save. 3 Zones. The WTC itself.
