We try to work to heal religious differences, racial differences and educational differences...yet our own country is going through its most devastating time emotionally and economically for the last 50 years and we are not showing compassion to our citizens. If I understand correctly the will of this Fund is to EXCLUDE domestic partners of gay VICTIMS of 9-11. WHAT!? We have overcome so much to learn to not hate people for their sexual preference and this fund seems to take the country back 20 years. Do domestic partners of gay victims not have house payments, or credit card bills, or need money for food and medical care? Most Fortune 500 companies now pay life insurance benefits to domestic partners in a homosexual relationship if they can prove they have been in that committed relationship for 6 months or longer - why can't a fund formed in 2001 follow suit? Is the only reason that you have excluded this group of people is because you don't feel their argument for punitive damages will hold in a US court of law, if they attempt to sue the airlines? Seems to be a purely financial decision in a time when this country needs compassion, from the top down. If the United States wants patriotism and compassion among its citizens, the government needs to start to treat all citizens fairly. We can start by treating gay domestic partners (tax payers!) at least as well as illegal aliens. This importantly should include the partners and children of same sex unions. It puts a face on each and every victim of this horrendous attack. Then I would ask you to reflect on the innocent children that have been affected for the rest of their lives. And, here is my two cents - the government should come up with a flat figure (for example, $250,000 per person - please feel free to go higher). If a family has three remaining members they would receive $750,000. In addition, the charitable organizations should compensate each family and the government should mind it's own business when it comes to these compensations. The money the charitable organizations have received was sent in by the world public specifically for the families affected. They should distribute EVERY PENNY!! Zwick, Director My daughter husband, ,Jr. was killed or should I say murdered on Sept. 11, 2001 at the World Trade Center. He worked for . was a loving, caring husband and father to his wife and two children, 12 years old and 10 years old. He gave his all to his community of Woodcliff Lake, NJ. could never turn down anyone when they asked for his help. was always there when he was needed. He never gave a thought to his own needs. Now he is gone forever. Never to see his girls graduate high school, college, marry or have grandchildren. And they will never have the pleasure of seeing their father at these wonderful occasions in their lives. This will be a very sad Christmas for his family. I have heard that the compensation package offered by the government will be determined by the amount of life insurance my daughter receives. I feel as she does. A common question among those who are involved is how, and to what extent, compensation from the September 11th Victim Compensation Fund will be "offset" by other compensation and/or support claimants have or will receive pursuant to these tragedies. This seems to be a key issue that could greatly affect a person's decision of whether it makes sense to forego certain legal rights by participating in the Fund. For example, one possible scenario is that a claimant who chooses to participate in the fund is required to present evidence of his or her losses, as well as any other sources of compensation he or she has or will receive, prior to obtaining a judgement award from the Fund. In this instance, the amount awarded for the person's loss is directly affected by the additional compensation information. A second scenario is that a claimant who participates in the fund presents evidence of loss to obtain a judgment award, but is not required to present evidence of other compensation received until after the award is determined. Once the award is determined, the amounts the claimant has previously received are deducted from the award. In the first example, a person might be less likely to forego his or her legal rights for suit because it permits the receipt of earlier benefits to influence the extent of that person's loss. In the second example, a person's loss is determined independently without regard to the level of support previously received. This seems to be the more equitable procedure. In the end, obviously, Congress will make the ultimate determination of what the procedures will be. But, in the interim, any information is greatly appreciated. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
